This work is focused on motivating and evaluating employees in a gastro company, analysis of these activities and their effect on staff behavior to corporate finance and property in general. The first part describes theoretical background issues, basic concepts and their relationships. Then where is the problem thoroughly analyzed and practical examples of problems and their current solution are included. After this comprehensive introduction to the topic, new solution will be proposed, which would have the maximum possible effect through theoretical knowledge, logical reasoning, and ultimately practical experience and analytical calculations.

1 Sanctioning of legal persons Abstract Sanctioning of legal person is a topic that is more than relevant. Although the phenomena of criminal liability of legal person is not unknown to the continental Europe, rapid development can be seen in the second half of 20th century and in the beginning of the 21st century where most of European countries enacted laws regarding criminal liability of legal persons. The Czech Republic enacted the Act No. 418/2011 Coll. on the criminal liability of legal persons (hereinafter "ZTOPO"). This diploma thesis is divided into six parts. The first part is about criminal liability of legal persons in general. It provides a quick historical evaluation and analysis of the term criminal liability of legal persons itself, then it is focused on the ZTOPO. The second part is focused on compliance program with regard to its function, preferable content and relevant case law. The third and fourth part is the core of this diploma thesis. The third part solely focuses on sanctioning of legal entities under the ZTOPO. It separately describes every sanction that could be imposed under the law and focuses on the deficits of the legislation. The topic of this thesis is fine and other penalties for administrative transgressions. The thesis deals mainly with various types of sanctions which can be imposed for committing an administrative delict, as well as with facts that have to be considered while imposing a sanction. The first chapter deals with theoretical aspects of the topic, namely with legal liability, definition of the term sanction, the characteristics of administrative punishment as well as the functions of punishment. The second chapter focuses on the basic conditions and rules for sanctioning the administrative delicts. The chapter deals with legislation of sanctions, the rules for sanctioning administrative delicts in terms of time applicability and also with the current system of sanctions. A part of this chapter is dedicated to releasing from imposing a sanction as a possibility of dealing with administrative delicts without the need to impose a penalty. Beyond the speculations about the consecutive waves of Covid, 2020 will be reminded for one of the most notorious failures of a listed firm, due to a massive accounting fraud: the German payment fintech Wirecard. The firm, with 30 subsidiaries in 26 countries, joined the prestigious DAX index just two years before. The spillovers of the billion-euro fraud range from the arrest of top managers to suspicion of auditors, politicians, and regulatory authorities (BaFin, European Commission, and ESMA), as suggested the Financial Times headline "Why was Frankfurt so blind for so long?"1 Such a failure serves as a reminder of the relevance of financial markets regulation, oversight, and enforcement, in order to protect investors and to encourage compliance with regulations. Proportionality of a four-year ineligibility for the first intentional anti-doping rule violations and its impact on professional athletes' careers

Title: ​Proportionality of a four-year ineligibility for the first intentional anti-doping rule violations and its impact on professional athletes' careers Objectives: ​The aim of this thesis is to ascertain whether the four-year ineligibility for the first intentional anti-doping rule violations has liquidation impact on professional athletes' careers. Methods: ​For quantitative research, I have used the electronic interrogation method and for qualitative research the in-depth semi-structured interview. Results: ​I have found that most athletes really do perceive a four-year ineligibility for the first intentional anti-doping rule violations as disproportionate. Only 24 % of surveyed athletes said that a four-year ineligibility is an appropriate punishment. 82 % of surveyed athletes would end their careers after receiving a four-year ineligibility, and just 30 % of them think that It's realistic to go back to an active career after a four-year break. Moreover, athletes have consistently said that the most crucial obstacles to their return are financial distress, loss of motivation and lack of racing mode. Sanctioning of legal persons Abstract The criminal liability of legal persons was introduced into the legal system of Czech republic by the Act no. 418/2011 Coll., Act on Criminal Liability of Legal Persons and Proceedings against them which came into effect on the 1st of January 2012. It is a problematic that was highly debated even before the respective law was created and its introduction into the legal system was closely followed by most of our experts in the field of criminal law. We can still see a big interest in how this problematic functions to this day, more than 8 years after its adoption. This interest became the main motivation for the creation of this thesis. This thesis focuses mainly on the 3rd part of the above stated Act which means it concetrates on the individual sanctions applicable in relation to legal persons and how they are being used in the decision-making process of the courts of Czech republic. 1 Abstract This diploma thesis deals with the analysis of the issue of sanctioning of legal persons as well as with selected aspects of criminal liability of legal persons. The main reason why I chose this topic is my deep interest in analyzing the discussed issues together with the evaluation of the current state of the Act No. 418/2011 Coll., On Criminal Liability of Legal Persons and the Proceedings against them, and on the basis of this evaluation to submit proposals for improvement. Domestic violence is an important problem in theory and in practical context. It is a serious social concern with high level of latency and this is why we still need to talk about it. An each family member, can be a victim in most of cases women are victims. This thesis also focuses on male victims of spousal violence. A violence is different for each of these groups which is described in this thesis. This thesis is divided into seven chapters. The introductory chapter is focused on the historical context of domestic violence. This chapter analyses the status of the victim and also deals with new convention of Council of Europe - Action against violence against women and domestic violence (Istanbul convention). The second chapter explains what the domestic violence is and types and characters does it have. It is impossible giving a precise definition of phenomenon domestic violence. On the other hand, we can find attempts to define the domestic violence and some of these are mentioned in this chapter. This thesis deals with sanctioning of legal persons under the Act No. 418/2011 Coll., on Criminal Liability of Legal Entities and Legal Proceedings against them (hereinafter referred to as "Act"). The main part of the paper consists in detailed analysis of the sanctions that may be imposed on legal persons. The main goal of the thesis was to evaluate this relatively new area of legislation which has not been amended to this day in any significant way. Special focus was given to the evaluation of whether the effective legislation in question is complex, sufficient and flawless or whether any amendment is necessary. The preface introduces the main topic, goals and the structure of the thesis. The thesis in general is divided into four parts. The second part deals with the basic institutes related to the criminal liability of legal persons and their sanctioning. The character of legal persons is defined, as well as the range of relevant legal entities on which the legislation in question is applicable.
