Presumption of illegitimacy of the state power
Gregárek, Matěj ; Kysela, Jan (advisor) ; Maršálek, Pavel (referee)
The thesis challenges the established "myth of easy legitimacy" and argues for more cautious attitude toward involuntary social arrangements by shifting the burden of proof in favour of the rigorous individual rights. Any State action shall be held for impermissible unless it is shown to be unavoidable - beyond reasonable doubts. With the assumption of existence of individual rights as a starting point, the thesis inquires into the attempts to derive State's legitimacy from individual rights. Finding this task virtually impossible, it comes to the conclusion that the only way how to legitimize the State is to compromise the individual rights somehow. Yet, to maintain some meaning of the rights, this compromise need to be restricted in scope, so the thesis analyses further the meaningfulness of "necessary and proper" provisos and the notion of "ideology" as a factor driving collective action and as the ultimate check of the State's power.

Kunc, Martin ; Brunclík, Miloš (advisor) ; Perottino, Michel (referee)
This diploma thesis deals with a political program of Strana svobodných občanů. Firstly, the methodology used in this thesis is explored in the first chapter. Then, in the second chapter are defined and described relevant theoretical concepts. These are the concepts of Euroscepticism, anarchocapitalism and libertarianism. In the case of Euroscepticism, a typology by a French political scientist Cécile Leconte is used as well because Euroscepticism is a very complex term. In the next chapter there are described relevant aspects of political philosophy of Strana svobodných občanů. The fourth chapter, with help of content analysis of the Strana svobodných občanů program, answers to all of the research questions: To what extent is Euroscepticism present in the political philosophy of Strana svobodných občanů? How the presence of Euroscepticism in the political philosophy of Strana svobodných občanů evolved since the founding of the party to the present? To what extent is anarchocapitalism present in the political philosophy of Strana svobodných občanů? How the presence of anarchocapitalism in the political philosophy of Strana svobodných občanů evolved since the founding of the party to the present? To what extent is libertarianism present in the political philosophy of Strana svobodných občanů? How...
Czech church duringthe reign of Premysl Otakar I.
Kudláček, Jaroslav ; Hrdlička, Jaroslav (advisor) ; Veverková, Kamila (referee)
This work deals with the person and period of Přemysl Otakar I and above all with the Bohemian church, which at this time was fighting for its independence. I attempt here to describe Přemysl's achievement of a great success in the form of the Golden Bull of Sicily. I also address the ecclesiastical struggle that Bishop Ondřej conducted with the king. This whole struggle between church and state culminated in great privileges issued to the church by Přemysl Otakar I. In this work I describe both these successes, ecclesiastical and statebuilding. I approach this struggle from the position of the church and from the position of the state and in conclusion I summarise the impact the result of this struggle had on the Bohemian church. Role of the state related to private institutions providing care for preschool children
Bártová, Petra ; Kotrusová, Miriam (advisor) ; Hejzlarová, Eva (referee)
The aim of this thesis is to determine conditions in which are private kindergartens in the Czech Republic founded and kept. What sorts of problem can meet founders of those institutions and how is nowadays situation judged by experts from different areas connected with the topic. A private kindergarten is an alternative to state one and in these days, where is high demand for place in kindergartens, this alternative is widely used. Information obtained from interviews revealed several problem situations. Founders of private kindergartens find the major problem in illogical legislation, mostly in area of hygiene demands. During questioning the author came across some differences in answers, which were connected with interpreting of laws and disunited attitude from state institutions. Interviews with experts revealed reasons for the different attitude when speaking about private kindergartens, which is caused by two factors. Firstly it is a mistake in Czech legislation, when current laws partly obstruct hygiene administration from controlling existing or newly established institutions for collective childcare. Secondly it is an absence of training of officials, which enables disunited interpretation of law. Therefore the same institutions can manage others with different rules. Although these...
Violence and the Political
Svorník, Petr ; Slačálek, Ondřej (advisor) ; Bíba, Jan (referee)
The main subject of this paper is the course of state and violence under the impact of processes of globalization and privatization, culminating in the beginning of 21st century. Max Weber's definition of state as the monopoly on legitimate violence within certain area is highlighted, the aim of this work is to show current unsustainability of a nation state by this definition and also to describe other possible meanings of state in globalized world. After the theoretical introduction characterization of historical process of monopolization of violence by the state follows - contemporary course looks like the exact opposite of historical process, during which the state expropriated all of the other possessors of rights to use physical force. Next chapter depicts the present-day role of the state in globalized world and also possible re-interpretaions of this role for new, cosmpolitan state, whose task should be worldwide promotion of human rights and defence against planetary self-destruction. The paper is closed by emphasis on openness of the whole process - transnational companies try to promote an opinion that there is no chance of state's survival - that is true, but only for the state defined in national, not cosmopolitan terms.
Hrdlička Museum of Man during years 1929-1939 as an example of a popularization of scientific knowledge.
Toman, Petr ; Stella, Marco (advisor) ; Šimůnek, Michal (referee)
This work is part of a broader effort to revitalize the Hrdlička Museum of Man and to research it from a historical perspective. Starting from the view that the popularization of science by museums in general is problematic and a viable topic for the social sciences, the work attempts to focus on the way the exhibition at the Hrdlička Museum of Man was constructed by its creators. This topic is analyzed from three main perspectives: 1st the scientific standpoints and personal worldviews of the creators, 2nd relations between the museum and the public, and 3rd relations between the museum and the nation state; also, the influence of the building process itself is taken into account. The intention of the work is to look at the origin of the Hrdlička Museum of Man within its cultural, social and political context rather than focus purely on a historical description. It is an attempt to bring to light all the "unscientific" phenomena that shaped the exhibition's scientific, objective and authoritative message to the public. Powered by TCPDF (www.tcpdf.org)
State and War: Development of the Concept
Duda, Jan ; Barša, Pavel (advisor) ; Slačálek, Ondřej (referee)
The history of international law, understood as an object of intersubjective reality, reflected various territorial structures of human society. States, as bearers of international law, were made in course of history by wars that they led with each other. On the basis of thought of Carl Schmitt we can distinguish two historical structures of territory: the universal medieval empire and the modern sovereign states. Both of these structures were connected with distinct systems of international law and with distinct concepts of war. Since the turn of 19th and 20th century we can observe signs of decline of the Westphalian system of sovereign states. This process, accompanied by changes in concept of war, began to be fully expressed at the beginning of the 21st century in connection with so called war on terror. On the juridical concepts of war on terror and humanitarian intervention I show decline of the Westphalian system of sovereign states and possible return to the international structure of the medieval empire.
The concept of investor in international agreements on the protection of investments
Dubovan, Michal ; Balaš, Vladimír (advisor) ; Šturma, Pavel (referee)
The term "investor" in international investment agreements The aim of this thesis is to explain, compare and evaluate the meaning of investor as one of the key terms used in the area of international investment protection. From a systematic point of view, international investment activities are governed by international economic law, which is a sub-discipline of public international law. Foreign investment as a transfer of assets from one country to another in order to generate wealth is a kind of activity known and done since the era of colonialism or even before. The subjects carrying out these operations are called investors. However the framework of international investment protection as we know it today started out when the so called bilateral investment treaties (BITs) became commonly used to protect and promote international investing. These treaties entered into by states as sovereign members of the international community stipulated conditions to protect each other's investors in order to stimulate the flow of free capital over the borders. As mentioned before the term investor inter alia is a fundamental part of each international investment agreement. It specifies the range of subjects that are protected under such treaty and thus entitled to pursue their claims on international level in case of...
Conceptualizing Location - One term, many meanings, a lot of problems
Kopanja, Mihajlo ; Morgado Albino, Nuno (advisor) ; Riegl, Martin (referee)
Mihajlo Kopanja Conceptualizing Location - One Term, Many Meanings, a Lot of Problems Master thesis Supervisor: Nuno Morgado, M. Pol. Sc., Ph.D. Abstract Location as a geopolitical concept is one of the most fundamental variables being used in research since the beginning of geopolitics itself. Yet, usages of the concept in geopolitical literature point to different conceptualizations of location which, in turn, provide different explanations of causal properties this concept has on the state's behavior. This logical inconsistency imbedded in the concept of location sets up a fundamental question: what location, as a concept, is and how does it produce causal effect onto a state? Following that another question arises: can this inconsistency be resolved through reconceptualization? By identifying the set of different attributes assigned to the concept of location in existing literature determination of inconsistency has been made and used as a basis for reconceptualization of location. Through the introduction of a model with four secondary concepts using the radial approach to concept formation an attempt has been made to resolve internal inconsistencies of location as a concept and as a variable while increasing its explanatory power in understanding and analyzing its effects on states as shown in the...
