Social Impacts of the Execution of Custody on the Accused Persons

The thesis deals with the issue of execution of custody and the social impacts of execution of custody on accused individuals. The aim of the thesis is to acquaint the reader with the Prison Service of the Czech Republic (hereinafter referred to as the "Prison Service") and the specifics of execution of custody, describe the social impacts of remand, and highlight possible ways to prevent and minimize their negative phenomena from the perspective of accused individuals in execution of custody. The theoretical part of this thesis is dedicated to the characteristics of the Prison Service, the issue of institute of remand, the life of the accused in prison, social work with the accused, professional prison staff and the social impacts. For the research in the practical part, a strategy of quantitative research was chosen. Within this strategy, a survey method utilizing anonymous questionnaire technique was selected. The research was conducted in the Remand Prisons České Budějovice, Liberec, Olomouc, Remand Prison and Institute for the Execution of Secure Detention Praha Pankrác and the Prison Plzeň. The results of the research summarized in the discussion showed that there is a difference between the frequency of contacts and the assessment of relationships with family members before and during execution of custody. Conversely, no dependence was proven between the length of execution of custody and loss of employment, or between the length of execution of custody and the growth or emergence of debts. The thesis can serve as a comprehensive overview of the issue of execution of custody and its social impacts. The information obtained may be beneficial for understanding this issue by relatives, professional staff of the Prison Service, and other individuals who come into direct contact with accused persons, as well as accused individuals and their close relatives. The thesis emphasizes the importance of considering social aspects within the criminal justice system and may contribute to the discussion on possible reforms or provide recommendations for improving conditions, support, and services during execution of custody with regard to the needs of the accused and the society as a whole.
Effective Treatment of Violent Offenders with Personality Disorder wihin the Penitentiary Custody

This paper addresses the question of whether individual delinquent behaviour, or criminogenic risks that lead to it, can be reduced for convicted violence offenders with personality disorder, using the newly developed offence-oriented therapeutic program TERČ ("TARGET"). If so, how will these changes manifest in the recidivism rate, and how they will reflect the personality characteristics of inmates. TARGET was first systematically applied within a special treatment unit for prisoners with mental and behavioral disorders in Liberec Remand Prison in 2008. It is based on selected elements of the Ambulant intensive program (AIP) from Switzerland. A total of 100 convicts were entered TARGET from 2008 to 2015. 65 individuals completed the program successfully, and 57 were released again. The already released graduates of TARGET re-offended within 12 months in 10.4%. Of all admitted TARGET participants, a total of 30.2% either relapsed or failed during the program since 2009. Graduates showed positive, statistically significant changes in the monitored areas of life satisfaction, emotional stability, insight, self-control and aggression, while on scales representing personality disorder no positive, statistically significant effect was observed. Criminological Aspects of Crime Recidivism The Diploma Thesis Bc. Petra Urbánková Abstract The main goal of the Diploma Thesis "Criminological Aspects of Crime Recidivism" is analysing recidivism, which is considered to be one of the most important criminal factors. We can analyse recidivism based on the criminal law, penology, criminal statistics and mainly criminology. The Criminological aspect is the widest one, because it focuses on the all crimes committed by the offender, not only those crimes which were investigated by Police or the prosecutors. We will also theoretically describe all statistic sources where the recidivism has been recorded, but mainly we will analyse practically the statistical data of The Prison Service of the Czech Republic and the data of the Police of the Czech Republic where we could find out the actual rate of recidivism in the Czech Republic. The data of the Prison Service contain mainly the offenders which are imprisoned repeatedly for more than once. The data of Police are focused on type of crimes which have the highest rate of recidivism and whose are committed repeatedly by the offenders. Perception of Inmates by Prison Officers

Literature about prisons is dealing with issues concerning prison officers very rarely, since attention is usually paid to inmates. Therefore, this work is addressing prison officers and their perception of inmates. By means of semi-standardized interviews, key sources and kinds of information were discovered. These aspects are crucial for prison officers to develop their attitude about inmates with focus on category of guilt. Prison officer's approach and inmate's approach arose as dynamic categories changing according to the certain circumstances, which are described in individual subchapters in more detail, and also according to time. Differences were noticed not only among prisons, but also among positions of uniformed staff (escorts, wardens and guards). Since this issue is overlooked, but essential for gaining awareness, understanding and improving situation in prisons, it is crucial to do more researches on it.
The legal status of sentenced to a term of imprisonment

This thesis deals with the legal status of persons serving prison from the perspective of selected areas of their fundamental rights. Analyzed areas include the right to protection from torture, cruel, inhuman or degrading treatment, the right to protection of health and to free medical care, the right to be protected from any unauthorized intrusion into one's private and family life and the right to participate in the administration of public affairs through active and passive voting rights. The theory includes institutional guarantees ensuring compliance with these rights and the relevant recommendations of international organizations. Practically oriented casuistic section of the thesis is based on the direct experience gained during authoress' internship at the Czech Helsinki Committee, non- governmental human rights organization based in Prague since 1988.
Education and employment of people within penitenciary and postpenitenciary care

The aim of this bachelor thesis is to provide the reader with the insight into penitentiary and post-penitentiary care. It tries to describe the period of custodial sentence with its possible impacts on the sentenced person and the society. It puts a special emphasis on the purpose of custodial sentence which is a successful reintegration of prisoners back into the community and mitigation of the risk of their relapse. The importance of education and employment is stressed in this context and also within the programs for convicts and within post-penitentiary care. The thesis also describes specific groups of people that tend to appear in prisons and methods employed for their care. A special emphasis is put on individual approach to prisoners. The current trend of alternative sentencing is also mentioned. The thesis paints an overall picture of the contemporary conditions of the Czech prison service, including the possibilities of education and work activities in selected prisons. For these purposes the following sources are used - scientific literature, laws and regulations of the Czech Ministry of Justice and current statistics of the Czech Prison Service.
