Relocation of the registered office of a company
Čechová, Linda ; Brodec, Jan (advisor) ; Dobiáš, Petr (referee)
Error! Unknown document property name. English summary The aim of the thesis is to present the possible ways of a relocation of a registered office of a company to other member state of the European Union. Furthermore, I tried to focus on common complication which can be faced in practical realization of such transfer, as well as on forthcoming legislation and possible perspectives which can be expected. I believe that this topic is very current and progressive and that the wish for cross-boarder movability of companies will be increasing. The thesis is composed of ten chapters, each of them dealing with different aspects of relocation of the registered office. Chapter One is introductory and defines basic terminology used in the thesis and reasons why I've devoted myself to this subject matter. Chapter Two examines the term "personal statute of a company". The chapter consists of six parts. Part One focuses on registered office of a legal entity. Part Two investigates the term personal statute itself. Part Three addresses the issue of theory of the Registered office and the Part Four the opposite theory of Incorporation. Part Five briefly introduces some other theories and Part Six contains a summary and my own opinion. Chapter Three is subdivided into three parts and provides an outline of relevant Czech...

Geometric Brownian motion in Hilbert space
Bártek, Jan ; Beneš, Viktor (referee) ; Maslowski, Bohdan (advisor)
The present work describes the relation between solutions of a special kind of nonlinear stochastic partial differential equation with multiplicative noise, driven by fractional Brownian motion (fBm), and the solutions of deterministic version of this equation. Solution of the stochastic equation is given explicitly by means of solution to the deterministic equation and trajectories of fBm. The geometric fractional Brownian motion plays an important role here. The solutions are considered both in strong and weak sense. Stochastic integral wrt. fBm with Hurst index H can be defined in various ways. Here we consider a Stratonovich type integral for H > 1/2. The results obtained are used for the study of properties of solution of stochastic porous media equation - the expected value of total mass of the solution and the long-time behaviour of the solution.

Lease and ownership of non-residential premises
Oravcová, Lucia ; Salač, Josef (advisor) ; Švestka, Jiří (referee)
Lease and ownership of non-residential premises Resumé The objective of my thesis is to describe in detail the current lease (sublease), and ownership of non-residential premises as well as their expected changes in the new Civil Code. Within my thesis I branch out into several chapters in which I try to provide a comprehensive view on the legal legislation of the concepts of a lease, sublease and ownership. I have analysed these terms and referred to the current as well as previous judgments where the legislation appears to be ambiguous, notably judgments delivered by the Supreme Court. Chapter One is introductory and defines basic terminology used in the thesis, non- residential premises. Chapter Two is subdivided into parts which I dedicated to lease of non residential premises. This part of my work is devoted to a brief historical overview and current legislation of lease of non-residential premises most notably in view of selected parts of the Act No. 116/1990 Coll, and Act No. 40/1964 Coll. It provides an outline about creation of lease, particulars of the contract, rights and obligations of the lease and termination of lease. Act No. 116/1990 Coll. is significant as it restores the rights, which were removed during the period of socialism, of owners of non-residential premises to rent their property....

Statistical applications of urn models
Navrátil, Radim ; Omelka, Marek (referee) ; Pawlas, Zbyněk (advisor)
This work shows various applications of urn models in practice. First, basic properties of the occupancy distribution are derived together with its asymptotic approximation. This model is applied and generalized in the theory of database systems for records search from a given database. An application to random texts is mentioned, namely the computation of the expected number of missing and common words in random texts. There are presented exact formulas, their asymptotic approximations and the approximations via occupancy distribution. Then, some urn models, which are used in the randomized response theory for finding out respondents' answers to sensitive questions, are described. These models are compared according to their accuracy and respondents' goodwill to answer. Finally, two non-parametric tests of empty boxes are derived, one for the hypothesis whether a random sample comes from a given population and the second for the hypothesis whether two independent random samples come from the same population. The powers of these tests are compared with commonly used tests for these hypotheses.

Divorce and the legal regulation of relationship between parents and a child after divorce
Zelenková, Monika ; Frintová, Dita (advisor) ; Hendrychová, Michaela (referee)
61 6 Divorce and legal regulation of proportion of parents to the minor child for a period after divorce 6.1 Resumé This diploma deals with the Czech legal regulation of divorce of marriage and status of the minor child during and after the divorce procedure. In the second chapter, following the introduction, is described the divorce itself. The divorce is the only possible legal dissolution of the marriage throughout spouses' life upon the qualified breakdown. As demanded by law, the qualified breakdown has to be deep, permanent and the restoration of cohabitation cannot be expected. The Czech legal regulation recognizes tree forms of divorce, (i) non-contentious (consensual) divorce, (ii) contentious divorce and (iii) divorce with harshness clause. Non-contentious divorce (hereinafter referred to as "consensual divorce") was amended in our legal regulation in 1998 by the act No. 91/1998 Coll. In my opinion this consensual divorce is the best how to dissolve the marriage from the point of view of the protection of the child's interests. The advantage of the consensual divorce is that spouses have to set off all their rights and obligations relating to their marriage (i.e. property relations, living situation, agreement on the status of the minor child after the divorce, … etc.). Without any doubt the...

Chování vybraných členských států EU v rámci dluhové krize (aplikace teorie her)
Novotný, Martin ; Dubský, Zbyněk (advisor) ; Sršeň, Radim (referee)
Thesis uses game theory to explain behavior of certain states in the European sovereign-debt crisis. The goal is to find out, if those states use strategies leading to equilibrium i.e. if they maximize their expected utility. Theoretical part is based mainly on repeated games and Bayesian game. Thesis summarizes development of European sovereign-debt crisis and key economic indicators. It constructs a game model of the crisis and further analyses situation of Germany, France, Italy, Spain and Greece as players in the game. The game model is then tested on key conflict situations such as relations of France and Germany, first Greek bailout negotiations or Spanish bank bailout negotiations. The results show that chosen states do maximize their expected utility in one election period. However maximization of utility in two or more election periods is limited by the parameters of democratic election system - length of election periods and information asymmetry between voters and politicians. The costs of elimination of information asymmetry would be higher than the costs of debt crisis. So even considering the costs of debt crisis the states are in long term equilibrium.

The NGO'and Prague 7 City District in the Area of Providing the Drug Prevention Services
Soukupová, Kamila ; Dohnalová, Marie (advisor) ; Moree, Dana (referee)
The aim of the diploma thesis is to describe the system of cooperation between the NGOs and Prague 7 City district on the field of providing the services of anti-drug prevention. In September 2008, the pilot project of Prague centre of primary prevention was starteed. If the project is successfully realised , it is expected, hat the cooperation between the NGOs and particular Prague city districts will be systematized. Firstly , the thesis briefly introduces the activities and the status of two workers, who are responsible for for the collabaration with the NGOs, that provide the preventional activities. These workers are: the school methodist of drug prevention and the anti-drugs coordinator. Then the attention is paid to thier "anchorage" within the scheme of anti-drugs politics in the Czech Republic and their relationship with the NGOs. The following part of the thesis is devoted to the process of the certification, that is an important instrument for the NGOs to get the money from the state budget. One of the chapters deals with the laws, strategical and methodical documents, that refer to the implementation of the anti-drugs prevention. I chose two organizations to make a survey with them. These organizations provide almost identical services in the Prague 7 area. I made the interview with the...

NATO - Russia Relations in the New Millenium
Konecký, David ; Kotyk, Václav (advisor) ; Krines, Vlastimil (referee) ; Eichler, Jan (referee)
The subject of the dissertation thesis focuses on relations between the North Atlantic Treaty Organization (NATO) and Russia in their post-9/11/2001 phase. The theoretical framework is provided by the realist school of thought with a special focus on the "defensive" strand of that school. The thesis has two main goals: the primary goal tests a validity of a statement "Confrontational aspects of the NATO -- Russia relations prohibit any significant mutually beneficial cooperation between the NATO and Russia", the secondary goal aims to create a robust body of primary-source information (with 31 December 2007 deadline). Confrontational aspects of the NATO -- Russia relations have been analyzed in the basic conceptual documents of both Russia and the NATO with following conclusions: (1.) Russia does not accept certain characteristics of NATO, (2.) NATO is not prepared to change these characteristics to meet Russia's objections. But as shown in the thesis, these conclusions do not prevent either side to state a conceptual preparedness to an interest-based cooperation. The other important aspect -- conventional and nuclear weapons balance -- has been analyzed in depth from both the static and dynamic point of view. The positive impetus generated through a rhetorical action immediately after the 11 September 2001 resulted in the creation of the NATO -- Russia Council (NRC). In comparison to the previous phase of the NATO -- Russia relations, the NRC comprises both evolution (prioritization of the content) and revolution (rejection of the previous form). But the positive impetus seems to be failing to generate concrete joint political or practical cooperative actions. Nevertheless, examples can be found of mutually beneficial cooperation between the NATO and Russia: operation Active Endeavor, search and rescue at the sea, project for fight against Afghan drugs, Cooperative Airspace Initiative. These examples do falsify the statement as defined under the primary goal of the thesis. As for a possible future development of the NATO -- Russia relations, the thesis concludes: (1.) No further upgrade of form is to be expected over a longer term, (2.) NRC is and will be and an import forum for a political dialogue, (3.) Mutually-beneficial cooperation will probably materialize through smaller-scale projects, (4.) Freezing of relations cannot be excluded, when an important political signal is to be sent, (5.) In spite of the Russia's denouncement of new military installation in Europe the fact is that the European perimeter is and will be for Russia far more secure and predictable than her Southern and South-Easter perimeter.

Historical development of the legal regulation of the residential ownership institution
Čejková, Šárka ; Salač, Josef (advisor) ; Dvořák, Jan (referee)
57 Summary The aim of my thesis is to outline historical development of institute of ownership of apartments and his changes due to economical progress and political changes. In our country institute of ownership of apartments was put into practice by Act No. 52/1966 Collection of law. Although this law was very progressive compare the period and situation when it was adopted, it didn't reach quality of acts set up institute of ownership of apartments in western European countries. Modern institute of ownership of apartments with all appropriateness, which are matter of course everywhere in the Word, was initiated finally by Act No. 52/1966 Collection of law . Description of development of institute of ownership of apartments should help to understand better current legal regulation of ownership of apartments and disclose main drawbacks persisting from the past or deficiencies by legislator never solved. In first chapters my aim is to define conception of ownership and idea of apartment according to regularization and interpretation made by person with degree. Above all the interpretation of conception of apartment is quite difficult and in our legal order unsolved. In relation to development of legal regulation and expected reception of new civil code (in year 2012) we can expect considerable changes in...
