Ciencialová, Andrea ; Štangová, Věra (advisor) ; Vysokajová, Margerita (referee)
Resumé Equal treatment and non-discrimination are rules that are essential in international law, European law and national law. They are regulated in many international documents, in terms of European law, especially, in the regulations and directives. Czech Republic, as one of the member States of the European Union is obliged to ensure compliance of national law with European law. It was therefore necessary in order to ensure compliance with requirements of the EC / EU in the field of equal treatment and non-discrimination of employees that are regulated in anti-discrimination directives with our national law. This happened by adoption of Act No. 198/2009 Coll., Anti-Discrimination Act, which as a general law governing these principles. In my works I deal with treatment of these principles in the documents of international law and international organizations active in this area in the primary and secondary law of the EC/EU and also the current modification in our legal system. My work is divided into an introduction, six sections and a conclusion. The first part of my work deals with the basic concepts relevant to this area, such as equality, equal treatment, discrimination and its types, as direct or indirect, and others. In the second part I focused on the modification of the principle of equal...

Mediation as a type of alternative dispute resolution
Kozlová, Kateřina ; Dobiáš, Petr (advisor) ; Brodec, Jan (referee)
The purpose of this thesis is to present mediation as an Alternative Dispute Resolution (ADR). The selection of this topic is influenced by the currency of this issue. This currency can be seen in the adoption of mediation act, which is first of its kind. The thesis is composed of five chapters. The first chapter deals with the general concept of ADR and presents different types of ADR. The second chapter then presents mediation as one of the types of ADR, and focuses on the concept of mediation, its history, the role of mediator and the mediation process in its four sub-sections. The crux of this thesis is then in the following chapters which addresses how mediation is utilised in the European, Czech and Australian legal environments. The third chapter of this work shows the development of mediation in the EU, which led to the adoption of the Directive on certain aspects of mediation in civil and commercial matters (2008/52/EC). This Directive is an essential guide for the development of mediation in the EU Member States, including the Czech Republic. On 13th June 2012 Act No. 202/2012 Sb. on mediation and amending certain laws, which establishes the new concept of mediation in the Czech Republic, was introduced. The adoption of this law implements a Directive on mediation, which the Czech...

Small mammals in diet of barn owl in the Eastern Meditarranean
Šindelář, Jiří ; Horáček, Ivan (advisor) ; Anděra, Miloš (referee)
The extensive material of skeletal remains of mammals from a diet of barn owl in the eastern Mediterranean has been processed and evaluated with different techniques of chorological and morphometric analysis. At least 8400 individuals of 45 species of insectivores, rodents and bats were found in our total collection of samples, which represents a significant portion of fauna of the region. We have evaluated a chorological composition of the taphocoenoses and the interregional differences, manifested primarily by differences in the representation of satellite and accessory elements. We found a highly significant impoverishment of the isolated island taphocenoses (Cyprus, Karpathos, partly on Crete), where Cricetidae, Arvicolidae, C. leucodon etc. are missing. On the other hand the essential part of the dominance structure takes up the Rattus rattus, which acts here as an invasive species, significantly more successful than in the ragged continental contexts. The species diversity of the examined samples is positively correlated with the geographic latitude (taphocenoses of the northern regions are significantly richer) and negatively with the island effect and the degree of aridization. The morphometric analysis of the three most abundant species of Soricidae within the studied region showed...

The efficiency of the legal regulation of care for senior citizens
Filípková, Hana ; Koldinská, Kristina (advisor) ; Vysokajová, Margerita (referee)
The effectiveness of legal regulation of care for the elderly - summary From the projected demographic development, one can conclude that the proportion of the elderly in the society will grow significantly in the future. Advancing age is generally accompanied by the weakening of self-reliance and the need of help from others to take care of oneself. The aim of this work is to capture the latest trends in taking care of the elderly and its legislative anchorage in the laws of the Czech Republic. The fundamental law from which I start is the act no. 108/2006 Sb. on social services. This act brought a large number of changes and new institutions into the department of care (not only for seniors), from which the most important was the introduction of care subsidy. The work is focused mainly theoretically, it is divided into seven chapters and further particular sub-chapters. The first chapter deals with embedding the social services into the social security law system, and also briefly with their historical development. These bases represent essential determinants that affect both the current state of social services, as well as their possible future development. The need for effective regulation of social services for seniors can be seen in the demographic indicators, which confirm the long-term trend towards...

Vertiginous relations in Eugene O'Neill's Desire Under the Elms and Mourning Becomes Electra
Landerová, Petra ; Roraback, Erik Sherman (advisor) ; Wallace, Clare (referee)
The recurrent theme of inter-human family relationships in a state of loss and decay in plays authored by Eugene O'Neill arises in part from the author's own traumatic relationship with his parents and with his brother James. Trying to deal with his torturous memories, O'Neill seeks answers through his cursed characters, who partly derive from the writer himself, yet also offer a universal portrayal of humankind as a victim of his own mental being and system. Given O'Neill's profound interest in psychoanalysis, the plays mostly take place in the life process of the individual minds of the protagonists and of the animating effect they have on others who populate the play-texts; therefore it is essential for the understanding of the play-works under critical consideration to look at the inner lives and worlds of these enigmatic characters, and to evaluate to what extent they act on their own will and where, conversely, unconscious forms of desire from other characters, memories, wishes, objects and so forth are instead determinant. The canonical plays Desire Under the Elms and Mourning Becomes Electra offer an intriguing blend of the forms and of the contents of the classical-traditional and of the modern stage play, as they extend the heritage and the lineage of ancient Greek tragedy, although situated in...
