Factors Affecting the Quality of Joint Custody for Children after the Parents' Divorce

In this thesis I deal with the factors that affect the functioning of alternate care for children after the divorce of their parents. In the theoretical part I deal with topics such as family, child development and parenting, marriage, divorce and joint custody. In the practical part I work with specific cases of families that are undergoing alternate care for children and the content of websites whose main theme is an alternate care. The aim of the study was to define the factors that affect the quality of alternate care for children after parental divorce. The partial aim was to categorize websites and nongovernmental organizations presented on the Internet, whose main theme is joint custody, according to their main opinion on the joint custody. To meet these objectives, qualitative research was performed using semi-structured interviews with several families which at the time used joint custody. Further analyzed were selected websites that deals with information about joint custody and the reasons why it is or is not suitable. The results of the work showed that in defined cases there is a correlation between the high number of positive factors that affect the functioning of alternate care, satisfaction with care and alternate subjective feeling that alternate care in this case works. Shared Custody

This thesis is a theoretical study that characterizes shared childcare after divorce as the most suitable post-divorce arrangement. This assumption is based on developmental changes in the European family from the time of the French Revolution, the development of family law and important aspects of family law, as well as on the needs of children, and definitions of maternal and paternal love. This hypothesis is also supported by the results of foreign research, which compares the lives of children in different post-divorce arrangements. The following paper discusses mediation as an appropriate way of helping parents achieve a solution that is suitable for all participants in the dispute. In the conclusion some case studies are presented.
Lone-parent families as a public policy problem: stakeholders' frame reflection and reframing

The main theme of the work is finding an answer to the question why in the past years Czech Parliament has failed to enforce measures improving the quality of life of lone-parent families, and what could be done for these measures to be adopted. Theoretical support for answering both questions is provided by a) frame analysis (Schőn and Rein), which works with the idea of conflicting frames and bridging conflicts through reframing, and b) the theory of social construction of target groups (Schneider and Ingram). Based on an analysis of stenographic minutes from proceedings dealing with the issue of non-payment of child support (in particular with proposals for the state to pay child support first and then to receive it from the obligor) and the arrangements connected to child custody (in particular the proposal to strengthen alternating custody), conflicting frames are reconstructed (in the case of non-payment, there are three conflicting frames, in the case of child custody two). These conflicting frames, or rather the fact that they are insufficiently addressed, may be the cause of the incapacity of Czech political representation to address the above agenda. An "efficient penalizing of the debtor" is described as a possible reframing of the problem in the field of non-payment of child support....

The family law recognizes also other forms of care, but both joint-custody parenting is rarely used in the Czech Republic. However, there is a tendency to change the state affairs in recent years. Supporters and opponents of joint custody voice their arguments in the public sphere, but relatively little attention has been paid so far to those who are supposed practice joint custody parenting, the parents. That is why, the focus of my research has been a comparison of experience of mothers and fathers practicing joint custody of their children in the Czech Republic. Concretely, I wanted to study whether, similarly with foreign studies, the mothers and the fathers experience joint custody differently. Divorce proceeding for children in the context of gender arrangements in families

In the theoretical part of this work I will explain the basic concepts: the role of women and men in the family, their functions in the formation of gender identity of the children, the effects of divorce disputes in terms of economic, social and mental impact of gender on the children in post-divorce custody. In the empirical part of work I will do research using qualitative methodology. I will also use a semi-standardized interview for data collection and observation as an additional method. I will work with a target group of divorced parents who experienced disputes where the custody of the child was awarded to one of the parents. I will conduct interviews with respondents who live in a small town of up to 50,000 inhabitants. I will be choosing interviewees bearing in mind that the questions will be of a personal and sensitive nature. The first respondents will be selected with and an aim in mind. Then I will proceed using a "snowball technique" in the respondents´ natural environment. All interviews will be carried out in the strictest confidentiality. The result of the qualitative survey of this work will be an in-depth description of the investigated topic "The consequences of divorce disputes for children in the context of gender arrangements in families ," or the hypothesis. In addition, conclusions will be reached on how with hindsight parents should have resolved conflicts to maintain a functional relationship between the child and the other parent.
Experiences of kindergarten teachers with shared custody and their attitude to this custody.

This Bachelor's thesis inquires shared child custody after divorce. In a theoretical part it is mentioned, when the shared custody, as a form of a child custody after divorce, was implemented. It also refers to its low frequency. The problem of shared custody is clarified here and a presentation of a research all over the world comes after. A difficult situation after divorce is mentioned afterward, an explanation haw difficult this period is, not only for parents, but also for children, who are overlooked usually, themselves. Further forms of child custody are mentioned in the end. Methods, used in the research, are presented in a methodological part. Information got from nursery school teachers are analyzed in a practical part. It is about their point of view of shared custody and of their experience with this form of custody.
The dilemma of a social worker in connection with the proposed alternate care for minor

In the theoretical part, there I devote to the family itself, what are its functions, further I deal with a marriage and parenthood. In the next chapter I explain the divorce with minor children, causes of the divorce rate and the children´s reactions to the divorce. This is followed by a chapter on the social worker dealing with the children´s social and legal protection, his roles and competences, which dilemmas he encounters during his work. Last but not least I deal with the mutual and alternate care. What are prerequisites of the successful alternate care, its advantages and disadvantages. I chose a technique of a semi-structured interview for the qualitative research. There is a minimum of topics and questions that the interviewer must discuss. These basic topics and interviews then are attached by various other additional topics that the interviewer seemed to be meaningful or suitable to an extension of the original assignment. Data obtained through the interview I worked out using the coding. The research sample has been represented by the department of the children´s social and legal protection. This department belongs under the department of social affairs in municipalities with extended powers. Specifically, they were social workers of this department who I gained all the necessary information for the research from. The aim of this thesis was to describe the dilemmas of the social worker in the area of the social work in connection with the decision on the alternate care for the minor child. The research showed that there still prevails the number of children, who are placed by the court in the sole custody of mothers in the Czech Republic. It more often happens, that children´s fathers who were for the alternate care at the beginning, after a certain time revise their opinions and decide to leave the education of the children to their mothers. Regarding the dilemmas of the social workers dealing with the children´s social and legal protection, there are situations which occur more and more. These are especially situations when parents cannot agree on any rules on which the alternate care could run smoothly. In those above mentioned situations the child is placed in the sole custody to one of the parents. The everyday problem of the social workers is a large number of clients. The main reason for this is a growing number of divorces. To be able to cope with so many clients, all leads to the fact that the social workers are forced to reduce their time, energy, but also their attention which is to be paid to individual clients. Specifically in České Budějovice, the social workers from the department of the children´s social and legal protection lead only very few consultations with their clients directly in their office. It is especially due to the lack of their time, because they more often go to investigate a particular family on demand of the court. Many social workers meet the fact that the family wants to realize the alternate care, but for the reason of the non-cooperation of the both parents most of the alternate cares come to an end. As for the forms of the alternate care, most families realize a week alternate care. Mainly it is at the primary school-age children for the reason that the children are small and after a short time they miss the other parent. A 14-day alternate care is realized at the older children. They usually dislike their permanent moving from one parent to the other. A contribution of this thesis is to provide a topic for the social workers dealing with the children´s social and legal protection, to use it in their own practice in connection with the alternate care. Finally, the results can be used for an evaluation of the social workers´ approach to the families wishing to realize the alternate care.
The care of a child after a divorce in terms of the alternate care

An alternate care of children after a divorce or parent´s separation is not only in Czech Republic still more common. Although it appears less than other models of child care, the number of split up families with this kind of care increase every year. The thesis analyses model of alternate child care. The theoretical part outlines kinds of child care models after parent´s separation. The development of divorce rate and children entrust in the world and Europe is presented in the thesis. Further, there are shown consequences of parent´s separating for the child with emphasize of gender irreplaceability of parent´s roles. The thesis describes potential influence of parent´s separating for the child in short term and long term period and points at negative consequences for the child if one parent doesn´t get involved in child´s life. The thesis occupies with assumptions of running an alternate care, its positives and negatives for kids and their parents. The aim of research part is to discuss different views at alternate care of parents, who practise alternate care and experts like psychologists and psychotherapists, who deal with alternate care in their professional experience. The main research query was to look into the parent´s view at positives and negatives of model of alternate child care for their children. The issue of alternate care is analysed through qualitative research with method of halfstructured interviews with opened questions. Connections among certain phenomenons occuring at alternate care are monitored. The results of research of both research groups show, that alternate care is, supposing keeping certain conditions, mostly positively accepted.
Joint Physical Custody after Divorce - Advantages and Disadvantages

In 1998 an amendment of the Family Act of 1963 made it possible, following the example of western countries, to entrust children to joint physical custody of parents, after their divorce. This gives them the possibility to equally share the upbringing and making decisions in important matters concerning their child after their divorce. This form of post-divorce organisation of child care is relatively new in this country, and that is why we have little experience with it so far. Specialists who are in contact with the questions of the joint physical custody present a number of both advantages and disadvantages. The objective of my diploma thesis was to map the particular questions, find out how the professional and non-professional public view the joint physical custody, and subsequently, compare these results. My further objective was to describe the advantages and disadvantages resulting from the shared parenting. My research was based on the hypothesis that the professional public regarded this post-divorce organisation of child care as suitable, further on the hypothesis that non-professional public was not sufficiently informed about this possibility of post-divorce organisation of child care, and, last but not least, the statement that there were differences between the attitude held by the professional and that held by the non-professional public to the questions mentioned. Two of the three hypotheses were confirmed in the course of the research. The conducted research is of explorative character, it combines elements of quantitative and qualitative research. To conduct it I used the method of questioning by means of an anonymous questionnaire, the data obtained were processed in the computer SPSS programme. In questions containing qualitative data, I conducted a qualitative content analysis. Another technique that I applied was the secondary data analysis. The research sample was made up of randomly chosen representatives of both professional and non-professional public from the Regions of South Bohemia and Hradec Králové. My thesis will serve as a feedback for specialists dealing with this field, it will be used for the needs of the Children and Family Crisis Centre in České Budějovice. Its results will serve for the improvement of information of professional and non-professional public.
