Psychological Context of Shared Custody

5 Abstract This bachelor thesis concerns the issue of shared custody as a form of post-divorce arrangement. The overview part comprises a short introduction to issues related to family transformations, divorce rate in the Czech Republic, legal definitions of marriage and divorce, and conditions of both it's formation and dissolution. A separate chapter also regards the consequences of absence of one of the parents during child-rearing. The thesis further encompasses an overview of various types of post-divorce arrangements, their incorporation in Czech legal system and the terminology used in English-written research articles. The very substance of the overview part of this thesis is the shared custody itself as a form of post-divorce arrangement and factors affecting it. In relation to shared custody I mention both it's advantages and disadvantages for everyone involved, shared custody from the children's point of view, characteristics of families going through with shared custody and experiences with it from abroad. Finally, the thesis outlines a draft of a qualitative research project, which aims to examine factors affecting the process of shared custody in Czech families based on interviews with their family members, where shared custody, at least for a limited time, took place. Summary: This work proposes a closer look at the divorce-related topics with consequential impacts both on financial situation of divorced spouses and destinies of minor children as resulting from divorced marriages in Czech Republic. Till date, this issue has been solved in different ways at both district and regional courts. In our republic, a more unifying element is represented by decisions of the Supreme and Constitutional Courts. This is a very serious social phenomenon which, according to statistics affects a large number of parents, children, but also childless partners. Yet from ancient times this phenomenon is known to be socially undesirable being almost entirely rejected by the Catholic Church in its canon law. The increase in divorces has resulted namely from the advancement procedure of society. It is a societal phenomenon known to occur irrelatively of the states and political systems, from the totalitarian regimes through those autocratic, up to highly democratic systems of developed countries worldwide. The relationship of parents to minors with regard to the specifics of domestic violence

The dissertation thesis "Relationship of parents to minors with regard to the specifics of domestic violence" focuses in particular on judicial proceedings in cases of custody of minors where family relationships are affected by domestic violence. It attempts to explain why it is necessary for the courts to take into account this fact and to adopt such measures within their decisions to provide sufficient protection to persons at risk and at the same time to stop violent behaviour. Domestic violence as a dangerous social phenomenon is described in detail; information on its individual appearances and forms is brought; briefly mentioned are also other scientific disciplines whose knowledge is important not only for the recourse of offenders and the protection of victims but also for creation of a strategy of effective prevention. Negative impacts on mental state of minors are stressed, who must be viewed in all cases of domestic violence as its victims, i.e. also when the violent behaviour is not immediately directed against them. Shared residence in Czech and German law

Abstract, key words Title of the thesis: Shared residence in Czech and German law The aim of this thesis is to compare the approach to shared residence in the legal order of the Czech Republic and the Federal Republic of Germany, i.e. to find out to what extent the approaches of these countries to shared residence differ. This is examined in relation to selected issues which courts had to deal with when deciding on the shared residence, i.e. the influence of the child's wishes, the parents' will, their ability to communicate and long distance between the parents' households on the suitability of shared residence. Special attention is paid to the presumption of shared residence, or shared residence as a rule. The thesis focuses on the effective regulations. The thesis is divided into three parts. The first part deals with the Czech regulation of the shared residence. The individual chapters explain basic terminology, sources of law, legal regulation of shared residence, case law on the selected issues, including the presumption of shared residence, and some of the specifics of maintenance obligation. Shared custody and its influence on a child's success in primary school

This diploma thesis deals with the problem of shared custody of children at primary school in relation to their school success. The issue is viewed from the perspective of primary school teachers and from the perspective of a school psychologist. The theoretical part deals with a child at primary school and also with child, who has special educational needs. It also deals with family, parental responsibility, discusses divorce, shared custody, school success and failure. The empirical part, through empirical research, aims to answer the question: "How does shared custody affect the school success of a child at primary school?"It examines the manifestations of children in shared custody, it looks for specific causes of problems of these children or specific factors ensuring smooth course of shared custody. It collects recommendations from teachers and school psychologist on how to work with and help these children. It also provides recommendations on who to work with and how - including cooperation with parents. It shows the level of teachers' awareness of this issue and their personal views on the issue. Shared child care in legislative documents and in real situations of families with preschool children

Focus of this Bachelor Thesis is the shared custody of the preschool child, its legislative aspects and the deep insight into the actual situations of families that share custody over their children. The thesis consists of two parts, theoretical and practical. Theoretical part describes family, its function and the need for family in children lives. Other topics covered are family crisis, family breakdown, ways of child raising after the divorce. The theoretical part is concluded with legislative aspects of shared custody in the law system of the Czech Republic. Practical Part includes the research conducted in three families in the course of one month - October 2019. Research objective is to learn if families find the shared custody to be the suitable solution of their situation, how it influenced life of the mother and father of the child and what are the positive and negative aspects of shared custody. The research also tries to find and tackle possible changes in child behaviour as a result of shared custody. The main research method is qualitative research in the form of a structured interview separately done with all of the involved parents. Legal legislation of shared custody

This bachelor's thesis is dedicated to the Legal legislation of shared custody in the Czech republic. The aim of this thesis is to examine legal regulations of shared residency and to present its pros and cons. This thesis covers most of the theoretical elements of shared parenting. It is composed of six parts, each of them dealing with different aspects of child custody. Most of the chapters build upon a detailed research. Legal regulation and judicature are the main featured resources of this thesis. The first part features the parents and the child. The second chapter covers all three acceptable forms of child custody supported by law: sole custody, joint custody and shared custody. The third chapter is focused on the terms custody and visitation and their meanings from a judical and legislative point od view. The next chapter covers the role of the courts and other authorities associated with child custody. The fifths part describes the elements of shared custody in greater depths, including preconditions and methods how to apply for shared custody agreement but it also presents its downsides and limitations. The last chapter is based upon the method of secondary analysis. I studied court decisions of child custody cases statistically and analyzed how they refer to the individual aspects of shared parenting.
