Protection of personal rights of individual in mass media

11. Abstract in English This Master Thesis refers to the protection of personal rights of the individual in mass media. The main purpose is to analyse Czech legal regulations regarding this matter and to assess if the level of judicial remedy for the protection of personal rights is sufficient and appropriate. This thesis is focused on the collision of two fundamental rights, namely the right to protection of personal rights and that of freedom of speech and expression. Because of the growing influence of mass media, these rights are frequently at the centre of public debate and issues. The principal problem is which right should be prioritized. Both of them are established as fundamental human rights at the constitutional level therefore enjoy the same degree of protection. Attention is also paid to Spanish legal regulations of protection of personal rights of the individual in mass media. The important differences between the Czech and Spanish legal systems are pointed out throughout the whole paper. The thesis is composed of seven chapters. The first chapter is introductory. The role of media during formation of public opinion on the course of criminal proceedings

Diploma thesis called The Role of the media in shaping public opinion on the course of criminal proceedings deals with the issue which lies on the border between legal and media science. Its aim is to explain the relationship between these two areas on the basis of criminal proceedings, both in theory and practice using real criminal cases. Diploma thesis primarily deals with the legal base of the media and its relationship to some important principles of criminal law, namely the principle of presumption of innocence and the principle of public prosecutions. The principle of presumption of innocence and its violation affects the personal rights of offended person, so this work is also focused on comments relating to the personality protection against unauthorized interference which may occur in the context of criminal proceedings, both by the authorities involved in criminal proceedings as well as from the media. For the media sector there are some typical legal institutes correcting such interference which are presented in this thesis as well. Personality Protection and Camera Systems

The thesis deals with the protection of individual integrity and camera systems, through the lens of valid and effective law regulation. The content of this work is formulation of theoretical basis, an analysis of relevant laws governing the issue of individual integrity protection of natural persons (especially their privacy) and camera systems, specifically for each type of camera system: the camera system with recording, camera system without recording, comparison of both types of camera systems and an account of legal instruments available for protection of individual integrity of each person, whose universal individual integrity rights were violated due to the operation of a camera system (regardless of it's type). The theoretical basis is followed by the main body of work, which explores researching camera system usage within a specific public authority agency. The operation of camera system is subjected to critical legal analysis, where particular aspects of a specific public authority subject's practice is evaluated as part of the findings of the thesis and qualified as compliant or non-compliant with the law. At the end of the work, the author formulates specific recommendations to the public authority agency, aiming to improve the approach to operating a camera system from the legal point of view.
General Data Protection Regulation and its Impact on Grey Literature

In April 2016, the European commission adopted a new General Data Protection Regulation. This regulation is based on fundamental principles of the existing legislation and elaborates it further into the set of rather detailed legal instructions. The suggested paper aims to summarize the parts of the new regulation that are most relevant for operators of gray literature repositories, who will have to adapt within the next two years. The paper will focus on the issues of consent to the processing of personal data, the legal regime of processing personal data without the consent of the data subjects, the data subject’s right to information as well as the legal regime of acquisition of personal data by third parties and exercise of the newly formulated right to be forgotten.

The protection of personality and CCTV systems.

This thesis is dedicated to the protection of personal details in the Czech Republic because it permeates the entire legal order and infringing on privacy is a fundamental right in the Charter of Fundamental Rights and Freedoms. The aim is to analyze the development and current state of protection of personality and the right to confront with the city camera supervision system indulging city police in the Carlsbad region. In the Czech Republic there is a collision of two components of fundamental rights and freedoms, the right to privacy and the right to safe living in society. Clash of these two components law is being compared under different regulations. The work is based on the decomposition of laws in force in the Czech Republic and subsequent research by municipal police Karlovy Vary region.
Marketing communication and legal protection of personality. Conflicts, solutions, sanctions, rectification.

The diploma thesis deals with the standard marketing communication and its possible effects on humans. The issue is analysed from a legal point of view and it treats with the recent problems affected by increasing level of technological development. The thesis is divided into two parts, covering part theoretical and part practical. The theoretical part primarily focuses on the individual terminology of the marketing and the marketing communication, continues with the issue of protection of the personality, and also defines the question of both aspects in the context. The thesis comprehensively analyses the regulation of the protection of the personality, the regulation of the marketing environment, as well as focus on the concept and regulation of the media, as major media. From the media view is the thesis derived from two fundamental human rights, which in practice very often come to a mutual dispute. The elaboration of the legislation is supported by the case law. The practical part of the thesis is focused on actual cases, which Czech and foreign courts deal with in particular themes. Sub-part of the thesis deals with the questionnaires investigation, in order to analyse opinions of the public in that matter. In the final part of the thesis are all received knowledge evaluated and applied to a specified hypothesis.
