Civil aspects of animal ownership

1 Abstract The topic of this thesis is civil aspects of animal ownership. The aim of this study is to analyze the specific civil aspects of ownership of animals, for example horses, in contractual relations and tort liability as well as a brief comparison of the issue with Austrian and Slovak legislation. The focus of this work lies in the analysis of the applicability of the relevant provisions of the Civil Code or the need for specific contractual provisions in the contractual relations and further analysis of the individual types of tort liability and their relationships. The thesis consists of three main chapters further divided into subsections. The comparison with foreign legislation is contained in the final subsection of each chapter. The first chapter briefly discusses the status of the animal as an object of legal relations and the subjects of those legal relations. The second chapter deals with the most common legal relations of contracts relating to horses. Those are the commencement and ownership transfer to the horse by increment, donation and purchase and legal relations associated with commercial stabling which are custody, lease and work. Dog in a public space. Negotiating "more than human" public space

The thesis deals with the presence of a dog in the city, specifically in the public space and the research itself is aimed at negotiating "more than human" public space. The presence of animals in the human world causes conflicts about the "right" place of this animal, whether is place conceptual or physical. The work takes the form of a case study, where I chose for research borough of Prague 2 and on particular cases of negotiation, I watched how each party tries to affect a form of public space. Through qualitative analysis I uncover the key points of negotiation by which I learn how the different parties understand the presence of a dog in a public space, on what basis is constantly negotiates form of residence and movement of the dog in this specific area. I have used several techniques of qualitative research, especially analysis of available documents, semi-structured interviews and participant observation. Data was analyzed using open coding. In the end the thesis answers to research questions, formulate recommendations and open debate.
Idioms with Animal Components in Czech and Chinese

This graduation thesis is dedicated to the animal phraseology in Czech and Chinese languages.The author focused on the analysis of animal idioms on the basis of the syntactical, formal and semantic aspects. She created an index of animal idioms in both languages on the basis of the relevant dictionaries - Slovník české frazeologie a idiomatiky 1. - 4. and Hanyu Chengyu Jinghua Cidian. Furthermore she made a mutual comparison of these idioms from both languages. The Czech National Corpus and Chinese Corpus were used as the main sources for the analysis.
Legal regulation of treating animals in human care

This diploma thesis deals with legal regulation of the treatment of animals under human care. It provides a comprehensive overview of international legislation, European legislation and also Czech laws. On the international level it describes fundamental conventions of the Council of Europe. On the level of European Union this thesis does not omit primary law of the European Union, secondary legislation as well as conceptual tools. On the national level it tries to outline the key regulations governing the treatment of animals. Next it deals with definition of an animal, creature and wildlife, and categorizations of animals. It also also includes a civil nature of the animal. The major Czech law governing the main ways of dealing with animals in captivity this thesis describes the act no. 246/1992 Coll., On Protection of Animals against Cruelty. After defining possible ways of the treatment it does not forget to acquaint with the possible torts for breach of the requirements for the protection of animals, including act no. 40/2009 Coll., The Criminal Code. In conclusion, it briefly describes the status of bodies whose activities relate to the protection of animals.
Felis versus Felix - Symbolic and narative content (of Cat) in Art and Art education

The theme of this diploma thesis is Felis versus Felix - symbolical and narrative content within art and arts education. This thesis is both theoretical and practical study of the topic. Theoretical part is concerned with understanding key words, their meaning, cat itself, its symbolic, history, properties, and connotations connected to it. The author of the thesis maps the occurrence of cat in art and literature, which she supports by specific examples. She further offers using the theme of the thesis in arts education and introduces already existing art set called "Animal within us". The author proposes another possibilities of using the theme within pedagogical practise. Practical part of the thesis stems from results of heuristic preparation. It contains two sets of art works of various but interconnected nature.
Liability for damages caused by wild animals

Liability for damage caused by game The damage liability poses the key and complex issues of civil substantive law with some aspects not yet properly investigated. The civil liability may have various forms and it demonstrates in a whole range of social relationships, which the doctrine tries to reflect by its systematisation and categorisation. In this respect, for damage caused by animals as special entity presents a specific case liability. Damage caused by game can be considered as special case mainly as the harmful agent is a living organism, of which the behaviour cannot be predicted to a certain extent. Since 1 January 2014, however, the civil-law regulations take the liability for damage caused by animals explicitly into account and assume that the persons responsible should be the owner of the respective animal or the actual holder. The concept of the liability is based on the owner or holder being aware or related risks and hence acting in a way preventing the animal to cause damage. While the Civil Code effective from 1 January 2014 regulates the liability for damage caused by animals that is owned by somebody and hence compensates the deficit of previous regulations, the liability for damage caused by game is very problematic and not regulated sufficiently; damage cause by game poses...
Looking at and through the Beast: Construction of 'Animal' within the Prague Zoo

The thesis is based on the presumption that zoological gardens are cultural institutions which reflect social and cultural interpretations of what is called 'nature' and animals. By analyzing data gained through participant observation it focuses on the meanings and forms which are ascribed to animals living in the Prague Zoo via the gaze of visitors. Furthermore, by analysis of visual and textual sources provided by the zoo, I examine how the 'zoo animal' is constructed by the zoo itself. I argue that this zoo animal constitutes a specific form of the animal, different from both the domesticated and the wild one. The zoo and its visitors create a chimeric 'beast' which encompasses different and even contradictory trends and conceptions of thinking about the zoo animal.
Opposition "homo - animal" in language. Contribution to the Czech linguistic picture of the world

This diploma thesis aims to contribute to the research of the Czech language picture of the world. It is based on fundamental theoretical and methodological resources of cognitive and cultural linguistics and focuses on the opposition of "man - animal", or "human - animal", in the Czech language, aiming to illustrate the way in which zooappellatives (animal names) relate to the reality of the human world. The most extensive part of the thesis is based mainly on an analysis of Czech dictionary material (etymological, reference, synonym and phraseological dictionaries), as well as comparing the scientific (biological) classification of animals to the categorization in natural language. In regard to the category ANIMAL, the thesis establishes four basic domains constituting the category's conceptual model (framework): "the place where the animal lives", "physical traits", "the animal's behaviour" and "relation to man". The thesis also includes questionnaire-based research that focuses on analysing the way in which speakers of the Czech language understand the category ANIMAL, and attempts to determine whether they regard some animals as more protypical than others.
An Animal on the Battlefield of First World War: Horses and Transport Animals

The aim of this thesis is in part to fill the gap that exists in the Czech historiography regarding the use of horses and other transport animals in the First World War. It follows the experience of draught, pack and mounted animals in this war, from its very beginnings to the end, and tries to answer these questions: how were these animals used, what did they have to go through and encounter on the battlefield and what care they were provided. This thesis combines the use of historical sources of both administrative and personal nature with the knowledge and observations gained from the field of horse ethology. It also addresses in detail the relationship between fighting men and their horses and tries to paint the picture of the role of war horses in the representation and memory of the First World War.
