Šedivá, Magdaléna ; Čírtková, Ludmila (advisor) ; Štourač, Petr (referee)
Hate crimes My final thesis is dealing with the phenomenon of hate crimes. The purpose of the study is not only to provide a general theoretical knowledge of biased - motivated incidents, but also to present real criminal cases and show on them how dangerous pure hate can be. The thesis is composed of three main chapters, each of them concerns aspects of hate crimes. Chapter One is more or less introductory. The chapter is subdivided into three parts. The first of them describes and interprets the basic term "hate crime" from the view of various authors. Moreover, it also conciders the necessary elemens (like prejudice against sex, race, skin colour, nationallity, ethnicity and religion), which should be involved in the hate crime definition. The second part deals with the possible causes of hate crimes - such as migration, globalization, economic problems and mainly stereotypes and preoccupation. The last part of the Chapter One examines relevant Czech legislation - compares and contrasts the previous and the current Czech Criminal Code. Chapter Two consists of seven parts. Part One focuses on the perpetrators of hate crimes generally, whereas Chaper Two and Chapter Three describe different types of offenders in accordance to their motivation and then classifies them into specific groups...

Mazzolini, Norbert ; Smolík, Petr (advisor) ; Zoulík, František (referee)
Act 182/2006 Coll., the Insolvency Act, brought many changes to the field of law of insolvency. Before all, it is the new conception of the system of unified administration, where the decisions are taken about the status of liquidation procedure, so that the most efficient method of resolving of such insolvency may be found followingly, and also new ways of insolvency resolving, namely reorganization and debt clearing. Preparation of the Act, similarly to many neighbour countries, was strongly affected by the aim at forming a set of conditions motivating debtors to try and resolve their difficult financial situation and avoid reluctance in case of economic crises by presenting legal tools enabling to keep the business running. That was supposed to bring an improvement of the situation of both the debtors and their creditors, who all play their set roles within the insolvency proceedings. The key factors were hence speed, efficiency, and the wish to balance the effects of liquidation and sanation form of insolvency resolution. This Master's degree dissertation is focused on the sanation form of insolvency procedings. The Act defines this form as a reorganization; a method replacing the quite rarely used institute of debtor-creditor clearing, and directly aims at balancing the long-observed disbalance between...

Pehal, Zdeněk ; Malý, Karel (advisor) ; Adamová, Karolina (referee) ; Soukup, Ladislav (referee) ; Šouša, Jiří (referee)
1 ABSTRACT The work deals with the infiltration process and the emphyteutic law evidence in the Čáslav province in the Middle ages. This area can be delimitated with the range of the Iron Mountains from the north, and then with the river Sázava from the south. Several significant territorial suzerains (authorities) acted here such as Vilémov monastery, Sedlec monastery and Želivka monastery, especially significant was the colonization activity of the Lichtenberk family which was developing in the area from the half of the 13th century. The Lichtenberks came to the area from north-western Bohemia, from the contact area of the Czech state, where their relatively early-ripening emphyteutic contracts are documented, and infiltration of early forms of the German law is presumed in general. This medieval law, sometimes designated as "stable and firm" in written sources, was brought from the area of present western Europe (also form the Netherlands) by new settlers, colonists who were bringing with them excluding new knowledge of landscape cultivation (drainage, forest transformation into fields) also juridical habits, which were used to adjust legislative relations while establishing villages. They were not only farmers, but they were also other specialists, mainly miners who brought with them technologies of...

The content of my thesis is directly related to the pension reform in the Czech Republic and I also described some impacts of the modifications in the legal tax regulations system.Czech Republic is another country that will have to deal with unfavorable demographic progress of its population such as increasing number of seniors and decreasing amount of subjects that contribute to the pension system. That might result in the financial instability and that is also a reason for preparation and implementation of the Czech pension system reform. I'm convinced that pension system as a part of the country's social system is one of the crucial economics cornerstones of every country. Laws that support the pension system are subjects of significant modifications in the recent years. Such modifications are content related, it means that new laws are created or current laws are modified. The execution of the laws changes...
