Liquidation of probate estate due to excessive debts

This thesis deals with one of the civil procedure institutes, liquidation of probate estate due to excessive debts, also known as liquidation of heritage that is newly designated as liquidation of inheritance. The thesis aims to comprehensively cover the liquidation-of-inheritance-procedure, from the opening of inheritance proceedings till the issuance of the decision resolving the case. The thesis is divided into five sections. Introductory section explains the terminological shift from the concept of liquidation of heritage to the concept of liquidation of inheritance, it acquaints the reader with the legislation changes that took place at the turn of 2013 and 2014 and it outlines the differences between liquidation-of-inheritance-procedure and the standard inheritance proceedings. The second section of the thesis seeks to define the concept of liquidation of inheritance. The definition is being found within the sense and purpose of the legislation of this institute and it is also stated that the legal definition of this institute has not been legally established. In the third section of the thesis, there is a concise summary of development of the liquidation-of-inheritance-legislation in Czechoslovakia and the Czech Republic since the late 19th century to the twentieth century. Image of Napoleon's age in Czech history text books

Bachelor thesis named Image of Napoleon's age in Czech history text books deals with the views of Napoleon I. Bonaparte through historical sources and literature from the 19th century to the present. The Austrian aspect pointed in two directions, Bonaparte's military art on one hand, the celebration of his defeat on the other. The Czech-French alliance was highly beneficial for The First Republic; Napoleon I was even included in textbooks at the time. During the Nazi occupation the view of Napoleon as a statesman and military leader prevailed. The communist doctrine emphasized the rise of Bonaparte's skills and his defeat by the commoners during the invasion of Russia. The thesis tries to show the French emperor in the context of the 19th century and present day, including the creation of the cult of Napoleon I and traditions related to battles that took place. The institution of legacy in Czech and Italian inheritanc

The thesis deals with one of the reinstated institutes which are introduced by act number 89/2012 Sb., that is by the new Civil Code and it is the institute of Legacy. This work is divided into five chapters, where firstly it discusses the characteristics of this institute in Roman Law and compares it with the institute of fideicommissum. In addition this work deals with characteristics of this institute in Italian law from the times of Unification of Italy up to the present day, therefore it briefly deals with both of the Italian civil codes. The most extensive chapter deals with the institute in our own legal history, especially about its form in ABGB, the "warp" and the "middle" code and it is followed by chapter, which deals with our new Civil Code, which has returned this institute into our Inheritance Law. The whole work is concluded by a comparison of the similarity of this institute in Italian and Czech legal order. This work is elaborated on positive note and its aim is to show that this is very practical institute, which is in both ours and Italian law very similar even though it has been developing for centuries. I believe that it could become normal part of donation mortis causa.
Inheritance contract as a new institute of succession law

The present work deals with an ancient and new-old legal institution of inheritance contract in actual private law. Inheritance contract (pactum successorium) was in the Czech legal order in the 50s of the last century as a traditional historical institute of inheritance law, and was conceived as the strongest inheritance title; its conclusion was nevertheless permissible only between husband and wife or fiancé. The mentioned problems began again to be relevant in the context of the government's draft of Act no. 89/2012 Coll., Civil Code (hereinafter the Civil Code), for the approval of the Chamber of Deputies took place on November 9th, 2011. The re-codification represents a return of inheritance contract to the Czech succession law, but it has also brought a number of other major institutes that current regulation for a long time neglected or did not even know. Institute of inheritance contract emphasizes the will of the testator, to whom gives another opportunity to arrange his property in case of death (mortis causa). The Iron Curtain and Its Heritage in the Context of Transformations of the Borderland of Czechia in the Second Half of the 20th Century This bachelor thesis deals with the Iron Curtain and its heritage, which is related how the Iron Curtain is commemorated to us today, and how we can look at the history of the Czech borderland affected by this former barrier. The thesis first introduced the phenomenon of the Iron Curtain and the problem of defining the borders. Then there is the form of discussion with the literature discussed how the Czech borderland changed by the Iron Curtain and its subsequent fall, and what was in this context of the research. It is discussed what is heritage of the Iron Curtain, and its possible use. Own research here is established at first, which is the comments of the Iron Curtain today, and what we can say these comments. Another part of the thesis is focused about the presentation the past of the Iron Curtain, and what people, visitors to the Museum of the Iron Curtain perceive about it. Different types of interviews are detected another interesting finding information on the borderland and the influence of the Iron Curtain. The development of the subject orientation of land change science can be divided into two phases. (i) During the first phase (50's/60's of the 20th century) the description of landscape and its morphology (structure) were at the centre of research interest along with the research of the potential for agro-production. This thesis deals with a specific group of historical sites called World Heritage, which are registered on the UNESCO World Heritage List. It characterizes the basic elements of the UNESCO World Heritage idea as a cultural and social process, which engages in acts of remembering that work to create ways to understand, present and interpret the past within the present social frameworks. The thesis brings to the attention a range of viewpoints about the nature of heritage in general and the UNESCO World Heritage in specific that have emerged in the relatively new area of academic interdisciplinary heritage studies. For the purposes of exploring different aspects of the World Heritage phenomenon, following themes of heritage discourse have been developed: remembering and making public use of the past, the UNESCO approach and the ways of presenting and interpreting the past. In order to give a sense of what World Heritage looks like on the ground this thesis details some aspects of three different World Heritage sites. To study such matters in the physical world a strategy of undertaking case studies of three specific UNESCO sites and employing the methods of direct observation and a fieldwork were chosen. Legacy of current law of succession

1 Abstract Legacy of current law of succession This master's dissertation focuses on the traditional legacy of Roman law institute which, through the law no. 89/2012 of the Civil Code, has found its way back to the Czech legal system. The text of the paper is divided into two main parts which are not split equally by what they cover, however, the aim of the dissertation determined such division. The first part the dissertation outlines the historical foundations for the nowadays' form of the legacy. In short, the shape of the Roman law is covered in the introduction as an essential ground for further law adjustments. A comparison of two, from these days' perspective most important sources of law modification - the legacy's modification of the ABGB, and the modification of unimplemented government proposal of civil code of 1937 - follow. The comparison is replenished by an overview of the diminishing legacy's modification of civil code of 1950, and of the final legacy's refusal in civil code of 1964. The second part of the dissertation covers the in-force legal form of the Civil Code. The current form of the legacy is elaborated, following the taxonomy of the law. The three Polynesian women writers - Florence (Johnny) Frisbie (b. 1932, Cook Islands), Patricia Grace (b. 1937, New Zealand) and Sia Figiel (b. 1967, Samoa) - represent three key stages in the development of Polynesian literature in English that are intrinsically linked to the transforming post-colonial context. Miss Ulysses from Puka-Puka: The Autobiography of a South Sea Trader's Daughter by F. J. Frisbie, published in 1948, is being defined as the founding text of this new literature. The autobiographical work is set in the Polynesian colonial background. Patricia Grace belongs to the first generation of Polynesian authors writing in English. She participates with them in the so-called "Maori Renaissance" that is embedded in the larger pan-Polynesian movement of resistance against British colonial hegemony and of indigenous cultural revivals started in the 1960's. Sia Figiel is a leading writer in the already established Polynesian contemporary literary scene of the 1990's. The region is almost entirely independent by now. The privileged literary themes and the linguistic choices of these three indigenous authors, together with their selected narrative techniques, reflect the on-going political and cultural emancipation of the autochthones. TRANSFER OF INHERITANCE TO HEIRS Abstract The aim of the rigorosum thesis is to clarify the issue of transfer of inheritance to heirs. Particular chapters of the thesis are defined at the beginning. Main attention is given to the current regulation of transfer of inheritance to heirs set in § 1670 - § 1713 of the current Czech Civil Code. First of all, the inheritance and the decendent's estate are characterised for a better understanding of the chosen topic. Particular key terms related to the issue of transfer of inheritance to heirs are explained then. The administration of inheritance, the administrator of inheritance, his rights and duties, subject of administration of inheritance, free disposal of property, differences between simple and full administration of inheritance are mentioned. The inventory of inheritance, its aim, order, reimbursement of expenses, substitution, and incomplete inventory of inheritance and the issue of status of creditors is discussed as well. The closure of inheritance and the way of distribution of inheritance based on last will of decedent, determination of third person, agreement between heirs, decision of court, related settlement of heirs and allocation of claims and debts is analysed later.
