Paulíny, Anna ; Frinta, Ondřej (advisor) ; Elischer, David (referee)
Determination and denial of parenthood with a foreign element Abstract This thesis deals with a significant, still current and well-known institute of family law, which is the determination and denial of parenthood, even in connection with a foreign element. Foreign element in so-called paternal disputes (in connection with the increase in travel and tourism in general) appears more and more often and is one of the pitfalls that may occur in determining and denying parenthood (others may include issues related to artificial insemination). This thesis deals with the historical development of the determination and denial of parenthood from Roman law to the description and analysis of the current legislation in the Czech Republic in the area of the determination and denial of parenthood, as well as examining whether there is a foreign element in them (and what are these possible specifics). For this reason, the individual decisions of the ECHR and the Constitutional Court are analyzed in this thesis because they significantly influence the procedures of the courts of first instance. Furthermore, the thesis describes the decisions of the Court of First Instance - specifically the District Court for Prague 8, which deals with paternal disputes with a foreign element. Thesis also briefly describes de lege ferenda...

The policy of active fatherhood in the Czech Republic in comparison with the Slovak Republic.
Češková, Eliška ; Dobiášová, Karolína (advisor) ; Vlčková, Kamila (referee)
The thesis deals with the active fatherhood policy in the Czech and Slovak Republics. The aim of the thesis is to compare fathers' involvement in childcare and active fatherhood policies in these countries. Then to map the types of measures to support active fatherhood that we can find here, their historical development and legislative anchorages in both countries. Specific measures are embedded in family policies. I am also interested in citizens' attitudes towards greater involvement of fathers in childcare. It is a comparison of two case studies (CR, SR), the current state of the policies is surveyed through expert questionnaires. The interviewees were experts on the area from both countries. The results of the research show us that, although the number of men receiving parental allowance in the countries is not much different, the Slovak Republic lacks the benefit of paternal postnatal care, which would mean a huge advance. In addition, family policy in the Czech Republic is more geared to a greater involvement of fathers, and a motivational bonus is currently being discussed to increase the number of men on parental leave. In the end, there are examples of good practice from Europe that both countries should follow.

Joštic Mrlinová, Barbora ; Hendrychová, Michaela (advisor) ; Šustek, Petr (referee)
With the estabilishment of paternity sooner or later encountered almost every one of us. Although the paternity law and estabilishment of paternity is already known from the times of ancient Rome, it remains a relevant and contentious topic. The aim of this thesis is to comprehensively explore and explain the establishment and denial of paternity in the Czech legal system. The thesis is divided into eight chapters. The first chapter deals with the conceptualization of family and parenthood. It is necessary, because the current Civil Code contains these concepts. However, it does not define them. To further develop the thesis, it is therefore crucial to specify, what exactly those concepts mean within the Czech legal system. The first part of this chapter examines in detail the concept of family, in the second part is dealt with parenthood. In this context, it is illuminated exclusively legal parenthood and disputes between legal, biological and social parenthood. The second chapter focuses on the history of establishment and denial of parentage from the time of ancient Rome, through the period of General Civil Code (1811), the Law on the Right to Family (1949) to the Law on Family (1963). The second chapter is also divided into two sections, namely the historical development and establishing...
Parental Couples' Views on Fatherhood
Pavlíček, Michal ; Pavlík, Petr (advisor) ; Havelková, Hana (referee)
This work focuses on the question of contemporary forms of fatherhood and thus responds to the current discussion about the greater involvement of men in childcare and domestic work. This ongoing discussion is closely associated with the equal opportunities for men and women. However, existing research shows that in most czech families the traditional gender division of family roles, which disadvantages women both within family and work life and limits men in fulfilling their parentel role, still prevails. The concept of active fatherhood presents man as an equally competent parent as a woman who is actively and more equally involved in childcare and domestic work. Poromoting this concept should help to eliminate inequalities mentioned above. The Ministry of Labour and Social Affairs of the Czech Republic, in support of active fatherhood, has conducted sociological research "The Forms of Paternity in the Czech Republic". The qualitative research carried out in this work is based on the research areas of the qualitative part of the mentioned research, specifically the part focused on the involvement of fathers in childcare and their ideas about the father's role. Conducted research tries to provide a more complete picture of the form of fatherhood through the inclusion of women to my research. The...
