The Europeanisation of Asylum law

The Europeanisation of Asylum law Abstract The content of this thesis focuses on the development of the European Union asylum policy, as the youngest but fastest developing EU policy. As the field of asylum law is highly influenced by the incorporation of EU legislation into the national legal orders of the Member States, this legal area can be described as strongly Europeanised. This thesis aims to document the process of Europeanisation of asylum law through the construction of a regional subsystem of refugee protection in the European area, called the Common European Asylum System, or CEAS for short. The thesis is divided into an introduction, seven chapters and a conclusion. The first chapter explains the basic concepts with which the thesis works, as well as emphasizes the necessity to consider the field of asylum law through the prism of three layers which mutually influence and complement each other. These layers are of the international, EU and national law. For this reason, the most important international legal pillars supporting the EU asylum acquis are mentioned. Europeanization of the non-profit sector in the Czech Republic: NGOs dealing with the integration of children from institutional care

In the international arena, European integration and globalization are becoming increasingly significant trends to which the Czech Republic must adapt by creating new international and supranational institutional and organizational structures. The Czech Republic's accession to the European Union and the process of Europeanization have opened up new opportunities and challenges for NGOs, which play a significant role in the participation of civil society in the European space. However, although Europeanization puts pressure on the political systems of EU member states, it is still unclear whether there is convergence between the member states, as empirical studies suggest that domestic changes tend to use alternative mechanisms. This diplomathesis deals with the impact of Europeanization on non-govermental organizations (NGOs) focused on integrating children from institutional care into society. The thesis explores the challenges and opportunities that arise with European integration for these actors and seeks to determine whether accessing EU funds provides sufficient motivation for the examined NPOs to Europeanize. Europeanization of Criminal Law Abstract The topic of this diploma thesis is europeanization of criminal law. It can be described as a process of approximation of criminal legislation of european countries. This process typically gets set in motion by organizations in which european countries associate. Said organizations use europeanization as one of the tools for achieving their goals. The goal of the thesis is to analyze how the process of europeanization of criminal law developed so far and to examine the tools which the organizations use in order to approximate the legislation of their member states. At the same time it also aims to point out some practical challenges which arise both generally in the organizations themselves and specifically as part of the application of selected tools. The first chapter is concerned with the tools the most important European organizations, the Council of Europe and the European Union, use to approximate their member states' criminal law legislation in general. It provides a brief look into their history and into the changes of the tools used throughout it. Comparison of Europeanization in the field of justice and interior in Moldova and Ukraine

This diploma thesis examines the theoretical concept of Europeanization in the context of the Russian invasion of Ukraine on 24 February 2022. The ambition of this thesis is to compare the relative levels of Europeanisation in the field of justice and home affairs in Moldova and Ukraine and then place it in the context of the Russian aggression. The aim of this thesis is to determine whether both countries were sufficiently Europeanised prior to receiving candidate status, or whether this EU move was solely a reaction to Russian aggression. Europeanisation theory was chosen because it examines a process that is crucial for EU accession. In this case, it was defined as the degree of approximation of national legislations to the EU acquis in the field of justice and home affairs. The integration process is a natural response of states to external threats, but also an opportunity for economic integration and shared prosperity. The Lidice Case and Memory Politics in the Czech Republic

This diploma thesis deals with the issue of mobilization of political memory connected with the degree of collaboration in the Czechia with Nazi Germany. I put the whole case in the broader context of dealing with the Holocaust in post-communist countries. I analyzed the process and consequences of the mobilization of political memory on the specific case of the Lidice. I examined in more detail the concrete effects of a wrong and inaccurate alignment with the historical past on the current political scene and the public in the Czech Republic. Europeanization of the Czech Foreign policy and the impact of the Presidency in the Council of the EU: The case of the Israeli-Palestinian conflict

This diploma thesis applies the theoretical concept of Europeanization on a research of the Czech foreign policy and its changes in relation to the presidency of the EU Council. As a case study, it analyses different Czech and EU's positions towards the Israeli-Palestinian conflict and then by comparison of both levels it determines the misfit between Czech and the EU's policies in the mentioned agenda. From historical point of view and from contemporary perspective as well, the Czech Republic is famous for very pro-Israeli attitudes. On the other hand, the EU is significantly focused on supporting of the Palestinians and building the Palestinian state. The research is divided into three periods: before the Czech Presidency of the EU in the years 2004-2008, during the Czech Presidency and then after the presidency until the end of 2010. The aim of the research is to evaluate changes of the misfit between the Czech domestic attitudes and the EU's positions by the example of the Israeli-Palestinian conflict's issues and then to find out whether the Czech foreign policy has been europeanized during the studied period. The Legal Nature of the Schengen Acquis

The Legal Nature of the Schengen Acquis Mgr. Robert Solich Abstract The thesis deals with general legal aspects of the Schengen acquis which represents a set of rules relating to the lifting of the border control at internal borders of the states concerned. It especially focuses on internal structure of the Schengen acquis, at its legal effect and legal forms with their mutual relations during particular phases of the development of the Schengen acquis. The author describes in detail the process of europeisation of the Schengen acquis, which was originally created as a legal subsystem of international law based on the "Schengen agreements" and later integrated into the framework of EU on the basis of the Treaty of Amsterdam. The author elaborates the question of legal effects of the acquis integrated in the EU and its co-existence with newly adopted Community or Union Schengen acquis. Within the analysis, the changes stemming from the Treaty of Lisbon are taken into account as well. The thesis further deals with territorial scope of the Schengen acquis and the EU case-law relating to the acquis in question.
Bilingual schools and European projects

The theme of this dissertation thesis is the relation of bilingual education and educational projects aimed at European issues. The research part was conducted at bilingual upper secondary schools in the Czech Republic, Germany and Great Britain (Wales). In the thesis the themes such as European politics, intercultural dialogue, international peace, human rights, humanitarian aid and language education are primarily included into European issues. The empirical research was deliberately realized at bilingual schools, where the instruction is delivered throught the medium of two languages. With regard to this fact a frequent participation at educational projects with European focus (European projects) was anticipated at these schools. European projects are often interconnected with the laguage studies. In recent years education projects have been an important part of the curriculum in Czech, German and British environment and they play a vital role in education context. The projects enrich the bilingual instruction from both methodical and content perspective and enable launching cooperation between schools and other partner institutions. The Socialization of the management of SK Slavia Praha after playing UEFA Champions Leauge

1 This MA thesis starts to explore a new exciting part of socialization theory, by applying the research into socialization in the management of the Czech football club SK Slavia Praha. This is done trough the evaluation of the end of the year 2007, when SK Slavia Praha for the first and last time played the group stage of UEFA Champions League. This MA thesis tries to prove that there was indeed a transfer of norms and values from UEFA to SK Slavia Praha. Next to this, this MA thesis also tries to prove that the previous socialization is not anymore apparent in the club, since the contacts with UEFA (and ECA) have since then lost because of the lack of international matches played by SK Slavia Praha. This research is done through interviews with the employees of the club, both the ones working in the club in 2007, and the ones who are employed in 2014. Europeanization of substantive criminal law Petra Meinlová This master thesis is focused on the development of police and judicial cooperation in criminal matters in the European Union and the Europeanization of particular crimes. The thesis is composed of four chapters. The introductory chapter defines basic terminology, the European Union with its powers, the European law and the main legal instruments with the effect on criminal law, and finally the part investigating the idea of Europeanization of criminal law. Chapter two focuses on the definitions of police and judicial cooperation in criminal matters. The cooperation in criminal matters is very problematic in relation to the state sovereignty, second part of the chapter outlines the main features of this relation. Chapter three describes the evolutionary process through which the European Union has acquired the competence over criminal law affairs. The cooperation in criminal matters is relatively new field of the European integration. The original purpose of the European integration was the economic cooperation with the target of creation the common market, the founding Treaties of European Community did not refer to the criminal law.
