Theory of Decision Making in Public Law and Private Law Corporations

2 Jan Broulík - Theory of Decision Making in Public Law and Private Law Corporations Abstract The thesis analyses Czech legal regulations concerning decision making in bodies of corporations. For the purposes of this analysis it employs mainly the apparatus of the economic analysis of law. Its basic concepts are also outlined. The author focuses on two kinds of legal entities which are public universities and joint stock companies. The ethical-legal connections and the significance of corporate governance in the decision making domain are presented. The analysis of the legal norms shows how reasons of the economic analysis of law correspond with provisions regulating body elections, body competence allocation and the body decision making procedure. The criterion for evaluating the quality of legal norms is effectiveness, meaning an increase of social wealth. The main detected imperfections are a missing provision allowing a long distance voting for joint stock companies' general meetings, a missing tool for the cases where a shareholder breaches his loyalty duty which leads to not passing of a general meeting decision and the mandatory nature of the duty of care. The Master Thesis European union as a Trade actor: the dynamics of the EU-US relations between 1991 and 1998 is concerned with the European Unions trade relations with the United States in the period of 1991 and 1998. The author critically analyzes European Unions integration and effectiveness in the area of external trade relations in the 1990s. Furthermore, the author scrutinizes the allocation of trade competence among the EU institutions at international trade negotiations and its effectiveness in achieving the European trade interests. Using the example of transatlantic business declarations the author points out how the European trade policy towards the United States evolved in the 1990s and what its major concerns were. Finally, the author analyzes the EU-US trade disputes put forth in the World Trade Organisation until 1998.

Comparison of commonly used SQL and NoSQL data storages

Data storing is today very important topic. Because of Web 2.0 and software-as-a-service applications there is growing need for scalability and new types of data stores. The aim of this thesis is to help understand competing SQL and NoSQL data stores and their target use cases. Author mapped last trends in data storing and application architecture and tried to find how concrete data stores address them. There is also experimental part with benchmark and simple application that demonstrate data store's connectors and their speed.

Limits of the mobile hospice care in the Czech Republic

This bachelor thesis presents information about standard hospice care, but it is mainly concentrated on the less known and less extended mobile hospice care. Text shows limits of this mobile care of dieing people. Limits and limitations result from insufficient legislative conditions for the accompanying persons and from readiness and competence of the caregivers itself to accompany their cousins in the home environment. Research part of the thesis is based on the question-form investigation performing verification of the presumed limits and pointing to them. The first investigated data samplewas collected on the bereaved persons of the patients hospitalized in the standard hospice in 2006. Second data sample is based on the bereaved persons, who used mobile hospice care in the same year. Two guided interviews with bereaveds are enclosed to illustrate the situation. Research was leaded in the cooperation with Hospic Anežky České (Hospice of the Anežka Česká) in the Červený Kostelec and Mobilní hospic Dobrého Pastýře (Mobile Hospice of the Good Pastor) in the Čerčany.

Author-addressee relationship in art textbooks and its translation from Spanish into Czech

The existence of an author and an addressee is inherent to every communicative process. The author and the addressee are considered important stylistic factors, since they determine a great deal the overall composition of the text. When writing his text, the author caters for the expectations and the competence of the addressee, and on the other hand, the addressee receives and interprets his text according to how it is formulated and how it complies with the conventions for the text type in question. The relation between the author and the addressee is reflected in the text and this reflection could be called "polarity". Polarity may be perceived in the composition of the rhetorical perspective, for it is expressed by the use of the second person singular and of the first person singular or plural, by the use of rhetorical questions and exclamatory phrases, by anticipating the reactions of the addressee, etc. The relation between the partners in the communication is governed by norms and since norms do not coincide in all cultures, we have to bear in mind that to render successfully the original and to meet with the expectations of our addressee we have to cross the cultural barrier and adjust the polarity of the text. Jan Broulík - Law and Economics and Decision Making Processes in Corporations Abstract The thesis analyses Czech legal regulations concerning decision making in bodies of corporations. For the purposes of this analysis it employs mainly the apparatus of the economic analysis of law. Its basic concepts are also outlined. The author focuses on two kinds of legal entities which are public universities and joint stock companies. The main difference between these two kinds of legal entities, which also impacts the decision-making processes, is the great extent of governmental interventions in public universities. The analysis of legal norms shows how reasons of the economic analysis of law correspond with provisions regulating (i) body elections, (ii) body competence allocation and (iii) the body decision making procedure. The criterion for evaluating the quality of legal norms is effectiveness, meaning an increase of social wealth. The doctorate work has a theoretical-empirical nature and is focused on the problems from the area of school management. The work deals with the management of elementary school of the arts in a period of curricular reform of elementary music education. Theoretical part outlines ways out for investigation of selected problems which are connected with management of transformational changes in elementary schools of the arts. The work offers view of up-to-date attitudes and paradigms of management, its structure and content and points out the spectrum of leadership styles and people motivation. The work deals with creative way of direction, leadership, which compares with operative direction, and managerial problems: change management, knowledge management and talent management. The aim of the thesis is to determine the level of respondents'opinions for the needs of introducing the headmaster`s profession and its influence on the quality of the school management with a potential impact on the overall level of education in the Czech Republic. The thesis also submits analyses of levels of knowledge in certain areas of management competences and assesses their importance for management work of the headmaster as basis for setting standards and headmaster` s career.
