Atypical Forms of Employment

The thesis deals with atypical forms of employment, from their definition, through legal regulation to their use in practice. Atypical employment is a highly topical issue in labour law. This is confirmed by the development in the European Union countries, where an increasingly clear shift from the typical employment relationship model to atypical forms of employment can be observed. Atypical employment can be a tool to promote higher employment rate, flexible adaptation to the requirements of the labour market and reconciliation of work and family life. The thesis consists of an introduction, three chapters systematically divided into subchapters, and a conclusion. The first chapter deals with the development of labour law in the Czech Republic. The second chapter deals with labour law in the sense of its concept, subject and position in the legal system. The core part of the thesis is its third chapter, which deals with selected atypical forms of employment regulated by the Czech legal system. Title of the thesis: Temporary agency employment Abstract The topic of this diploma thesis is temporary agency employment. Temporary agency employment is a type of employment intermediation realized with the cooperation of three entities - the employment agency, the user undertaking and the temporary agency worker. Based on this institute of labour law, temporary agency workers may be assigned to user undertakings to work there temporarily. Temporary agency employment is a popular way of recruiting a labour force, as it provides the possibility to respond relatively quickly and effectively to the need to increase or decrease the number of employees. This work aims to summarise the essential characteristics of temporary agency employment and to point out some problematic aspects of the Czech legislation related to temporary agency employment. The text of this thesis is divided into six chapters. The first chapter deals with employment intermediation and its individual forms. Comparison of recruitment, selection and hiring of staff between the staff agency and the employment agency

The thesis deals with the comparison of the activities of a recruitment agency and an employment agency. The content of the thesis is divided into theoretical and empirical parts and consists of six chapters in total. The theoretical part contains the necessary concepts to understand the issue of job search through an agency. On the basis of the literature, the development of agencies in the Czech Republic is described, where the development of the labour market during the pandemic is also mentioned, the next subchapter deals with the differences between agency employment and outsourcing, the differences between a recruitment agency and an employment agency are also described, it is also explained who is a recruitment consultant. In the next subsection, the methods of recruiting workers, the advantages and disadvantages of staffing services and what other services agencies can provide to other entities are presented. There is also a description of the internal processes of agencies and an introduction to the associations and professional guarantees of staffing and employment agencies. - Agency employment The name of my diploma thesis is the agency employment. Nowadays, the institute of agency employment is a widespread phenomenon on the labour market. It is a very popular institution for employees as well as for employers, which is being changed under the demand of society needs and according to valid legislation. I have chosen this topic due to its timeliness and flexibility with which the agency employment reacts to the growing unemployment rate. Since the capacity of the agency employment is very vast, this diploma thesis aims to approach the fundamental issues and concepts relating to it. The aim of this diploma thesis is to offer a complete overview of the institute of temporary agency work. Temporary agency work is an institute that brings to the user undertakings the possibility to quickly adapt to the increase or decrease in demand for their products by changing the number of employees. The first part of the diploma thesis presents a brief excursion into the history of temporary agency work with focus on the most important historic moments and includes the explanation of its impacts. This chapter emphasises Czech history of temporary agency work, but it takes a quick glance at the history of temporary agency work in other states. The institute of temporary agency work was introduced to the Czech legal system as late as 2004. This point is very important to understand the uneasy position of agency employment on our labour market. The main part of this diploma thesis concerns current legal status of temporary agency work. - Agency Employment For my thesis topic, I have chosen "Agency Employment". It's a relatively young institute, which was incorporated into our legal system only on October 1st, 2004. I believe that Agency Employment topic can be always considered current and positive, because it allows us to flexibly react to the needs of the job market. Since the topic is very broad, the goal of this paper is not a detailed analysis of all aspects of this institute, but only a few of them that I consider to be most important. I shall present and evaluate current law governing the subject and also try to point out its flaws. I have structured the thesis into 4 chapters, further divided into subchapters. Attitude of people to employment agency and agency employment in the Czech Republic

Agency employment is a unique flexible tool, which is able to respond quickly to changing conditions and demands of the current labour market. It also provides flexible employment contracts and employment to risk groups in the labour market, thereby it helps to reduce unemployment. However, the flexibility of agency work is accompanied by high uncertainty. Agency employment is in the Czech Republic still underestimated and its use does not reach the level of most European countries. This may be caused by the prejudices and stereotypes of Czech society based on the generalization of the illegal activities of some employment agencies on all agencies and by the importance of job security for the majority of the Czech population. The aim was to detect and analyze the attitude of the people to the employment agencies and agency employment. Results from own representative research showed that people in the Czech Republic don't trust to employment agencies, they wouldn't use the while searching the job and they wouldn't accept the job in the form of agency employment. Their attitudes then differ depending on their own experience with agency employment, their awareness of functioning of employment agencies and sociodemographic characteristics, namely gender, education and personal income. Identifying obscured employment or: How to avert the associated risks Summary The thesis explores the issue of obscured employment and obscured agency employment. Its roots are in practical experience and real needs of actual subjects. In practice, the issue of obscured employment and obscured agency employment is particularly important in relation to outsourcing of one's business activities to another person. However, the current legal regulation is not perfectly clear when it comes to definition of these two legal problems and their identification in practice. This is true especially in relation to the issue of obscured employment. Thus, the goal of this thesis is to identify the elements defining obscured employment and obscured agency employment. Added value of this thesis is then introduction of possible ways of how to organize an outsourcing relationship so that the relevant authorities do not assess such relationship to be obscured employment or obscured agency employment. In other words, how to avert the risks associated with obscured employment and obscured agency employment. The topic of this rigorous thesis is agency employment. Agency employment constitutes now a common part of the market with employment services and enables employment agencies to temporarily assign their employees to perform work at users. The thesis defines the concept of agency employment and describes its roles and functions which are typical for agency employment. One of the biggest user benefits of agency employment is the possibility of quick and effective workforce procurement for a wide range of different professions. The thesis contains a definition of agency employment at both the international and EU level. The thesis also presents international legal sources of agency employment adopted at the UN, EU legal sources of agency employment and legal sources of agency employment under the Czech legal order. 1 Agency employment with a cross-border element Abstract The topic of this diploma thesis is agency employment with a cross-border element. Employment agencies cover the shortage of workers on the Czech labor market by assigning foreigners to users. The thesis analyzes this process of agency employment of foreigners, by connecting the institutes of agency employment and employment of foreigners. In its introductory chapter, this thesis briefly describes and analyzes the institute of agency employment, focusing primarily on the requirements necessary to obtain a permission for agency employment and on comparable working and wage conditions. Furthermore, this work deals with the cross-border element of agency employment, where the second chapter analyzes in detail the process of agency employment of foreigners, both citizens of other Member States of the European Union and especially foreigners from third countries. Based on this analysis, the content of the second chapter is also a comparison of the legal status of Czech nationals, citizens from other Member States of the European Union and foreigners from third countries in the framework of agency employment.
