Recovery rates and the absolute priority rule

Recovery Rates and the Absolute Priority Rule The paper analyses the relationship between expected recovery rates in bankruptcy and the claim's standing within the capital structure of the debtor. According to the absolute priority rule (APR), the claims in bankruptcy should be always repaid in certain order, i.e. each claim can be satisfied only if all relatively senior claims have been repaid in full. But since the APR is often violated in practice, the actual recoveries may differ significantly from the scenario based on the assumption of adherence to the APR. The extent of the APR violations depends highly on the creditors' position in the bankruptcy proceedings within each particular legal system. The paper investigates the characteristics of bankruptcy codes that allow APR violations as well as both ex-post and ex-ante effect of these violations. In this context, we also analyse the New Czech Insolvency Act which will enter into force on 1st January 2008. The paper aims to provide a step towards understanding the problematic relationship between the recovery rates and the creditors' rights protection within particular legal framework. A Comparison of Curricular Materials in Regards to the Teaching of Civics in the Czech Republic and in the USA

This diploma thesis is a comparative study of Czech and American curricular documents concerning the educational reform that is taking place both in the Czech Republic and the United States of America. By comparing the documents I have tried to find strengths and weaknesses of both reforms and educational systems in general and suggest some means of improvements in areas where I found it useful. I was comparing the documents on more different levels: In the first chapter I was concentrating on two acts as the bases of the educational reforms: No Child Left Behind in the USA and Národní program rozvoje vzdělávání v České republice [National program of educational development in the Czech Republic] in the Czech Republic. The second chapter is dealing with the national curricular frameworks, and is comparing the Czech national framework to Michigan Curriculum Framework. The third chapter is concerned with schools' own curricula, and with the recommended ways how to develop them in both countries. As this thesis is aimed at area social studies and at civic education particularly, the next chapter compares the content standards and benchmarks of both frameworks. Applets and physlets in physics education

This diploma thesis deals with description, analysis and creation of physic applets called physlets. It includes overview of existing sources of applets and their comparison. Detailed table analysis informs about usability and quality of available physlets from different websites. Corresponding lesson plans to the chosen physlets on high school level are contained. I elaborated five worksheet of different level to the three chosen physlets. Some of them are attested on high school students. Softwares for creating physlets are compared according to accessibility, demandingness and usability. Diploma thesis contains instructions to create physlets using softwares Easy Java Simulation and Meta Builder. I published a manual for Easy Java Simulation on the server moodle.cz. Corresponding website informs about the whole diploma thesis. It contains all translated physlets with lesson plans and worksheets.

An Analysis of a Test of School Preparedness in the Context of the Development of Children at the End of Pre-school Age

The thesis concerns various screening procedures applied on pre-school children with regard to their readiness to the school-entry. The chapters with theoretical basis mainly examine children's abilities and skills, like reading and writing, which are thought an essential for the sake of further education. A particular attention is paid to present diagnostic and screening methods, which are aimed at mapping readiness of children for the school-entry. A method that can be in particular useful in pre-school children screening procedures is a newly created Test of school readiness. The test can be used for stopping insufficiently prepared children from entering the school. Moreover, the test is also aiding in finding a suitable way to prepare children for school; and appropriate interventions can be made upon the test results. The actual task was to consider recently prepared method with regard to its applicability and usefulness. It has been compared in the form of sub-tests to previously mentioned Test of school readiness, Orientation test of school maturity (Jirásek, 1970), Compare scheme of school ability (Kondáš, 1984). This master's thesis focuses on studying the function of civil control over local government and maps this practice both in the Czech and the Slovak Republic. It pursues the following questions: what is the role of watchdog NGOs in civil society and democracy? What is the watchdog concept? What is corruption and how to fight against it? Through practical examples and several case studies it describes the basic interactions of watchdog with the local environment, the sources of civil control legitimacy, and the obstacles and limits to watchdog work.

Franchising as a modern form of increasing competitivness of small and middle enterprises

V úvodní kapitole se zabývám konkurencí, jejím obecným pojetím a funkcí. V ekonomickém pojetí konkurence zmiňuji názory "klasiků" ekonomie Adama Smithe a Karla Marxe na konkurenci, kteří ji pojímají jako "střet kapitálu". V textu dále uvádím mikroekonomické dichotomie konkurence- dokonalou a nedokonalou konkurenci a její formy, a konkurenci cenovou a necenovou. Zmiňuji též mikroekonomickou diferenciaci konkurence podle trhu, na kterém ke konkurenčnímu boji dochází, tedy konkurenci mezi nabídkou a poptávkou, trh na straně poptávky (trh výrobce) a na straně nabídky (trh spotřebitele). Na závěr kapitoly uvádím manažerské pojetí konkurence, užívané v praxi. Analyzuji konkurenci na základě Porterovy teorie konkurenčních sil, kterou rozšiřuji o současný pohled na konkurenci v odvětví (podnikatelské oblasti) od J .Jiráska. Druhá část kapitoly seznamuje čtenáře s vývojovými formami konkurence, jak se postupně rozšiřoval její dosah. Uvádím zde konkurenci meziodvětvovou, produktovou, národní, mezinárodní, globální a alianční. V rámci mezinárodní konkurence připomínám teorii komparativních výhod. Závěrem kapitoly rozebírám současnou podobu konkurence, tzv. superkonkurenci. V další kapitole definuji, co je to konkurenceschopnost a všímám si jí na úrovni států a firem. VCL Components for Vector Graphics in the Instruction of Chemistry

Předmětem práce je zhodnocení problematiky vzorců ve výuce organické chemie na střední škole, zhodnocení současného stavu softwaru pro kreslení chemických struktur a vývoj VCL komponent pro chemické kreslení. V současnosti dostupný software je na vysoké odborné úrovni a v chemické praxi má široké použití, nehodí se však pro použití ve výuce na druhém a třetím stupni. Výsledkem práce jsou komponenty pro vytváření, zobrazení a manipulaci s chemickými vzorci jednoduchých organických látek v souladu s požadavky střední školy Součástí práce je také aplikace ukazující základní vlastnosti vyvinutých komponent. Kom- ponenty i aplikace jsou vytvořeny v prostředí Borland Delphi 2005. CD s elektronickou verzí textu, zdrojovými kódy komponent i aplikace a spustitelnou verzí aplikace je přiloženo.

SYSTÉM ŘÍZENÍ PROJEKTŮ V MEZINÁRODNÍ KONZULTAČNÍ FIRMĚ

Tato práce se zaměřuje na problematiku projektového řízení. Jedním z jejích cílů je shrnutí a definice základních pojmů v oblasti projektů, jejich řízení a základních metodických postupů, které by měly být v praxi uplatňovány. Dalším cílem je popis a shrnutí základních a nejpoužívanějších projektových metodik. V této části jsou čtenáři přiblíženy metodiky COBIT, VAIL IT, CMMI, PMBOK a Prince2. Další část práce se zabývá popisem konkrétního projektu s cílem ověřit vykonávání specifických praktik a dosažení cílů požadovaných standardem CMMI, včetně určení úrovní vyspělosti jednotlivých procesů a návrhu kroků a opatření, které vedou k odstranění identifikovaných nedostatků.

Analysis of information science education at universities in the Czech Republic

Práce se zabývá analýzou výuky základních kurzů informatiky na vysokých školách v ČR. Předmětem porovnání je 20 vysokých škol ekonomického zaměření. Práce nejprve vymezuje pojem ?Informatická gramotnost? a uvádí požadavky, které jsou kladeny na informaticky gramotného člověka. Poté toto vymezení rozšiřuje na studenty vysoké školy a požadavky, které jsou na tuto specifickou skupinu kladeny vzhledem k náročnějšímu studiu a budoucímu uplatnění v praxi. Vzniká tak pojem ?Vysokoškolská informatická gramotnost?. V analytické části jsou popsány a hodnoceny jednotlivé kurzy z hlediska stupně naplnění předem definovaných úrovní gramotnosti a to vzhledem k obsahu, intenzitě vyučování, zpusobu zakončení, využití e-learningu a vyučování aplikací podnikové a obchodní informatiky. Závěr obsahuje shrnutí hodnocení a formulaci doporučení pro zlepšení úrovně výuky.

Public procurement practise in the Czech republic

The thesis is focused on the procurement process in the Czech Republic from the perspective of the contracting authority and analyzes legislation in the field of public procurement, understandable definition of certain institutes in the field and evaluation of individual species and tender procedures. The aim is to bring the very essence of a procurement process at the local government level. The theoretical part explains the most important legal concepts and basic principles of contracting procedures. Furthermore chronologically describes the whole procurement process, including analysis of partial processes for selected types of procurement procedures. Results of the work is devoted to the questionnaire survey and controlled interview.
