Big Data and Personal Data Protection in the Age of Surveillance Capitalism

The diploma thesis deals with the topic of personal data protection in the age of surveillance capitalism, relying on the General Data Protection Regulation or GDPR. It presents, first of all, what can be imagined by the term Big Data, since the protection of personal data consists in the constant collection of all data, among which there are personal data. In the context of this issue, the various risks of data collection and processing will be discussed. Then, attention is given to surveillance capitalism, i.e. not only the definition, but also what it consists of and what pitfalls come with it. Above all, this paper seeks to answer the question of what role the GDPR currently plays in relation to data protection, i.e. whether it is successful or not, which of course cannot be done without a more detailed analysis of this legal document. To this end, the thesis will focus on selected examples from practice that should help to answer the question posed. Autonomous Vehicles Liability Insurance Abstract The diploma thesis is focused on the issue of autonomous vehicles and its liability insurance as it is a very current topic, as evidenced by extensive discussions across the professional and lay public. The aim of this thesis is to analyse the currently existing legal framework at national, EU and international level and to clarify whether the current legal framework is sufficient for the operation of autonomous vehicles. The liability insurance system itself and the principles of its operation are also analysed with regard to their suitability for autonomous transportation. Where deficiencies are identified, de lege ferenda considerations are outlined, and expected changes as well as appropriate solutions are identified. In addition, the diploma thesis provides a meaningful introduction to the principles of autonomous vehicles and discusses other areas closely related to liability insurance for damage caused by the operation of autonomous vehicles. CCTV systems in the workplace Abstract This thesis focuses on the topic of CCTV systems in the workplace, both from the perspective of Czech labour laws and the european General Data Protection Regulation. The thesis focuses on the analysis of individual legal sources and presents an overview of the legal obligations and criteria that the employer is obliged to fulfil in order to install and use CCTV systems in the workplace. The thesis is divided into four thematic parts. In the first part of the thesis, space is devoted to the definition of the term "CCTV system" and the division of CCTV systems into types according to criteria relevant to the legal regulation of personal data protection. Subsequently, with emphasis on the development of the opinion of the Personal Data Protection Office, it is examined whether the defined types of CCTV systems fall within the scope of the GDPR. This section also defines the concept of 'dummy' cameras. Brno: Mendel University in Brno, 2023 The bachelor thesis is focused on the topic of protection of personal data and privacy of employees in the practise of the business organization. The literature research includes basic terminology of this topic, law requirements in the Slovak republic, the competence of the Office for personal data protection and consequences in case of not following the law. The original part analyses processing and protection of personal data and privacy of the employees. These activities begin in the process of recruiting the employees, then during the employment relationship and after termination of employment. The own research is devoted to both physical protection and legal requirements that have been mentioned in the literature research. In case of some deficiencies in the business organizations, there will be created propositions to ensure the compliance with the legislation of the Slovak Republic.

Genetic Databases and Protection of Genetic Data Abstract This thesis deals with the processing of genetic data obtained by DNA sequencing. The data obtained from the human genome represents a revolutionary basis for scientific research and open the way for the treatment of some so far incurable diseases such as cancer, AIDS, and Alzheimer's disease. The thesis primarily focuses on the legal regulation of the protection of genetic data. The thesis describes the processing of genetic data, including its use and dissemination, mainly through providers of genetic databases and genome browsers for scientific research purposes. From the perspective of the current legal framework in the Czech Republic and the European Union, the thesis analyzes the existing level of protection of genetic data and points out evident shortcomings. However, the thesis is not limited to a description of legal regulations but thoroughly evaluates the issue de lege ferenda. Protection of personal data in the decision-making practice of the Office for Personal Data Protection Abstract This work is devoted to the right to personal data protection, which is constitutionally protected in the Czech Republic. According to Article 10, paragraph 3 of the Charter of Fundamental Rights and Freedoms, which is part of the constitutional order of the Czech Republic, "Everyone has the right to protection against unauthorized collection, disclosure or other misuse of personal data". The right to personal data protection responds flexibly to global socio-technological developments, which reflects not only the European regulation of the right to personal data protection, but also the case law of European courts and the decision-making practice of individual European data protection authorities. Legal aspects of online behavioural advertising

In 2022, the AdTech industry is on the verge of a significant makeover. In addition to technological changes caused by the phasing out of third-party cookies, real-time bidding systems used for online behavioural advertising (OBA) are subject to fierce criticism by privacy advocacy groups. Moreover, the concerns about privacy deficits in advertising ecosystems are starting to translate into regulatory attention. In February 2022, the Belgian data protection authority sanctioned IAB Europe - the ambassador of one of the largest real-time bidding ecosystems in Europe - for failure to ensure lawful data processing. Considering the recent developments, this paper aims to ascertain how online behavioural advertising is governed by current privacy laws and verify whether the prescribed legal requirements are observed in practice. Before assessing its legal aspects, it was first necessary to examine online advertising from a technological perspective. The Role of Privacy in Forming the European Union's Normative Power through Regulation

The question of privacy has long been an integral part of the debate on human rights and fundamental values, which national governments should ensure. The rapid technological development of last decades brought the topic of privacy protection even more to display mainly because of the rising digital economy and new challenges that are connect with it. This thesis discusses the role of privacy, as a fundamental right, in forming the European Union's role as a global power, specifically, the thesis builds on two theories: The Normative Power Europe and The Brussels Effect. Digital economy of the European Union has been growing exponentially over the last two decades. Given the increased importance of the digital economy since the 1990s the European Union started to gradually implement laws to regulate the flow of the personal data online. These new regulations often had influence on global markets and big tech companies operating on the European single market but residing outside of Europe. Apart from analyzing the development of the European data protection laws, and the role that was played by the European Courts in forming the European global power, the thesis overviews the debate surrounding the incentives to introduce new regulations to protect the right private life of European citizens.
