The principles of private law
Čermák, Dalibor ; Dvořák, Jan (advisor) ; Elischer, David (referee)
The Principles of Private Law In my thesis I occupied myself mainly with representative principles that master private law and that should lead to the implementation of the idea of justice as an ultimate goal of a legal set of rules in general. Despite of Sisyphean character of this task and impossibility of reaching it, there is nothing that can discourage from trying it again and again. I would like to admit that this attempt was at least ambitious and meaningful. Inability of perfect recognition "an sich" turns attention into extralegal sources of information, such as ethics, political sciences, sociology, economy and the head of all sciences - philosophy. This thesis also reflects intuitive approach to the principles of private law as a result of dependency on my personal preferences and cited sources and their authors (which also reflects my own disposition). The main issue was a function of the principles of private law in the normative set of rules. These principles make an important place in the normative set of rules as they form its limits. We can hardly imagine its "commission" without such principles of private law. They protect the integrity and the compactness, because Czech private law is nowadays extremely heterogeneous complex of rules. According to the restriction mentioned in the...

Chromčíková, Viktória ; Zoulík, František (advisor) ; Pohl, Tomáš (referee)
Types of civil proceedings written by Viktória Chromčíková Abstract This thesis deals with kinds of civil proceedings which have developed for protection of rights in private law sphere. Courts are the authorities that provide protection for rights. In civil proceeding they judge disputes in private law and other issues provided by special acts. There are several kinds of civil proceedings that have developed in time. The history of civil proceeding is described in the first chapter of this work. In the other chapters there are particular kinds of civil proceedings existing according to the present Czech law analyzed. Adversary proceedings resolve the usual dispute of two parties which obtains all that it takes - proceeding is initiated by a petition against a certain person. There must be a hearing held in the case where the both parties are heard (they have the same opportunity). Opposite to this procedure there are proceedings where there is no dispute in the case, but the decision of a court is obliged according to a special act. There is a special public interest on this judgment (decision). Therefore this kind of proceeding can be initiated in official duty and principle of investigation is applied. Execution is initiated only in private interest and is complied with different principles than the...

Resumé - Cizí jazyk The Development of the Czech Republic Pension System and Its Application in the Legal Form The In this thesis I presented a comprehensive overview of the current pension system in the Czech Republic and introduced some changes to the pension system of the Czech Republic that has been already clarified or will be very probably clarified by the modifications in the legal regulations. The content of my thesis is directly related to the pension reform in the Czech Republic and I also described some impacts of the modifications in the legal tax regulations system.Czech Republic is another country that will have to deal with unfavorable demographic progress of its population such as increasing number of seniors and decreasing amount of subjects that contribute to the pension system. That might result in the financial instability and that is also a reason for preparation and implementation of the Czech pension system reform. I'm convinced that pension system as a part of the country's social system is one of the crucial economics cornerstones of every country. Laws that support the pension system are subjects of significant modifications in the recent years. Such modifications are content related, it means that new laws are created or current laws are modified. The execution of the laws changes...
Types of civil procedure
Vágnerová, Martina ; Macková, Alena (advisor) ; Pohl, Tomáš (referee)
The attempt of this diploma thesis is to give a comprehensive analysis of all of the components of civil procedure. Civil procedure represents the united process on the outside, but is differentiated inside. We can distinguish five types of civil procedure and within the finding procedure two other types - controversial and uncontroversial. All of these types are constructed on the same basis which is right to a lawful trial. This is the basic principle of justice in general. Considering the scope of this area the diploma thesis focuses on the determination of the elements that are common to some types, and within the frame of the particular types mainly on answering the present questions connected with them. By the characteristics of the finding procedure the attempt is to determinate the principal differences between controversial and uncontroversial procedure and, in connection with that, also to outline the future course in this area. In the chapters concerned with execution and insolvency procedure, the thesis is concentrating primarily on the determination of requirements which must be met to carry out these procedures. In connection with execution procedure there is also outlined this year's amendment, which means some kind of transfer of the judicial execution on the executors. Within the frame of...
