Pospíšil, Petr ; Weiss, Tomáš (advisor) ; Šlosarčík, Ivo (referee)
The basis, upon which this thesis has been built, are the two following trends: occurence of terrorist attacks in the EU and creation of new counter-terrorism institutions on the EU level. A frequency of both trends has been rising: the occurence of terrorist attacks on the EU territory has increased despite the closer cooperation in security and counter-terrorism area that can manifested by adopting new measures and designing new institutions. Therefore, the author asks a question: What factors are hindering a better functioning of the EU counter-terrorism mechanisms? The six most significant EU counter-terrorism institutions with exclusively or overwhelmingly counter-terrorism mandate is subjected to analysis. The respective limits of their functioning have been subsumed to a classification that was created by the author using the general institutional theory, in particular the theory of regimes. The attention is given to an interplay between the EU counter-terrorism bodies and their counterparts on the national level. In case of every institution that has been explored, the author evaluates the following criteria. Firstly, presence of a "patterned behaviour" in sense of cooperation between the national counter-terrorism bodies and the EU institutions. Secondly, a subjective perception of such...

Drhlíková, Eva ; Kozák, Kryštof (advisor) ; Raková, Svatava (referee)
Freedom of expression is a fundamental human right which is important not only for the intellectual integrity of an individual but also for the healthy development of the whole society. The work represents both general arguments for freedom of expression and codification of freedom in two different legal cultures. In the United States the freedom of expression is protected by the First Amendment of the Constitution, which complements the rich jurisprudence of the Supreme Court of the United States. In Mexico, the right is regulated in Article 6 of the Constitution. The work shows how both countries reached the current legislation on the basis of examination of legal developments and cultural values. The values of the societies are presented on the basis of Hofstede's cultural dimensions. The core of the thesis is to compare the legal limits, which is made primarily on the basis of judicial practice of the Supreme Courts of both countries. Emphasis is placed on four main areas which are related to freedom of speech: (i) fighting words including hate speech, (ii) symbolic speech, (iii) obscenity, and (iv) defamation. In addition to the legal limits the work interprets also the most significant actual limits in both countries. Finally, the author examines the relationship between freedom of expression and...

Lenc, David ; Vokoun, Rudolf (advisor) ; Šámal, Pavel (referee)
1 Abstract THE CONCEPT AND LEGAL CONSEQUENCES OF THE TRANSGRESSION OF THE LIMITS OF SELF-DEFENCE AND NECESSITY As the name suggests, this Master's thesis examines the concept and legal consequences of transgression of the limits of self-defence and necessity. Self-defence and necessity, together with other circumstances excluding illegality, belong to the fundamentals of criminal liability. If all their conditions are fulfilled by some action, which would otherwise give raise to criminal liability, then these legal institutions exclude not only criminal liability, but also illegality of such action (i.e. such action is considered lawful). The purpose of the paper is to provide complex and understandable analysis of these two crucial legal institutions. The analysis is mainly focused on conditions of these legal institutions, which form their limits; determination of conditions which, if not met, constitute the transgression of the limits of self-defence or necessity, and content and cases of fulfilment or failure to fulfil these conditions. (Thus, the cases of the transgression of the limits of self-defence and necessity are examined.) After the analysis of such excesses, the thesis addresses specific issues connected with their legal consequences. The thesis is based on Czech legal regulation, namely the...
Freedom of speech, its guarantees and limits in the context of Czech media
Šťastný, Ondřej ; Hofmannová, Helena (advisor) ; Gronský, Ján (referee)
(K práci pouze volně přikládám, protože abstrakt není vyžadován platným zněním Rigorózního řádu Právnické fakulty Univerzity Karlovy). Mgr. Abstract This work deals with the selected aspects of the freedom of speech as it is guaranteed in Czech, International as well as European law. Special focus is put on the limits of the freedom of speech and its conflicts with other basic freedoms. Important part of the work is dedicated to the core cases, whit traced the shape of the freedom of speech in the Czech Republic in the 2000s. For the most part, these are the frequently discussed cases...
