Resumé Limity svobody projevu ve světle judikatury Evropského Soudu pro lidská práva Tato práce pojednává o svobodě projevu a jejích přípustných limitech tak, jak tyto hranice deklaruje Úmluva o ochraně lidských práv a základních svobod (dále jen "Úmluva") v článku 10. Svoboda projevu je každému garantována. Nicméně svoboda projevu není absolutní, omezování svobody projevu prostřednictvím zásahů vnitrostátních orgánů do svobod jednotlivce je možné za splnění přítomnosti některého z ospravedlnitelných cílů dle odstavce 2 článku 10, při současném užití tzv. testu legality, legitimity a proporcionality. Čili jinými slovy, opatření užité vůči osobě musí být stanoveno zákonnou normou, musí sledovat dosažení legitimního cíle a musí být nezbytné v demokratické společnosti. Tento test Evropský soudu pro lidská práva (dále jen "Soud") aplikuje vždy, když shledá zásah do svobody projevu přítomným. Tato práce se zaměřuje na judikaturu Soudu ve věcech stížností pro porušení svobody projevu s ohledem na posuzování přípustnosti užití legitimních limitačních klauzulí ze strany vnitrostátních orgánů aplikujících právo. Struktura obsahu této práce věcně odpovídá skladbě článku 10 odstavce 2 Úmluvy, co se týče zajištění cílů dosažených omezením podle okruhů ospravedlnitelných důvodů zásahů do svobody projevu. Limits of freedom of expression in the light of case-law of the European Court of Human Rights This diploma thesis deals with the freedom of expression and its permissible limits as those declared in Article 10 od the European Convention on Human Rights (hereinafter referred as "Convention"). Freedom of expression is guaranteed to everyone. However freedom of expression is not absolute, restrictions on freedom of expression by the intervention of the national authorities to individual freedoms is permissable in case of existence any justifiable targets pursuant to paragraph 2 of Article 10. We named this procedure by test legality, legitimacy and proportionality. So, in other words, the measures used against a person must be established legal standards, must pursue achieving a legitimate aim and be necessary in a democratic society. European Court of Human Rights (hereinafter "the Court") applies this test whenever it finds existing interference with freedom of expression. It focuses on case law precedents, set by the European Court's of Human Rights (hereinafter referred as "Court"), in cases of complaints for violation of the freedom of expression concerning the admissibility of the use of legitimate aim clauses by national authorities applying law.
