Cílem této práce je prozkoumat rozsah právní ochrany, která je poskytována těhotným ženám, ženám na mateřské dovolené a rodičům na rodičovské dovolené, zhodnotit poskytovanou ochranu z hlediska flexicurity a navrhnout možná řešení. Nejprve je práce zaměřena na obecné zásady pracovního práva, které s danou problematikou souvisí a na vztah pracovního práva s právem občanským. Poté, v deskriptivní části, se práce zabývá základními právními prvky ochrany těhotných žen, mateřství a rodičovství, které jsou hodnoceny z hlediska flexicurity. V práci jsou dále rozebrány problematické úseky právní úpravy, především otázka zaměstnávání těhotných žen, možnosti práce v průběhu mateřské a rodičovské dovolené a nástup rodičů zpět do práce po skončení mateřské a rodičovské dovolené. Závěrem je zhodnocen stávající stav, navrženy možné změny a popsány vhodné flexibilní formy práce. The aim of the bachelor thesis is to examine the extent of the legal protection that is provided to pregnant women, women on maternity leave, and parents on parental leave, to evaluate the granted protection in terms of flexicurity and to suggest possible solutions. Firstly, it is focused on the general principles of labour law related with the topic and the relationship between labour law and civil law. In the descriptive part, the thesis deals with the basic legal aspects of the protection of pregnant women,maternity and parenthood. The aspects will be evaluated in terms of flexicurity. Furthermore, the most problematic sections of the law, especially the issue of employment of pregnant women, the onset parents back to work, and opportunities to work during the maternity and parental leave will be analyzed. In conclusion, the current state will be evaluated as well as the possible points of improvements and the description of suitable flexible forms of work will be possessed.
