Determination of Parenthood - Alexandra Hrušáková Abstract In my thesis "Determination of Parenthood", I focused on the largest area of family law. Everyone's life is influenced by his family the whole life. And there are many consequences connected to the relation between a child and his parents. My topic responds lively to the changes brought by current scientific and technical progress and dynamic development and metamorphoses in our society. I tried to describe it in a complex way, but in order to put accent on the most important segments of this problem. From the times of ancient Rome there exists the principle "mater semper certa est, pater incertus", which means that the identity of the mother is always certain, but the father isn't. However there exist some situations in which the principle could not be so clear. These situations created objective of this thesis. This thesis is divided into ten chapters. The aim of the thesis is to define content of various aspects of parenthood as they are currently perceived and treated in the legal order of the Czech Republic. The theme is reflected in the work with regard to its historical legal developments, including the reflection of the current Czech legislation. Mentioned is also legislation in terms of international law. It often represents the direction of Czech legislation. The main idea of the domestic legislation parenthood child's interest and the protection of basic human rights. The child is seen as a specific body of legal rules with all its peculiarities and increased need for legal protection with regard to their position in society. For contemporary society, which is child-centered, that is child-centered, are issues related to the rights of the child and his relevant status and position is important to be dealt with in relation to the child as possible and thoroughly as possible. Welfare of women during pregnancy and maternity The main aim of this thesis is to identify and analyse key issues within the current welfare system for woman during pregnancy and maternity. This will then allow recommendations to improve Czech legislation. The reason of choosing this theme is my deep interest in this sphere. The thesis discusses a broad range of issues over eight chapters; each chapter examines different aspects of the issue. First Chapter simply defines basic terminology associated with the subject. Chapter Two deals with the history of women's welfare during pregnancy and maternity and describes how legislation for those women has evolved over the past years. Chapter Three puts women's welfare in an international and constitutional context. Chapter Four examines the two main subdivisions of legislation. Part One is concerned with doses of the health insurance system. Part Two deals with doses of the state social support. Chapter Five looks at women's welfare during pregnancy and maternity in labour law. Chapter Six illustrates the approach to imprisoned women and their rights during pregnancy and maternity. Legal issues of Surrogacy

This master thesis deals with the issue of legislation of surrogacy. Development in the area of reproductive medicine as the first "test tube baby" in 1978 and following medical progress has inevitably brought development expansion of this institute. This institute, although that it brings with itself many ethical, social and legal questions, is not legally regulated in the Czech Republic (except one provision, Art. 804 of the Civil Code). Therefore, this master thesis tries to provide a proposal of legislation which might be adopted in the Czech Republic, using primarily analytical and comparative methods. After the surrogacy is explained and forms and models of it are described, the international framework is clarified. Although many states realize actuality of this topic, there has not been any international legislation adopted that would regulate e.g. surrogate tourism, until this day. However, there is a certain guideline, namely the interest of a child, as the European Court of Human Rights judged. Changes in the concept of the child and childhood

This thesis examines the changes in perception of the child and the childhood from the Early Modern Age until today. Primarily, the thesis investigates the quality of life of infants and education advice concerning the first year of age. The historic part of the thesis addresses the changes in infant treatment depending on the social status of the mother. Further, the thesis discusses the possible origin of these changes in folk traditions and examines the role of authorities by reference to historical education guide books. Moreover, the thesis points out the influence of science and rationality on the infant treatment. Given the fact that there is no summarizing research available about the infant treatment in the 20th century, the thesis analyses different infant approaches using education guide books from this time period. Using data from a survey among contemporary mothers, which investigates their beliefs about infant education including the origin of these beliefs, the thesis aims to analyse the most popular guide books among the mothers. The findings from the research are used to outline problematic aspects of the present-day motherhood. The fathers on parental leave in the Czech Republic

This diploma work is focused on the situation of fathers on parental leave in the Czech Republic. The aim of research is to find out how fathers feel on their parental leave, what is positive or negative for them and how they evaluate this experience. The theoretical part describes the legislative framework of parental leave and parental allowance and explains the concepts such as femininity, masculinity, maternity and paternity. Then I deal with gender stereotypes and situation on the labour market, and their influences on the decision for starting parental leave. Then I formulate arguments for more father's participation in taking care of children. The empirical part is focused on a qualitative research. The research was realized by interviews done with 10 fathers on parental leaves, and analyzed by coding. Then I made a connection between new data and theoretical resources which are described in the first part. At the end I indicate the posibility of doins some other research, for example with both parents.
Voluntary childlessness as a social phenomenon

This diploma thesis deals with the topic of voluntary childlessness, which, among other things, with regard to the low birth rate, resonates by our society. Its aim is to describe the concept of voluntary childlessness from a sociological point of view, to summarize existing sociological researches on this topic, and primarily to analyze the opinions and motives of women who have opted for voluntary childlessness. For the practical part is used qualitative method of Grounded Theory. The research itself takes the form of in-depth semi-structured interviews, which, thanks to the possibility of responding to specific communication partners, offer the opportunity to look into the lives and values of voluntarily childless women. The conclusion summarizes and interprets knowledge about the opinions and motives of voluntarily childless and offers the professional public a better understanding of this issue.
The Social Condition of Sole Wage Earners - A Comparative Analysis of Family Policy in The Czech Republic and France

This thesis discuss various steps how institution of family policy in France and the Czech Republic influences the social status of single mothers, or how it affects their standard of living an opportunities. The thesis is based on a comparative analysis of two measures. The first one concerns possibilities of work-life balance, the second one means of prevention from poverty. The key factor influencing work-life balance is the interplay between maternity/ parental leave, public childcare accesibility and flexible working time practice. The character and availability of allowances completes the picture of what the prevailing gender principles in each family policy are. Hence, it also demonstrates the situation of single mothers.
