Anchoring of the Concept of Flexicurity in the CR in the View of Rational Choice Theory and of Sociological Institutionalism

This diploma thesis is a single-case study analyzing promotion of the concept of Flexicurity principle in the CR through the Open Method of Coordination (OMC). The concept of flexicurity began raising European integration actors' awareness since early 2000s. That was due to considerations how to strenghten competitiveness of the EU Member States' economies during growing expansion of more liberal markets such as China, and in the same time to maintain the European social model based on the concept of welfare state. In 2007, there was adopted EU's definition of Flexicurity. Flexicurity began to be promoted by the OMC. This thesis responds to the lack of studies analyzing the influence of the OMC in specific policy areas. The author analyzes literature, relevant legislation as well as their explanatory reports, National Reform Programmes, Czech government's policy statements, and interviews with representatives of tripartite actors who take part in social dialogue. The study explores how does the OMC work in the case of Flexicurity promotion. The aim is to find out which of the selected theories is more suitable for describing the way Flexicurity is anchored in the CR. Flexible forms of working hours

- Flexible forms of working hours Flexibility is hotly debated term in the recent years and not only in a relation to labour market. This diploma thesis deals with flexible forms of working hours, which represents one of the means to achieve greater flexibility of labour law as well as flexible labour market. Increased options in adjusting working hours based on the needs of the subjects of labour-law relations contributes to more efficient use of employees work, provides new possibilities for some risk groups of employees on the labour market and helps employees in achieving work- life balance. These factors also have positive influence on unemployment rate. The thesis is divided into four chapters, which are further divided into subchapters. The first chapter introduces selected legal principles with the regards to the subject of the thesis. Main focus is on subsidiary relation between civil and labour law and "what is not forbidden, is allowed" principle, which is crucial for flexible forms of working hours, followed by an overview of selected basic principles of labour-law relations and introduction of flexicurity concept. Flexible Forms of Employment

Flexible forms of employment This diploma thesis deals with the flexible forms of employment as an alternatives to regular form of employment. The focus of the first two chapters is to determine the basic terms regarding the topic of this thesis; the following chapter concentrates on the flexible forms of employment regulated by Czech law in particular, i.e. Fixed-term contract, part-time job, homeworking, agreements on work carried out beyond employment and agency employment. In the scope of introduction of the particular flexible forms of employment this thesis in detail deals with the Czech law regulation of these forms of employment and follows up their benefits and drawbacks to the parties of the before mentioned agreements. The thesis briefly mentions some legal issues besides the labor law, especially the issues from fields of the social security law and the tax law.
Women between family and work. Conditions for harmonization of work and family in Prague

Diploma thesis "Women between family and work: Conditions for harmonization of work and family in Prague" is focused on current problem which is being dealt with on national as well as supranational level. The aim of this thesis is to describe the factors influencing harmonization of family and professional life of the mothers with children from two to six years old in region of Prague and find out whether the policy of state and regional governments reflect these factors. Chosen factors are described from the macro perspective but individual influences are also dealt with. On one hand the attention is allocated to state policy, especially from the point of view of Ministry of Labour and Social Affairs, but also from the point of selected municipality - municipal authority of Prague and municipality Prague 17.
Options of harmonization of work and family in terms of setting the pillars of flexicurity in the Czech Republic

Bachelor thesis "Možnosti harmonizace práce a rodiny z hlediska nastavení pilířů flexicurity v ČR" deals with situation regarding the setting of two of three pillars of flexicurity (numerical flexibility and jobs protection, employment protection supporting functional flexibility) and possibilities of harmonization of work and family in the Czech Republic. The goal is to evaluate which actions of flexicurity there are in our country and what effect they have on the situation regarding the reconciliation of work and family roles and what could be improved in this issue. Within the evaluation of the current situation was described and evaluated the system setting of childcare, which contributes by a large degree to opportunities for females on labour market and thus also to harmonize work and family. The issue has been consulted from a gender perspective. Also the system of active employment policy and lifelong learning, which contributes to functional flexibility, was described and evaluated. The second part is created by the results of interviews analysis, which were performed by the author with experts from organizations such as MPSV, Hospodářská komora, ČMKOS or Gender Studies. The concept merges two apparently opposite components of labour market, i.e. flexibility and security. Furthermore, this approach has been spontaneously developed in Denmark and the Netherlands and became an inherent part of socio-legal labour market policies promoted by European Union at the beginning of the twentieth century. First part of this paper reviews a situation of both components of flexicurity in the Czech Republic at the time when this thesis is formed. It describes the evolution of unemployment as well as the degree of flexibility and security on the Czech labour market and compares them with current situation in the rest of European states. Second part analyses flexible forms of employment in the Czech Republic, such as part-time jobs and its microeconomic implications. Contractual freedom versus protection of employees

This diploma thesis deals with the problematics of the contractual freedom and the protection of employees in labour law relations and the concept of flexicurity which seeks to find balance between these two opposing notions. Its main objective is to evaluate the applicable Czech legislation regulating formation and termination of an employment relationship from the view of flexicurity, including by proposing possible changes of legal instruments within the framework of reflections de lege ferenda. The first part characterizes the contemporary Czech labour law legislation and the concept of flexicurity, followed by its reflection into the Czech Labour Code. This part concludes with an introduction of successful flexicurity models. The following part analyses both development and understanding of flexicurity at European level with the focus on impacts of EU strategy for the Member States. The key parts of this thesis are parts number three and four which deal with the legislation regulating formation and termination of the employment relationship in the Czech Republic. In this theses I explain the concept of flexicurity aplied in the conditions of Czech Cepublic. The main goal was to explain the impact of flexicurity on competitiveness in the social and economic framework of Czech Republic. The main topics are labour market processes, social protection and lifelong learning strategy as 3 main pillars of flexicurity working togehter to fight unemployment and support employment and labour market flexibility, to ensure a right mix of social protection for people.
Women and labor market - coordination of family and working life due to implementation and working of flexicurity in social and economic conditions of Slovak republic from 2004 to 2015

The diploma thesis is dealing with mutually linked relations between family and working sphere of working women, mothers in sense of dependency on availability and possibility to use the measures how to coordinate family and work. Such measures coordinating family and work are very important part of concept known as flexicurity, combining required flexibility of labor market and social securities. The goal of the thesis is to answer the question: Is effective implementation and working of concept of flexicurity under actual social and economic conditions of slovak labor market possible? The theoretical part describes the concept of flexicurity itself, its pillars, especially the measures how to coordinate family and work. These are the inevitable assumption of effective implementation and working of the concept in practice. To meet the objective the combination of quantitative and qualitative research is choosen. According to research findings the diploma thesis concludes, that even the availability and possibility to use the measures of family and work coordination up allow some level of organization of family and working time, actual social and economic conditions of slovak labor market are inadequate in order to effective implementation and further working of concept of flexicurity.
Protection of pregnant women, maternity and parenthood in labour law

The aim of the bachelor thesis is to examine the extent of the legal protection that is provided to pregnant women, women on maternity leave, and parents on parental leave, to evaluate the granted protection in terms of flexicurity and to suggest possible solutions. Firstly, it is focused on the general principles of labour law related with the topic and the relationship between labour law and civil law. In the descriptive part, the thesis deals with the basic legal aspects of the protection of pregnant women,maternity and parenthood. The aspects will be evaluated in terms of flexicurity. Furthermore, the most problematic sections of the law, especially the issue of employment of pregnant women, the onset parents back to work, and opportunities to work during the maternity and parental leave will be analyzed. In conclusion, the current state will be evaluated as well as the possible points of improvements and the description of suitable flexible forms of work will be possessed.
