Charles University, Faculty of Law, Department of European Law Prague, March 2013 The aim of the dissertation is to analyse the role of the European Commission in the legislative process of the European Union with the focus on procedures for adoption of legally binding Union acts. The European Commission is one of the main institutions of the European Union. It represents and upholds the interests of the EU as a whole and manages the day-to-day business of implementing EU policies. However, to limit the role of the European Commission to that of an executive body would be misleading. Its role in the EU institutional system is much broader than that. The European Commission is the most important legislator among the EU institutions and is also empowered with an almost exclusive power to submit drafts of EU legal acts. The rule-making power of the European Commission could be seen from two different points of view. Legislative Process in the European Union: European Citizens' Initiative

This thesis is embedded in the theoretical approach of multilevel governance and presumption of the rational behaviour of actors. Using the method of process tracing it aims to uncover the legislative process in the European Union. It is a single case study and as a case was chosen the negotiation of the regulation of the citizens' initiative. Various actors were involved in the negotiations, this thesis focuses on the main one - European Commission, European Parliament, the Council, interest organisations and national parliaments. The thesis presumed, that all actors will try to push through their interests based on their rational choice. This presumption was verified, although the success rate of the players varied a lot. As the most successful should be considered the European Parliament, who defended the interests of the individuals and the Council, which apparently represented the interests of the governments of the member states (especially in the issues of lowering the bureaucratic burden). The interest organisations showed their positions clearly, however the Commission did not take their positions much into account while preparing the draft regulation. Evaluation of Macroeconomic forecasting accuracy

This thesis deals with real GDP growth forecasting. It includes comparison of predictive performance of OECD, IMF, European Commission, and Ministry of Finance of the Czech Republic in period between 2000 and 2010. Forecast errors for Central European countries are analyzed and compared to forecast errors for G7 countries, which has never been done before. Organizations are benchmarked based on summary statistics, comparison with nave forecast, and directional and sign accuracy. Results of the analysis show that forecasts for expansion period are more accurate than forecasts for recession period. Furthermore, hypothesis that forecasts for G7 countries are on average more accurate than forecasts for Central European countries is not confirmed. This is particularly interesting for the Ministry of Finance of the Czech Republic, which did not outperform other organizations in forecasts for the Czech Republic and apparently has no comparative advantage in predicting economic development of the Czech Republic.
Influence of the European Commission on the Adoption of the Public Service Law in the Czech Republic

The master's thesis focuses on the role of the European Commission in the adoption of the Public Service Law (zákon č. 234/2014 Sb., o státní službě) in the Czech Republic. Its goal is to identify particular European Commission's tools of influence and their utilisation in the analysed case. The case study puts stress not only on hard methods (such as ex ante conditionality), but also on soft forms of influence (e.g. socialisation or persuasion). The Commission's tools were sorted according to Frank Schimmelfennig and Ulrich Sedelmeier's typology: 1) External-Incentive-Model; 2) Social-Learning- Model and 3) Lesson-Drawing-Model. The thesis combines two methodological approaches - process tracing and discursive analysis of relevant Czech actors. Data were collected using semi-structured interviews and publically accessible documents.
Comparation of the EU and US approach towards mergers and acquisitions

This study aims to compare the EU and US approach towards mergers and acquisitions, both from a theoretical point of view (the historical development and regulation) and the practical one(comparing certain cases), identify their similarities and differences, explain it and evaluate. To achieve the goal, the method of comparison was used (especially control procedures and assessing relevant markets). It was also assisted by case studies (specific decisions of the competition authorities), thus that the merger of GE / Honeywell and acquisitions, Oracle / Sun Microsystems. The work is divided into four chapters. The first chapter approaches the topic in terms of their development and legislation. The next two chapters introduce the merger control in both systems. The last chapter deals with cooperation between the competition authorities of the EU and the US. Chapter also compares the specific cases in which both teams have decided differently.

Hlavným cieľom diplomovej práce je kriticky analyzovať politiku Európskej Únie a jej dopad na činnosť nadnárodnej spoločnosti E.ON. Keďže politika Európskej Únie má za cieľ zefektívniť spôsob podnikania vykonávaného v rámci Európskej Únie a okrem iného má predstavovať garanciu zodpovednosti jak spotrebiteľov, tak dodávateľov operujúcich na trhu, tak zámer práce bol definovaný na analýzu politického vplyvu rozhodnutí Európskej Únie a ich dopad na následné strategické rozhodnutia firmy. Analytická čas práce je preto zameraná na analýzu Európskej energetickej politiky s kladením dôrazu na profil spoločnosti E.ON, Európsku energetickú stratégiu, obnoviteľné zdroje, jadrovú energetiku, bezpečnosť energetickej dodávky a na Európsky systém obchodovania s emisiami.

Text juniorní analytičky Terezy Novákové Komisi chválí za pokrok v souvislosti s vytvořením energetické unie a unie kapitálových trhů, pozitivně je hodnocena také reforma struktury Komise a portfolií. Naopak nejhůře hodnotí pokrok v dosažení dohody TTIP a v sociální oblasti a zdraví a nedostatek pokroku v oblasti ochrany životního prostředí a klimatu.

European Arrest Warrant in Theory and Practice

The bachelor thesis deals with the European Arrest Warrant in theory and practice. In the theoretical part, the thesis is primarily focused on the legal regulation of the international judicial cooperation in criminal matters within the European Union, its development from a historical perspective and its current status. In the second part, the thesis deals with the practical performance of the European Arrest Warrant and with the related complications. The issue here is, that after ten years of the enforcement of the European Arrest Warrant, many doubts over its performance and subsequent impact on the fundamental rights of citizens have raised.
Alternative Dispute Resolution in the EU Internal Market through the SOLVIT Network

This Bachelor's thesis deals with alternative dispute resolution in the EU internal market via SOLVIT network. The aim of this work is to provide a comprehensive view of the functioning of SOLVIT mechanism and to clarify the way in which it can help citizens and undertakings that are adversely affected by unlawful decisions of national administrations which acted contrary to EU law. Emphasis is made on the structure of SOLVIT network, its activity, cooperation with the European Commission and its role in the context of other ADR systems. The last part of this work deals with analysis of the effectiveness of the mechanism.
