Real Estate Division - a Farmstead

The present diploma thesis ‘Practical Division of a Real Estate – Agricultural Farmstead‘ is concerned with actual division of an agricultural homestead in XXX, the district of Olomouc. Based on the local examination which has been performed and after analyzing documents acquired from the owners, conclusions were drawn as to the possibility of dividing the estate while adhering to the applicable regulations of the civil procedure, construction law, construction technology, operational technology and economy. Valid price guidelines were used to determine the price of the estate and a comparative price of the estate was also estimated. Both price levels were also determined for the individual parts established by the practical division of the estate. The thesis consists of two basic sections. The first section focuses on theory, explaining the problem of practical division of an estate and providing a description of work of a certified expert drawing up this type of expert opinion. The second section comprises a practical part, which contains the expert opinion on the actual division of the agricultural homestead in the town of XXX in the Olomouc district.
Optimization of the procedure for the transfer of ownership of agricultural land

The Master´s thesis is focused on optimizing the procedure for the transfer of ownership of agricultural land, which will also form the aim of this work. The theoretical part consists of information on the acquisition of property rights to agricultural land. They also described the basic concepts related to the issue. The practical part is formed at the beginning of the analysis of the situation on the market of agricultural land type arable land species in the selected area. It is followed by the creation of objective work, which is creating the optimal procedure for the transfer of ownership of agricultural land. Conclusion the Master´s thesis contains a description of differences in the transfer of ownership of practice and also a summary of the law legislation in the Czech and Slovak Republics
Countryside Ever Changing - LE3N8 LEŠNÁ

The goal of the master’s thesis is to return the landscape to the people in the sense of rediscovering wealth in our close neighborhood in connection to the relationship between people and the landscape. The work and theoretical background is used in my place of residence, which is the cadastral area of Lešná, which includes 7 municipalities (Lešná, Jasenice, Lhotka nad Bečvou, Mštěnovice, Perná, Příluky and Vysoká). The basis for the work became a personal relationship to the location and physical research in the form of walking the area in a straight line, along paths and finding connections in the landscape. By simply changing my movement, I was able to perceive my own intense experience, which I rely on in my designs. In the area, I have selected 8 places with a unique character, to which I apply the proposed buildings. Each of these unique places has a name in history, but few people know it today. Through specific architectural designs, I return names to these places and bring them back to life through the people who begin to discover these places.
Land management for development project

Topic of this bachelor thesis is preparation of land for a development project. The thesis consists of two parts. The theoretical part gives on overview of processes necessary for initiation, preparation and implementation of the development project. Namely these are the idea of construction, issues related to spatial planning, different phases of the development project, funding of the development project, ensuring the legal ownership of the land and setting the utilities. The practical part describes the difference between two development projects of land preparation for construction of houses, one initiated and managed by a local authority and the second of uncontrolled construction on property of a real estate owner.
Comparation of the Real Estate Registration in the Periods of its Development

This dissertation thesis deals with a Cadaster theme and its historical development starting from defective land inventories, first real estate records and land registers up to the contemporary Cadaster – information system that involves all the property deatils of the Czech Republic area. Furthermore, the thesis describes the present Cadaster state, regulations on which is the Cadaster based on, its structure and written records. Finally, the thesis also mentions the Slovak Republic Cadaster and other cadastrial systems in foreign countries.

Acquisition of ownership title from a non-entitled person This thesis deals with the institute of acquisition of ownership title from a non-entitled person with focus on the acquisition of movable property. The purpose of this institute is to compensate for the lack of the transferor's title to transfer the ownership right in certain justified cases. Acquisition of ownership title from a non-entitled person is an original way of acquiring property right and leads to the breaking of the legal principle nemo plus iuris ad alium transfere potest quam ipse habet - no one can transfer more rights to another than they possess themselves. Although almost ten years have passed since the new legal regulation, which introduced this institute in its current scope into the Czech legal system, has come into force, it is still possible to encounter a number of uncertainties accompanying this legal regulation. It is precisely their numerous occurrences that point to the need for a critical examination of this regulation. The subject is therefore still up to date and the case-law is constantly evolving. In particular, conclusions concerning the requirements of bona fides on the part of the purchaser must be sought primarily in the decision-making practice of the courts. The restriction of real property for the protection of nature and landscape

The aim of the diploma thesis is the analysis of legal instruments regarding the restriction of the ownership of real property arising out of the protection of nature and landscape. This diploma thesis is divided into 7 chapters including the introduction and the conclusion. The second chapter deals with the constitutional origin of the respective legal institutes. The third chapter deals with the conflict of the fundamental rights. The fourth chapter provides for the fundamental institutes, their basic components, and their legal basis in private and public law. The fifth chapter is concerned with the particular restrictions of the ownership of real property as stipulated by relevant legal regulations. This chapter is divided into the analysis of the act no. 114/1992 Coll. in general and the analysis of the general and special protection of nature and Natura 2000 and provides examples of the respective legal institutes. The sixth chapter defines the restriction of the ownership rights arising out of other acts. The conclusion is concerned with the comparison of the aforementioned legal institutes and the evaluation of the particular features thereof. The conclusion also provides proposals for prospective changes in the relevant legislation.

The aim of this thesis is to answer some problematic questions related to the retention of title in the context of the current legislation. Considering the frequency of negotiating reservations in ordinary civil law relations, the thesis seeks to answer those questions that may appear to be relevant for everyday practice. In pursuing its objective, the thesis primarily analyses the current legislation and considers relevant decisions of the courts and the opinions of respected authors. The thesis is divided into five chapters. It proceeds from the most general issues to the more specific sub-aspects of the reservation of property rights. The first chapter contains a brief analysis of the legal regulation of the moment of acquisition of the retention of title. The second chapter focuses on the more general issues of retention of title with a view to discussing some aspects of the retention that have not been satisfactorily addressed by the literature. In addition, the chapter aims to capture the essence of the retention of title. The third chapter deals with selected issues related to the position of the seller. 1 ABSTRACT Specifics of Landownership in Specially Protected Areas The thesis deals with specifics of landownership in specially protected areas. The objective is to describe and analyze institutes that a landowner is presumably to encounter in specially protected areas. The thesis also presents the specifics related to the state as landowner in specially protected areas. First chapter as an introduction to the issue presents groundings of specially protected areas in legislation of the Czech Republic. Second chapter firstly provides a definition of landowner in specially protected areas. In connection with the state as landowner in specially protected areas, the rest of the second chapter is dedicated to latter mentioned issue. Followed by an introduction of fundamental institutes that the state implements in terms of achieving the aim of the state being the majority landowner of selected specially protected areas due to its uniqueness. The legal regulation of specially protected areas imposes significant restrictions on ownership rights in real property, more significantly on landownership. Personal ownership in Czechoslovakian law in 1964 - 1990

Personal ownership in Czechoslovakian law in 1964 - 1990 This thesis aims to comprehensively describe the regulation of personal ownership in Czechoslovakian law in the years 1964 to 1990. The thesis deals with the origin and development of this property type in Czechoslovakia, including the constitutional aspect of property law under socialism and Soviet law, which significantly influenced the Czechoslovakian law. Emphasis is placed on the description of the historical and philosophical roots of property rights with regard to Marxist-Leninist ideology. The introductory part of the thesis comprehensively discusses the regulation of ownership in key legislation before the year 1964, including both post-war Czechoslovakian constitutions and key laws such as the Civil Code of 1950 (Act No. 141/1950 Coll.) or the Economic Code (Act No. 109/1964 Coll.). The main part of the thesis focuses on the regulation of personal property in the Civil Code of 1964 (Act No. 40/1964 Coll.) as amended before 1990. The text compares the original wording of the Code with the amendment of 1982, which returned to the Code traditional Roman law institutes such as possession or easements.
