Parental separation and awarding custody of pre-school aged child

This thesis focuses on the topic of parental separation and awarding custody of pre-school and early-school aged children. In the theoretical part the specifics of each developmental stage and also of the mother's and father's role are described. In the following chapter the thesis focuses on the process of parental separation, its phases, causes and its influence on children. Also the most typical phenomenons and risks connected with this complicated situation are mentioned. Not to be forgotten, the legal side of the process is also included. The thesis contains empirical part, in which structured interviews with social workers were led, in order to map current trends, the most serious risks, the possibilities of different forms of custody and the role of psychologists in parental separation in the Czech environment. Joint custody - its assumptions, strengths and potential weaknesses in the light of psychology

This bachelor thesis deals with joint custody in relation to its assumptions, strengths and potential weaknesses in the light of psychology. The theoretical part provides insight into the context of the form of contemporary family, with the issue of divorce and its impact on all involved individuals and with different forms of parenting. The legislative grounding of post divorce child care and its possible forms in the Czech legal order is also covered. The psychological assumptions of joint custody of both the parents and the child are emphasized to a great extent. On the basis of these findings are drawn possible strengths and weaknesses of joint custody. Last but not least are presented different approaches to joint custody among a few selected countries. The final part of this thesis is designed as qualitative research project focusing on the evaluation of joint custody from the perspective of individuals who have personal experience with this post-divorce arrangement. Potential risks of joint custody of pre-school child

The present bachelor's thesis deals with the possible risks of joint custody of preschool children. At the beginning there are some notes on family and the factors which can lead to its break-up. Then the three possible after-divorce arrangements which are allowed by the current legal regulation of the Czech Republic are defined and described. The core of the thesis is the chapter on joint custody, which describes its most frequently cited advantages and shortcomings which also presents previous research into this topic. The next chapter describes selected areas of the preschool period of child development, which are linked to the divorce of the parents, and to the pros and cons of joint custody. Emphasis is placed on the risks of this after-divorce arrangement, which should be taken into account by parents, as well as by courts. The final part of the thesis is the proposal for a research project in this field.
Psychological Context of Shared Custody

5 Abstract This bachelor thesis concerns the issue of shared custody as a form of post-divorce arrangement. The overview part comprises a short introduction to issues related to family transformations, divorce rate in the Czech Republic, legal definitions of marriage and divorce, and conditions of both it's formation and dissolution. A separate chapter also regards the consequences of absence of one of the parents during child-rearing. The thesis further encompasses an overview of various types of post-divorce arrangements, their incorporation in Czech legal system and the terminology used in English-written research articles. The very substance of the overview part of this thesis is the shared custody itself as a form of post-divorce arrangement and factors affecting it. In relation to shared custody I mention both it's advantages and disadvantages for everyone involved, shared custody from the children's point of view, characteristics of families going through with shared custody and experiences with it from abroad. Finally, the thesis outlines a draft of a qualitative research project, which aims to examine factors affecting the process of shared custody in Czech families based on interviews with their family members, where shared custody, at least for a limited time, took place. This bachelor thesis deal with adjusting ratios of minors with divorce proceedings of parents' marriage. This work characterizes and analyses the current legislation valid in the Czech Republic in response to a brief overview of earlier legislation. On the theoretical basis is built a practical guide of the whole guardianship proceedings. The bachelor thesis analyses substantive and procedural aspects of this issue. The objective of this work is good cognition of the basic legislation valid in the Czech Republic, because this knowledge means prevention against possible injudicious action of parents, which can negatively affect successful development of minors.
The relationship of parents to minors with regard to the specifics of domestic violence

The dissertation thesis "Relationship of parents to minors with regard to the specifics of domestic violence" focuses in particular on judicial proceedings in cases of custody of minors where family relationships are affected by domestic violence. It attempts to explain why it is necessary for the courts to take into account this fact and to adopt such measures within their decisions to provide sufficient protection to persons at risk and at the same time to stop violent behaviour. Domestic violence as a dangerous social phenomenon is described in detail; information on its individual appearances and forms is brought; briefly mentioned are also other scientific disciplines whose knowledge is important not only for the recourse of offenders and the protection of victims but also for creation of a strategy of effective prevention. Negative impacts on mental state of minors are stressed, who must be viewed in all cases of domestic violence as its victims, i.e. also when the violent behaviour is not immediately directed against them. The alternate care in the families with a history of domestic violence

The theme of this bachelor's thesis is the issue of joint custody in a context of problems of families with a history of domestic violence. The theoretical part describes the main characteristics of joint custody, the conditions for its court order and the basic legislative frameworks on which it's based. Attention is also paid to the proponents or opponents of this form of child care in the post-divorce period. The reader is introduced to the specifics of domestic violence, its dynamics and impact on a child in a family. In the end of the theoretical part are described some of the forms of possible solutions that the existence of domestice violence in conjuction with the joint custody requires. The practical part deals with case studies of families with a history of domestic violence in which was applied the joint custody on the basis of a court decision.

The thesis "Shared Custody - Advantages and Disadvantages" focuses on joint custody as one of post-divorce arrangements. The theoretical part summarizes important position of a family in child's life, the position of parents and children in the time of divorce, and covers shared custody after divorce. It points out pros and cons of shared custody in more details and summarizes presumptions for its successful implementation. The survey represents opinions of professionals on shared custody, its pros and cons as well as important criteria such as suitable time interval and suitable child's age for joint custody. In addition, personal experience case studies are added for better illustration. The aim of the thesis is to point out aspects that are necessary to focus on while choosing this type of post-divorce arrangement.
The issues of marriage divorce and its consequences

Mr. Eduard Němeček, MD Divorce issue and its consequences Diploma Thesis 5. Summary: This work proposes a closer look at the divorce-related topics with consequential impacts both on financial situation of divorced spouses and destinies of minor children as resulting from divorced marriages in Czech Republic. Till date, this issue has been solved in different ways at both district and regional courts. In our republic, a more unifying element is represented by decisions of the Supreme and Constitutional Courts. This is a very serious social phenomenon which, according to statistics affects a large number of parents, children, but also childless partners. Yet from ancient times this phenomenon is known to be socially undesirable being almost entirely rejected by the Catholic Church in its canon law. The increase in divorces has resulted namely from the advancement procedure of society. It is a societal phenomenon known to occur irrelatively of the states and political systems, from the totalitarian regimes through those autocratic, up to highly democratic systems of developed countries worldwide.
