Mediation in the Czech legal framework and comparative analysis with foreign legislation

In the diploma thesis titled "Mediation in the Czech legal framework and comparative analysis with foreign legislation", the author aims to analyze how the basic principles of mediation are legislated in the legal systems of the Czech Republic, the Federal Republic of Germany and the United States of America. By applying a combination of methods of quantitative and qualitative comparative analysis, the author deals with the question of how the legal regulation of mediation affects the usage of court-ordered mediation and the success of such a mediation process. The author focused mainly on the legal grounding of the main principles of mediation, the historical and cultural context of their origin and the form of the mediation process for court-ordered mediation. The author based her work on the authentic wording of legal regulations and used officially available data for the quantitative comparative analysis, which related the usage of court-ordered mediation in the analyzed countries.
Germany's Energy Security in the Gas Sector

Energy security is an important and current issue that resonates especially in resource-poor countries. In these countries, it is crucial to ensure a stable energy supply in order to maintain economic stability and ensure future economic growth. Germany is a state with low energy reserves (apart from coal reserves), and therefore this work focuses on German energy security in gas sector. The aim of this master thesis is to evaluate the current level of energy security in Germany in natural gas sector and to point out future potential threats arising from the realization of Nord Stream gas pipeline. In order to meet this goal, a new analytical framework is created, which evaluates gas security in terms of both short-term and long-term energy security indicators. This framework is based on several studies, primarily on the Model of Short-term Energy Security published by International Energy Agency. The framework is further extended by other studies dealing with the long-term dimension of energy security. Constitutional development of selected Central European countries in 1945 - 1990 Abstract This diploma thesis deals with the constitutional-law development of selected countries of Central Europe, namely the development in the German Democratic Republic, the Federal Republic of Germany and Poland, from 1945 to 1990. The thesis captures significant changes in the field of constitutional law in these countries and tries to put them into the background of social events and moods of the time. After an initial outline of the social situation after the end of the Second World War, the work deals with the situation in post-war Germany, the division of its occupation zones including the circumstances that preceded the division, and then the emergence of political parties in each zone. The third chapter deals with the development in the Federal Republic of Germany. It analyses the establishment of the Basic Law and the Republic itself and describes in detail the constitutional framework formed by the Basic Law, not forgetting the occupation status and the general treaty. The Importance of two German-Czech European Battlegroups with regard to German-Czech Relations

The goal of this Bachelor thesis was to examine the importance of two German- Czech European Battlegroups with regard to German-Czech security relations. This thesis is concerned with the mutual security cooperation of both countries since 1990. It reveals a dynamic development in the bilateral relationships, especially a conciliation with the past, which has been a precondition for later successful cooperation. Differing historical experience projected into an attitude of both states towards their armed forces, which is noticeable until the present day. The thesis further analyzes the German role during the NATO enlargement in 1999 and discusses the military cooperation of the Czech Republic with the Federal Republic of Germany both in the North Atlantic Treaty Organization and the European Union. The main emphasis is placed on the concept of European Battlegroups and its practical realisation in four particular examples: Czech-Slovak (2-2009), the first German-Czech (2-2012), the first Visegrad (1-2016) and the second German-Czech (2-2016) European Battlegroups. Surrogate Motherhood - Comparison of the Legislation in the Czech Republic and the Federal Republic of Germany

The main subject of this master thesis is the issue of surrogacy in the Czech Republic and the Federal Republic of Germany. At the beginning, this thesis aspires to define the term surrogacy in general as well as other connected terminology, and subsequently to specify its categories and describe its major historic milestones. Afterwards, it deals with the rather brief Czech legislation concerning this institute and the consequences this has inevitably led to. It also concentrates on the methods of the assisted reproduction which help to put the surrogate motherhood into practice. This thesis does include ethical problems of surrogacy and some of the psychological and sociological aspects as well. Consequently, it summarizes sanctions which may arose as a result of surrogacy. After that, it explains the legislation related to this issue in the Federal Republic of Germany, its history and legal limits. It deals with the German sanctions which the realization as well as mere arrangement may be subjected to. Political Party Funding: an International Comparison

The aim of this thesis is to identify significant weaknesses of political party funding system in the Czech Republic, and to suggest possible improvements of the system. Knowledge acquired in the first part of the thesis, which deals with the theoretical basis of political party funding, is used to analyse the applicable legislation. This part of the thesis first of all describes the legal framework of political parties, the principles and goals of political party funding, and possible approaches to the funding; the most space is devoted to one of the possible approaches, regulatory measures, which is divided on the basis of supply side (state a private funding) and demand side (mainly campaign spending regulation). The Czech legislation is not only analysed in general and using the theoretical basis, but is also compared with the system adopted by the Federal Republic of Germany. The hypothesis is that the German law is a good example for the Czech Republic in the field of party financing, for the Federal Republic of Germany has been a developed democratic state of law for a longer uninterrupted period of time, and was one of the first countries in the world to introduce state funding of political parties. Alternative for Germany: election marketing, political personalities and current development

The submitted bachelor thesis Alternative for Germany: election marketing, political personalities and current development deals with an analysis of a German political party. At first, the creation and development of a political subject and its anchoring in the German political system is described. The influence of individual chosen politicians on the policies of the Alternative for Germany is examined, as well as the tools of political marketing and the communication with the electorate. In the end of the thesis, an emphasis is given on the current development of the party from autumn 2017 till April 2018.
Comparison of selected aspects in the coordinated rehabilitation in Czech children's homes and in German children's homes

In the provided care for children placed in substitute residential facilities in the Czech Republic are in the context of European Union made demands to change some key aspects of its current structural frame. Aim of this master thesis is to provide in this context, through the analysis of mainly bibliographic sources, a complex overview of the system of substitute residential care in two EU countries, the Czech Republic and the Federal Republic of Germany. The thesis contains an insight into the activities of both systems, as well as comparatively processed answers to two initial research questions. The results of the research work on the answer to the question "What are the differences in the existing service network, regarding the work with the children placed in selected Czech and German children's homes?" show, that the established frame of the provided services is similar, but the qualitative and quantitative offer of the services is in practice reflected by different economic situations in both countries. The result of the second comparative research, answering the question "How are in the chosen countries determined the means of children rehabilitation in the selected children's homes?", shows, that the coordinated rehabilitation is in all its parts realized in both countries as consistent with the fulfilment of "the child's best interest" as possible. The most significant difference in reaching the optimal harmony of all segments of coordinated rehabilitation in these countries makes the application of support means to the work with the family, to the care for youth preparing for leaving the institution, to the realization of complex multidisciplinary care, or to fulfilment of an individual approach and planning. It is therefore desirable, that the Czech Republic, as well as the Federal Republic of Germany, orient themselves not only on the quality of provided help and care for the children placed in children's homes, but also on the future of young people, who are in the process of leaving the institution. This can be achieved by legislatively well-set structural system of substitute residential care, in which is through suitable service provided a valuable support in the context of coordinated rehabilitation. This master thesis can for the people interested in this topic expand the view on how the same mission regarding the children in substitute residential care is fulfilled by two advanced European countries, it can also be in this context an impulse to reflect on the form of a good practice in these institutions.
