Legislation for breeding animals

The " Legislation for breeding animals" thesis gives overview of laws and regulations in this area. The respective legislation is included in many acts and regulations of public law, mainly the laws protecting animals from abuse. Some aspects of entrepreneurship and animal trade are included in private law. One part of the thesis covers international agreements and European legislation. Out of secondary European legislation the thesis discusses some regulations relating to the topic. The thesis also contains chapters on legislature concerning animal abuse, veterinary care and animal trade. It states differences in record keeping of farm animals and pet animals. The thesis also deals with animal trade, farming, breeding facilities and animal shelters. The thesis contains a chapter on competencies and the distribution of competencies among the authorities. There is a list of some competencies relating to the topic at every authority, with some authorities there are issues which are rarely addressed in publications (e.g. animal training licence or alternative dispute resolution for consumer disputes). Roads from the Perspective of the Environmental Law

Roads from the Perspective of the Environmental Law Abstract In this Thesis, in light of amendment of the Line Act which severely dampens the concerned authorities' means of protecting the environmental public interests, I present a brief introduction to the environmental protection legislation in relation to roads, road construction and road traffic, showing the state of related present-day legislation and means through which the environmental public interests are protected during the road construction process as of today. To this end, I present a brief description of negative effects of roads on the environment, i. e. environmental fragmentation, land annexation, pollution of land and air, noise and artificial lighting. Next, I am showing an in-depth analysis of means through which the Czech law deals with these negative effects and which means of protection against them it offers. I show the road construction process, means of environmental public interest protection in this process and administrative-legal acts through which the means of protection are applied. Here I mostly focus on the environmental public interests in environmental protection, limiting the environmental fragmentation and protection of land. Hunting law as a tool for environmental protection In the scope of three main chapters, introduction and conclusion, the thesis attempts to capture the relationship between the Czech hunting legislation and nature conservation. The question is whether we can consider the current concept of the Hunting Act (449/2001 Sb.) as one of the tools of environmental protection. For the elaboration I based the research, among other things, on my personal experience with pro-landscape hunting in the vicinity of the village Vinaře, Central Bohemia. Furthermore, I elaborated on interesting cases of judicial and administrative practice and, last but not least, I took into account the relevant legal norms and appropriate literature or professional texts. The first chapter deals in more detail with the very concept of hunting, including various interpretations and therefore also meanings. The second part of the first chapter describes - rather briefly - the history of hunting predominantly in the Czech territory. In this context, greater emphasis is placed primarily on the first signs of nature protection. Legal Regulation of Environmental Impact Assessment

The subject of this diploma thesis is the analysis of the legal regulation of environmental impact assessment (EIA). EIA is one of the horizontal instruments of environmental law. It is based on the principle of prevention and sustainable development. The Czech legislation can be found primarily in the EIA Act which, to a large extent, is the result of the transposition of the EIA Directive. National and European regulation of environmental impact assessment is significantly influenced by international law, in particular by the Espoo Convention and the Aarhus Convention. Non-legally binding documents are also very important. During the environmental impact assessment process, which consists of several phases, the significant impacts of the project on the environment and public health are examined and evaluated. Not all projects are subject to assessment, but only those which are stipulated directly by law ("obligatorily assessed projects") or by the relevant administrative authority in the screening procedure ("facultatively assessed projects"). The result of the assessment, which is performed by authorized experts, serves as an objective expert basis for the so-called consequential proceedings, in which a decision is made on the approval of the project. Acquisition of real estate from unlawful possessor comparison of Czech and German legal regulation

v anglickém jazyce The topic of the thesis is the institute of acquisition of a real estate from a non-entitled person which breaks the traditional principle of Roman law nemo plus iuris ad alium transferre potest quam ipse habet (one cannot transfer to another more rights than they have). The thesis describes, analyses and evaluates particular conditions for acquisition of ownership rights and other rights in rem over a real estate from a non-entitled person, as set out in the Czech and German legal system. The possibility to acquire a real estate from a non-entitled person which is closely connected with the principle of material publicity (public faith) was relegislated as a part of the domestic recodification of private law. The socialist as well as the post-revolutionary law rejected the possibility of a bona fide acquisition of a real estate from a non-entitled person very strictly. However, the recent strengthening of the material publicity of public registers brought a number of ambiguities. Although we cannot foresee the future trends in decision- making practice of the domestic courts in relation to the acquisition of a real estate from a non- entitled person, the German legislation could outline possible solutions of some domestic interpretation problems. Liability for environmental administrative offenses Abstract The subject of this diploma thesis is the institute of liability for environmental administrative offenses, which consists of two separate legal branches, namely environmental law and administrative law, which intertwine and form a comprehensive system of environmental protection and its components. The mechanisms of this protection include, in particular, prohibitions and orders for certain conduct, various forms of preventive action and, in particular, instruments of a sanction character. The concept of legal liability, which occurs in several types, is associated with sanction instruments, while in the protection of the environment the most widespread legal liability is tort legal liability, specifically administrative offence liability. This issue is still very topical, as on 1. July 2017 there was a new legal regulation of this type of liability and the anchoring of important institutes, which have so far been inferred only by analogy of law and court case law. Legal Protection of Wolf in Czech Republic

The purpose of this diploma thesis is to evaluate legal protection of grey wolf in the Czech Republic based on comparison carried out with legal codes of our neighbours and international law environment in order to offer a solution for revealed deficiencies, since, as the thesis describes, the number of wolfs dwelling in the wild areas of the country has been gradually growing. It is the question of direct protection and wolf's legal status, which is examined, as well as related administrative obstacles, and conditions or means of hunting, respectively. The thesis also deals with the issue of legal status of "wolf-dog" hybrids. Furthermore, currently pressing matter of compensating damage caused by wolfs is examined. Finally, attention is devoted to the protection provided to wolfs within the field of pet breeding and animal trade.

The Constitutional Court as a negative legislator: Restriction of constitutionally guaranteed rights for the purposes of environmental protection Abstract This thesis examines how the Czech Constitutional Court deals with proposals to repeal laws or statutory provisions that restrict constitutional rights or other constitutional provisions concerning environmental protection. Specifically, it examines how the Court deals with conflicts between constitutional rights concerning environmental protection and other constitutional laws pertaining to the environment and/or the public interest in protecting the environment. In addition to the analysis of the decision-making practice of the Constitutional Court, the thesis deals with the anchoring of environmental protection in constitutional documents and in the Czech Constitution - both in the preambls of the Constitution and the Charter, where the environmental protection is embodied in individual rights and the state's duty to protect the environment, including those provisions where environmental or nature protection is explicitly enshrined as a possible grounds for restriction of another constitutional right.
