Strangers in a Strange Land: American Lives under the Soviet Gaze
Perry, David ; Brisku, Adrian (advisor) ; Vykoukal, Jiří (referee) ; Kolenovská, Daniela (referee)
Strangers in a Strange Land: American Lives Under the Soviet Gaze By David Perry This paper aims to shed light on the lives of American immigrants living in the Soviet Union during the 1930s, while also discussing the role that state propaganda, presented through English-language periodicals such as Moscow News, played within the immigrant community. This paper provides needed analysis of an under-researched population in the study of immigration in the modern era. By focusing on primary sources produced for the consumption of the community as a whole, as opposed to individual experiences found in memoirs or letters, this paper attempts to create generalizable information regarding the social and political pressures facing the Soviet-American immigrant community of the 1930s. In the second chapter of this paper, I construct a profile of the immigrant community and trace the historical development of the community, from the United States in the early years of the Great Depression to their emigration to the Soviet Union. I also work to describe the ways that factors such as race, gender, and class affected the experiences of the immigrant community. This paper utilizes a conceptual historical approach, particularly in its third chapter, to develop an understanding of the way that concepts important...

Dubravská, Tereza ; Kubešová, Silvia (advisor) ; Frintová, Dita (referee)
Comparative analysis of representation by the attorney in Czech and Spanish civil proceedings The subject of the diploma thesis is the comparative analysis of representation by the attorney in Czech and Spanish civil proceedings. The first part is dedicated to concepts of civil procedure and it's categories. The second part contains a definition of the concept of representation in the civil procedure and it's categories in the Czech and the Spanish law. The third part which is crucial for this thesis focus on the role and the position of an attorney in the civil procedure and on the relationship between the attorney and his client. The third part is also dedicated to the attorney and the requirements the attorney has to meet according to the law. In case of the attorney, as a professional in law and as a member of a bar association, and in case of the relationship between attorney and his client - Czech and the Spanish law are very similar to each other. However significant differences exist in roles which attorney holds - precisely the extent of his activity as a representative of the participant. One of differences is an existence of the legal institute of the legal representative in the Spanish procedural law. This legal institute does not exist in the Czech procedural law and its functions...
UN Secretariat: Representative sample of the world population or dominance of specific groups?
Bartošová, Kristýna ; Parízek, Michal (advisor) ; Karlas, Jan (referee)
This thesis attempts to apply the Representative Bureaucracy theory established and developed within the Public Administration scholarship addressing the lack of formal accountability of bureaucratic bodies on the case of the largest international bureaucracy in the world - the United Nations Secretariat. It builds on the normative presumption that it is necessary to staff the bureaucracy proportionally from all the societal groups so that it reflected the values of the society in whole and the policy outcomes corresponded to those produced if all the society participated in the process. Accordingly, we aspire to find out whether the UN Secretariat is a representative sample of the world population in terms of its bureaucrats' national affiliation, and, if not, what are the factors associated with a better relative representation of a Member State in the UN Secretariat. Through the usage of descriptive statistics tools and Ordinary Least Squares Multiple Linear Regression, we find out that the per capita representation of different Member States in the UN Secretariat is by no means equal and, thus, the UN Secretariat is not a representative sample of the world population. Moreover, the research identified internal capacity of a country to ensure wellbeing and opportunities of its people and low...
Representation
Komárek, Tomáš ; Dvořák, Jan (advisor) ; Elischer, David (referee)
Representation: This thesis on the topic of representation is focused generally on behalf of the Institute. It mainly deals with the rules contained in Civil Code, Act no. 89/2012 Coll. It desribes basic concepts and methods of resolution representation. Its interpretation focuses on the diferences between any forms of representation. In that case, it is not possible to write up the entire institution of the representation, which was one of the largest in the law. This work is therefore focused on the substantive representation, and especially on the conditions for the creation and termination of contractual representation and on guardianship and especially guardianship of individuals. The thesis contains also an outline of the historical development of the Institute's presence in our law, but again, considering the vastness of representation, it is not an exhaustive analysis, but merely mentioning the most significant sources. An element of this thesis is also an overview of the procedural representation in civil court proceedings. Adoption of the Civil Code Act no. 89/2012 Coll. had to institute represented a significant impact when to applicable law brought many new important sub-institutes, and greater clarity.

Power of attorney and its significance in civil law
Kaňková, Petra ; Šustek, Petr (advisor) ; Hendrychová, Michaela (referee)
Power of attorney and its significance in civil law First, in my thesis I generally dealt with the representations, I outlined the historical development, I mentioned very briefly adjustment of the legal representation and then I examined the conditions a person must meet in order to become a representative. The emphasis was put mainly on the distinction of the various terms associated with the institution of representation by power of attorney, as a unilateral act of the principal. Although the main part of the thesis was focused on adjustment in the Civil Code, I also mentioned provisions of the Commercial Code and a separate chapter is devoted to modify the representation by power of attorney in the Civil Procedure Code. The importance of representation by power of attorney is very significant, so I explored this part in a separate chapter. As this institute is used in practice almost every day, I focused on individual persons authorized to represent and on their most important rights and obligations. The aim of the chapter on certain types of contracts was only to point out some differences between them, not to provide their detailed analysis. An interesting and inspiring chapter then focuses on the comparison of Czech legislation with the legislation of Australia. In the last chapter I tried...

Kříž, Josef ; Čech, Petr (advisor) ; Pelikán, Robert (referee)
OF DIPLOMA THESIS An impact of incapacitation of a limited company upon legal theory and practice Author: Josef Kříž Supervisor: JUDr. Petr Čech, LL.M, Ph.D. Department: Department of Commercial Law The main purpose of my thesis was to analyse the significant change in the concept of limited company, i.e. old-new concept of the members of statutory body as agents of the company. However, I conceived a thesis more generally as analysis of the question of whether the New Civil Code and the Business Corporations Act incapacitated limited company or not. The thesis is divided into five main chapters, including an introduction and a conclusion. In the second chapter I try to reconstruct legal thinking of First Czechoslovak Republic on this issue, because its reference by the New Civil Code. Although views on the status of a statutory body of legal persons and the legal capacity of a legal person were different, I came to the conclusion that there was more or less consensus that members of statutory body are agents of legal persons. Regarding the legal capacity of a legal person, then it can be concluded that the doctrine of the First Czechoslovak Republic concluded either that the legal person is a person incompetent, or that the legal capacity is not by definition characteristic of legal person. In the...
Representation upon a Power of Attorney
Krupová, Petra ; Dvořák, Jan (advisor) ; Salač, Josef (referee)
The aim of this thesis is to clarify the legal regulations of the institute of the representation with an emphasis on the representation upon power of attorney (contract representation). Thanks to the extent of this work it is impossible to encompass the whole matter of the representation in a way that would be worthy of an analysis. In this thesis it is written about the historical roots of the legal regulations of the representation which are already enshrined in Roman law. The main part of the adjustment is de lege lata. The general adjustment of the representation has to be searched in the valid and effective Civil Code (The Law No. 40/1964). We can meet the partial legal regulations in other branches of the legal code too, for that reason other legal statutes related to the topic of this work are discussed. The thesis deals with the application problems in practice and numerous law cases of the law particularly of higher courts. The attention is also focused on two initiatives within the European Contract Law - the Principles of European Contract Law (PECL) and the Draft Common Frame of Reference (DCFR). Finally it is necessary to pay - now approved - the new Code of Civil Rights, which represents an extensive legislative work and as the complex is an important legislative step in the times of...
