Guindon, Ľubica ; Hýbnerová, Stanislava (advisor) ; Honusková, Věra (referee)
Ľubica Guindon :Universalism of Human Rights in the Light of pluralism of African cultural values The purpose of this thesis is to analyze actual discourse in international law terms about universal or culturally determined characters of human rights. This theoretical problem is introduced with the focus on legal qualification of female circumcision (FC/ FGM ) in international human rights protection. The study goes beyond the scope of international law and reaches cross-disciplinary analysis related to the African context and its cultural, political and social factors. Chapter One addresses the theoretical issues of the notion of human rights, its sources and models in international law. This passage challenges an African approach to human rights bills including a catalogue of individual duties towards family, state and society as a whole. This concern about collective identity of a person within his or her community is a very important feature of African understanding of human rights and human dignity, and can enrich the universal consensus in this field. Within the theoretical issues of the international human rights protection it is necessary to look at the global, regional and local dimension of legal regulation. Political Philosophy of John Gray
Černý, Kryštof ; Znoj, Milan (advisor) ; Bíba, Jan (referee)
Precis The Political philosophy of John Gray touches a number of topics and also has gone thrue a couple of modifications. However this thesis aims to show that there can be found a consistent political doctrine of agonistic liberalism in Gray's thought that arises from his critigue of rationalistic theories of liberalism. Agonistic liberalism is based on the naturalistic ethical theory of value-pluralism which Gray adopted whit some modifications from Isaiah Berlin. On the ground of incommensurability and uncombinability of some values within individuel lives as well as within life forms Gray comes to conclusion that the conflict of values is ineradicable part of our lives. And that's the reason why any legel or political theory cannot set up a set of liberal principles that could claim universal validity. That is why Gray sets up the concept of modus vivendi, political ideal of coexistence of individuals, groups and societies based on mutual toleration. With regard to the rational indeterminacy of conflicts over values, according to agonistic liberalism these conflict has to by resolved by political means.

In order to exert influence, the organisations have to penetrate the complex decision-making system. This thesis scrutinises their strategies as well as analyses the institutional framework and its impact on the civil society organisations. The research builds on several complementary theoretical approaches including theory of lobbying, political opportunity structures or new institutionalism. Using the process-tracing method, this thesis analyses causal mechanisms linking interests of civil society groups and changes in the EIDHR programming documents. Melčák, Miroslav ; Veselý, Rudolf (advisor) ; Kropáček, Luboš (referee) ; Mendel, Miloš (referee)
Waqf (pI. 'awqi() emerged in the first century after the birth of Islam, and spread to the whole of the Middle East to become one of the most distinctive features of its societies. Although waqfs played many different socio-economic roles, their significance has up to now usually been described by means of the dichotomic concept distinguishing between waqf chayri (charitable endowment) and waqf 'ahli (family endowment), the first having been established as a kind of charity to provide free social services to the population (mainly mosques and madrasas), the latter as a tool for evading inheritance rules (ilm al-jarii'i), which, if applied, would cause the fragmentation of properties into uneconomical units. This concept originated in the period of the 19th and 20th centuries when the new legislation was beeing produced in Middle East countries to restrain waqf as an obstacle to social and economic progress. The thesis traces a history of this dichotomic concept in the context of modem Egypt. First it discusses the waqf policy of Mul).ammad cAli in the first half of the 19th century, then the development of the central waqfbureau up to the end of the 19th century, and the process of conferring property rights to the land which caused an unprecedented expansion of family-like endowments during the first half...
