Mass media portrayal of Czech courts
Forejtová, Natálie ; Homolová, Pavla (advisor) ; Sedláčková, Markéta (referee)
This thesis focuses on the mass media portrayal of Czech courts in the context of the possible influence on the court's legitimacy and confidence. The research of portrayal is based on the analysis of Fagan's dimensions of legitimacy (effectiveness, distributive justice and procedural justice), court rulings and the overall view. The representation of sources of legitimacy rather corresponds to materialistic society - the most represented dimension in 2014 was the effectiveness, on the other hand, distributive justice was represented the least. Normative factors, namely procedural fairness, however, were not covered much. The portrayal in 2014 was, in terms of judicial rulings and the overall view, rather neutral but the sources of legitimacy were mostly negative. Differences were mainly found among mass media portrayal of the lower courts and higher courts and the differences correspond to different confidence in these institutions. I also studied the development since 1997, but besides the increasing interest of mass media in the courts, I have not found any other significant differences which could cause the rise of confidence in the courts. Mass media can also cause the difference in confidence in the courts of the left-wing and right-wing oriented people, because the journal Pravo has a slight...

Contemporary Critique of Juristocracy
Píša, Radek ; Kysela, Jan (advisor) ; Reschová, Jana (referee) ; Holländer, Pavol (referee)
(Contemporary Critique of Juristocracy) This theses deals with a comparative research of judiciaries of the United States, Israel and the Czech Republic. Consequently, it reaches a conclusion that all of these countries are undergoing a substantive political crisis, which leads to unhealthy empowerment of a judiciary system. The judiciary in abovementioned countries is moreover incapable of meeting challenges connected to the legislative deferrals, since the courts are unable to disconnects themselves from a social reality. The countries selected for the study was chosen in order to achieve as diverse sample as possible. That should lead to universally applicable outcome. Besides this empirical line of research, there is a deeper normative line attached. I believe it is vital to foresee a future political arrangement in a positive manner, even though there is a substantial risk of authoritarian regime's emergence during this transition. Still, the worst thing we can do is to kick a can of contemporary political imagination down the road forever. That prevents progress, but it also highlights another threat of authoritarian regime in name of protecting "freedom" against democracy or "democracy" against freedom. Regarding the content of the thesis, I pursue an abovementioned idea about highly...

A Libertarian Critique of the U.S. Criminal Justice System
Král, Zdeněk ; Sehnálková, Jana (advisor) ; Calda, Miloš (referee)
The thesis analyzes selected issues in the U.S. criminal justice system, and the solutions proposed by American libertarians. First, it introduces libertarianism as a whole, based on both contemporary and historical sources. The thesis then examines the real influence of libertarians on U.S. politics, and the possibility that libertarian proposals might be adopted. It analyzes the successes of the U.S. Libertarian Party and introduces movement and factions in the two major parties, Republican and Democratic, and today's influential politicians who at least partially promote libertarian proposals. In the final, pivotal chapter, the thesis uses the theoretical base provided in the first chapter to analyze the shortcomings of the U.S. criminal justice system, and the solutions and changes that libertarians propose. The structure of this analysis follows the generally accepted structure of the system itself, dealing with criminal law and its enforcement through policing, courts and corrections. On each of these levels, the thesis introduces both the libertarian critique of today's system and examples of specific issues and proposed solutions. The thesis identifies the so-called "War on Drugs" as one of the key points of the libertarian critique, and uses is as a case study which illustrates the impact of...
