Problematical legal aspects of determination of parenthood
Vařeková, Adéla ; Frinta, Ondřej (advisor) ; Thöndel, Alexandr (referee)
The Abstract The aim of my thesis is to find and describe the problematic aspects of the determination of parenthood. I chose four areas of the determination of parenthood, which can lead to various complications - assisted reproduction, surrogacy, secret childbirths and anonymous births. In the first chapter of the thesis I deal with the legal aspects of the determination of parenthood. I examine mandatory determination of maternity and various assumptions of paternity. With the development of relations in the society and of the reproductive medicine, there emerge possibilities doubting the traditional legal principles of the determination of parenthood. Mother is not always certain anymore and there are five presumptions of paternity in the Czech legal order nowadays, compared to the traditional three. The second chapter is devoted to the issue of assisted reproduction. Assisted reproduction is a modern and rapidly developing area of medicine that allows infertile couples to have their own child. It is a medical specialty that requires a broad legal framework to prevent its abuse. At the end of a successful medical procedure a new life is coming into existence and such area must be regulated. The third chapter, entitled Surrogacy, builds on the previous chapter. Surrogacy is often discussed area of...

Enforcement proceedings conducted by the Enforcement Code and its social impact on the borrower
VOLFOVÁ, Ilona
My bachelor thesis deals with the current legal regulations of the civil executory proceedings pursuant to Act No. 120/2001 Coll. about the court executors and executive act (executive order) in comparison with proceedings pursuant to part six of civil proceeding code No. 99/1963 Coll. Until the effectivity of executory order in 2001 the civil proceeding code was the only legal enactment, which enabled creditors to enforce its civil claims if debtors don´t want to discharge a debt voluntarily. The claim must be declared by court or other institution and there must exist such desicion, it is basic for order of execution. Dualism of executory proceedings takes from 2001. Purpose of both proceedings was the same, enforce a debt, but the instruments which they used were different. Since 2013 there is the only chance to enforce civil claims if debtors don´t discharge and it´s executory proceedings because it offers faster and more effective way. The aim of the practical part is to find out the reasons for the borrowers to get enforcement proceedings, as part of the executor office in České Budějovice, and what impact this had on their social situation. The work was compiled in the form of qualitative and quantitative research, collection of data was conducted from content analysis of execution documents in selected execution office, and technology-driven interview was also used within the Office of 8 borrowers when borrowers selection was based on the possible availability. In the context of this research were defined subsequent research questions: 1) What are the causes of non-payment and subsequent executions? 2) What impact has the recovery on the social situation of the debtor, respectively. his family? Research has confirmed that people think poorly of their financial possibilities. They usually have a low income and the disproportionately high costs. It was found that the respondents have no financial plans. Often they don´t think, which points to a lack of rationality and miscalculation of finance. These findings confirm the forecasts of experts. The research also shows that it is necessary to focus on the prevention of the formation of the family budget and increasing financial literacy. Most often the borrowers owe the insurance, energy, and to the city, which also confirms the findings of experts on the topic of foreclosures. Often, in practice also meet with irresponsible sanation other debt. The research also confirmed the theoretical knowledge of experts. Supervised execution proceedings is negatively reflected on family life and can lead to psychological problems. The financial burden resulting from debt collection leads to an inability to fulfill other obligations, including such as cost of living. Respondents confirm the findings of experts that enforcement proceedings can lead to social exclusion and limitation of basic needs. Furthermore, research shows that people under execution only "survive" from paycheck to paycheck. It is also confirmed that the impact of enforcement can lead to alcoholism, illegal work and had a great impact on the whole family. The solution to this issue in order to avoid default on receivables and subsequent enforcement proceeding would be to increase the dissemination of information through the media. Information about the negative impacts of foreclosures should be provided clearly and should be available to all. It would also need to increase financial literacy and has been since elementary school. People should try to behave in a more economically way and be able to make responsible decisions about their finances. Possible assistance and prevention could be to extend the services of financial advisors who would provide information and advice on how to manage the family budget. From the state could lead to a tightening of credit conditions in the conclusion of contracts. The creditor should be required to determine the revenue potential borrower.

Insularity and connection in E.M. Forster's Howards End and A Passage to India
Rezková, Jana ; Beran, Zdeněk (advisor) ; Armand, Louis (referee)
Howards End and A Passage to India, the two best known novels by E.M. Forster are quite different in theme and setting, but they have an important aspect in common. Both novels take place in a strictly divided society and they both deal with the insularity and narrow-mindedness of separate communities and their inability to reach beyond their own environment and experience. "Only connect ... ", an epigraph from Howards End, introduces one of the central themes of F orster' s writing. E. M. Forster strongly believed in the importance of personal relationships and in living a full, undivided life. That is, a life in which spiritual, physical, emotional and rational aspects are all in harmony. 1 In order to reach the desired harmony, one needs to establish connections not only between the spiritual and material life, but also on the level of personal relations. Forster is concerned with an individual's search for harmony, but also with finding harmony and overcoming fragmentation in the whole society. To reach such harmony, both within the self and within the society, is what the characters of his novels strive for. Forster disregarded religion already during his university years2 and this may have led him to consider personal relationships of primary importance. His belief in personal relations is also...

Halada, Martin ; Růžička, Květoslav (advisor) ; Pfeiffer, Magdalena (referee)
UNCITRAL Arbitration Rules and their application in practice The purpose of the thesis is to analyse the UNCITRAL Arbitration Rules and the ways they are applied and interpreted by parties of dispute and arbitrators in international commercial arbitration. The thesis is divided into two parts. In the fist part the basic principles and legal framework of international commercial arbitration are described. Differences between institutional arbitration and ad hoc arbitration are discussed and special chapters are dedicated to permanent arbitration courts in the Czech Republic and important international arbitration institutions. Second part begins by discussion of the UNCITRAL Commission history and describes historical development of the UNCITRAL Arbitration Rules. Analysis of individual articles follows. With some articles there is established common international practice regarding their application or interpretation in international commercial arbitration. In such cases these practices and interpretations are discussed in more detail. Some articles of the revised 2010 version of the UNCITRAL Arbitration Rules are significantly different compared to the 1976 version of the UNCITRAL Arbitration Rules. The life afterwards. The return of Czechoslovak political prisoners to society.
Vránková, Ivana ; Bouška, Tomáš (advisor) ; Hlaváček, Jiří (referee)
The Master's thesis "The Life Afterwards. The Return of Czechoslovak Political Prisoners to Society" is concerned with the topic of the re-integration of Czechoslovak political prisoners of the 1950s back into society after their release from prison. In the conceptual framework I provide the political and historical background of the Communist Czechoslovakia during the 1950s. I discuss the concept of political prisoner and describe the living conditions in prisons and labor camps. As observed from their narration, I also briefly outline the various strategies employed by political prisoners in their attempts to deal with imprisonment. Although the descriptions of the respondents' arrests and events that had led up to them are topics not directly concerned with the primary topic of my thesis, they are included, because they are vital in understanding the existential and other re-integration-related problems these prisoners faced. In my research, I employ the qualitative method of oral history. I focus on the time period when the interviewees were released from prison and try to describe the numerous issues they faced and had to deal with. More specifically, I focus on family and friendship relations, which had been often disrupted and the issue of seeking a new employment, an area of life in which...

Development of Public Policy Study in Europe : Czech Study of Public Policy in European Context (Comparing the Cases of France, Germany and the Czech Republic) PhD. thesisr: Vilém Novotný English abstract This PhD. thesis deals with an issue of study of public policy which is considered to be a specific subdiscipline of political sciences. The study of public policy encompasses all approaches that are engaged in research of public policy. In the issue of public policy study is attention focused, in explorative way, on development of public policy study. This aim is pursued from moderate constructivist positions at two levels. At the first, theoretical, level, it is interested in question how to study the development of public policy study. It attempts to formulate general analytical frame which could be used as a comparative grid as well. Its main reference framework is represented by Peter deLeon's model of advice and consent (supply and demand model) (deLeon, 1988) and model devised for an analysis of Canadian political science development by John Trent and Michael Stein (Trent, 1987; Trent, Stein, 2002; Stein, 1998). The analytical frame is designed under assumption of interaction between the subdiscipline and its national and international environment. In the concrete case it deals with mutual...

Issues of structure Det + N1N2 in contemporary Portuguese
Matějovicová, Jitka ; Tláskal, Jaromír (advisor) ; Jindrová, Jaroslava (referee)
The aim ofthis work is to divide and analyse the structure Det + N1N2 in contemporary Portuguese. Hence we deal with expressions consisting oftwo side-byside substantives, which are not connected by preposition (cf. a palavra-chave, o navioescola, o Estado-nar;ďo ou o cantor/poeta; o Prémio Nobel). These structures are relatively frequent in spoken as well as in written language and they contribute considerably to the enrichment ofvocabulary. We can consider them as compounds or simple nominal groups, sometimes they are analysed within the framework of transposition. Authors, who apply themselves to the issue of compounds, usually deal with the distinction between compounds and simple nominal groups and with creation of criteria for their typology and c1assification. Those who study the structure in terms of transposition focus on transition of expression in the N2 position from the c1ass of substantives to the c1ass of adjectives. Generally we can say that iťs possible to find several theoretical attitudes, which blend together in some aspects and differ in others. Thaťs why we introduce in the first part different conceptions of the structure Det + N1N2 in contemporary Portuguese. In addition to the work ofPortuguese linguists we also take into consideration works ofFrench and Czech experts. In the...
