Innominate Contracts in Business Relations

Diploma thesis Innominate Contracts in Business Relations deals with a legal basis of innominate contracts in the Czech private law. It focuses mainly on so the called Modern innominate contracts. The purpose of the thesis was to answer whether leasing, factoring and franchising contracts should be codified. Consequently, it aimed to prove or disprove that the Czech legal regulation does not reflect the recent developments in business environment. The thesis is divided into two parts. In the first chapter an analysis is carried out on the legal regulation of innominate contracts in the Czech business law, civil law, labour law and international private law. The legality of innominate contracts and the applicability of an analogy is discussed in this part. Based on the Czech legal regulations and court decisions it was concluded that innominate contracts were valid and that courts may use analogy when deciding on civil or commercial contracts. The second chapter deals with the contents of leasing, factoring and franchising contracts. It concludes that there are reasons against the codification of the above mentioned contracts. The content of an operating leasing agreement very much resembles a rental contract which might be used for this kind of leasing contract.A leasing purchase contract does not present any new answers to issues which had already been dealt with by court decisions. The substance of a factoring contract -- assignment of a receivable is already regulated by the Civil Code. A franchising agreement involves parts of many types of codified contracts and interlocks with multiple legal areas. Moreover, all the above mentioned contracts are challenged by a fast pace of development therefore a codification could hamper the progress or it could become obsolete. Based on the above mentioned facts the thesis concludes that leasing, factoring and franchising contracts should not be codified in the Czech private law as separate contract types and therefore disproves the primary proposition of this thesis and subsequently infers that the Czech legal regulations do not reflect a recent business development.

Determination of biologically active compounds in medical plants by capillary electrochromatography

Capillary electrochromatography in macroporous polyacrylamide columns was successfully used to analyse and quantify lignans in extract of the seeds of Schisandra chinensis. Good separations were achieved in less than 35 min. The levels of schizandrin, gomisin A, gomisin N and wuweizisu C determined by CEC were in good agreement with those obtained by reverse-phase HPLC.

Changes to the Common Foreign and Security Policy of the EU with the Adoption of the Lisbon Treaty

Since its foundation in 1993, the common foreign and security policy of the European Union has undergone many changes aimed at improving its strength and efficiency. The Lisbon Treaty brought the most significant changes so far, transforming its institutional character as well as its functioning. The goal of this thesis is to introduce to the reader the changes to the common foreign and security policy brought by the Lisbon Treaty. However, our aim is not only to describe what individual provisions of the Lisbon Treaty mean for this policy area but also to focus on their real impact on the functioning of the common foreign and security policy and the strength of the European Union at international level. The thesis also focuses on the main shortcomings that the common foreign and security policy had to face in the past. It then tries to answer the question, whether the Lisbon Treaty removes these shortcomings and indeed increases the strength and efficiency of the common foreign and security policy of the European Union.

Econometric test of euro adoption impact on German and Czech exports: the costs and benefits of Eurozone membership in the trade sector

The purpose of this study is to find the influence of common currency on the international trade development. The study deals with the Rose effect, which says, that the currency unions increase trade by more than 200%. This thesis designes an extended gravity model of international trade where the economic characteristics of countries are combined with institutional and policy factors of trade, such as the EU common policies, impacts of the Euro or trade agreements and other factors, which lowers the transaction costs of trade, such as the quality of infrastructure. The thesis also deals with the data structure influence on the results of the estimation of gravity models and shows the problem which is not in common literature noted. Compared to the common research, this thesis focus in detail only on Czech and German exports.

The contemporary Czech art on the domestic and the global art market

The goal of this thesis is to analyse trends of the contemporary Czech art on the domestic market and possibilities of the contemporary Czech artists to succeed on the international art market. The firts part of the thesis describes specific forms of contemporary art and their position on the art market. The main factors influencing contemporary art prices are mentioned. The next chapter is concentrated on trends of contemporary art in comparison with the other segments of the art market. The third chapter is focused on development of the contemporary art on the domestic market. It analyses the present situation on the Czech art market and explores the potential of the contemporary Czech art. The last part of the thesis evaluates a success rate of the contemporary Czech art on the global art market.

Globalization and Health - access to health care for children of foreigners in the Czech Republic

Olga Davidová - Abstrakt DP - AJ Abstract Diploma thesis "Globalization and Health - access to health care for children of foreigners in the Czech Republic" addresses the issue of availability of health care for children of foreigners in the Czech Republic as development of legal framework in the Czech Republic and human rights issues. The main objective of this work is a critical reflection on the cause of discrimination against children of foreigners from third world countries (non-EU countries) in their access to health care. This is a retrospective case study which is selected by the institutional analysis of the key events of public policy focusing on the development of health insurance legislation. There are different mechanisms of protection of human rights at local, national, and international level in the availability of health care for children of foreign nationals from third world countries; unfortunately national legislation is not fully in line with international requirements in the area of health law. Although international documents are binding for the Czech Republic, they are not sufficiently applied in the Czech constitutional right to prevent violations of human rights.

Position of Asian developing countries in international trade

Developing countries, and especially Asian are playing an increasingly larger role in international trade. The aim of this thesis is to examine the current status of Asian developing countries in world trade, to analyse the impact of involvement in international trade on their economy in the period since the eighties to today. The work will focus in detail on three selected countries: China, India and Vietnam. In order to meet the objectives of the work mainly used methods are analysis, comparison and induction. Research has been carried to the conclusion that the share of developing countries in international trade Asia continues steadily to grow, but is influenced by developments in the major economies and the main driving force is still China. Shares of other Asian developing countries on the world market are still relatively small. The fact is that international trade has helped these economies to reach positive developments. The results of this study allow readers to have a deeper look into the issue of Asian developing countries in international trade.

The dissertation "Did It Really Happen? Testimonies before The International Criminal Tribunals and in Refugee Status Determination" promotes the creation of guidelines for the fair and consistent assessment of evidence in refugee status determination. The correct interpretation and effective application of these principles can reinforce local as well as global trust in the international refugee protection regime. The framework in which witness testimonies are assessed before the two ad hoc international criminal Tribunals - the International Criminal Tribunal for the Former Yugoslavia, and the International Criminal Tribunal for Rwanda - appears to be the most relevant for refugee cases. The judgements issued by Trial Chambers often include a coherent and logical description of how they work with and interpret rules on evidence, and their approach is generally approved by the Appeals Chamber. Aim diploma work is analysis of system HACCP in company Pascual Polabí s. r. o.. To analyze this system properly I arbitrated to carry out internal audit upon this system, I examined, whether adhere plus check all critical control points. Processed I record from hereof inner audit plus determine several power procuration plus recommendation. This system I examined partly with reference to valid legislature plus partly with reference to in-home regulations " Health dangerous at agricultural basic industry firm Pascual Polabí s. r. o." I investigate with recency plus rightness diagrams industrial process plus assesment breaking point.. System implementation HACCP will realize legislative requirements for food processing firm, will ensure production (performance) plus sale health unexceptionable groceries plus dishs, protect the consumer and food processing firm (better vindication before inspection authorities plus complaints consumers) as well as increases know - how plus qualification workers. Base system HACCP is, that not only must be well - established, but also have to adhere correct production plus hygienic rules. That is means, that all personnel must be familiarized whith it and everyone have to know what, when, why plus how be to do. Describe here, how is system HACCP in company Pascual Polabí s. r. o. implemented and on what diversification according to legislature zero in on. In third chapter describe fulfilment check internal audit system HACCP, where I double - checked how consequential plus entire lead all documentation system HACCP, so and observance all critical check point in terrain, afield and in store. From defense alliance to security management: neoliberal institutionalism and NATO's transformation

Changing environment of international relations, changing conflicts character, and new threats and risks influence North Atlantic Treaty Organization (NATO) and its role in international system. Clear structure of international system ended with end of bipolar division of Cold War. Unclear political equilibrium brought the question of future of NATO. Political concept that was used during Cold war was not sufficient and the Alliance stated again in front of transformation needs. Also during the Cold War the role of national security had been changing. Subject of this research is character of transformation of NATO and its adherence to theoretical premises of neoliberal institutionalism. International institutions are often subject of research in international relations. This thesis reacts on the deficiency of interest about changes and survival of institutions in literature. The thesis works with the theory of Robert O. Keohane that is rooted in the end of the Cold War but has been modified by further author's works. After basic analysis three variables were identified.
