Decrees of the President of the Republic - constitutional and international contexts

- anglický jazyk In my thesis I deal with presidential decrees in constitutional and international context. It consists of 5 parts. There are preconditions for the emergence of decrees in the first part. This international-legal recognition of the Czechoslovak government in exile, the theory of legal and political continuity of Czechoslovakia, uninterrupted presidency of dr.Beneš and the withdrawal of the Munich Agreement. The second part talks about the concept of issuing decrees. In the third part is the most important content of constitutional decrees. The fourth section deals specifically about formal-legal, material-legal and political continuity. In the last part I deal with today's issue of the validity of the decrees and decrees of the Czech Republic by accession to the European Union. Government in exile was recognized by Great Britain in 1940. It was very important because it could arise decrees. It arranged the constitutional decree Nr. 2/1940 official bulletin of Czechoslovakia, which established the emergence of decrees. Decrees of the President of the Republic published a proposal to the government. The State Council worked on decrees since 1942, received as an advisory vote. Confiscation and the Allotment Procedure pursuant to Presidential Decrees in Czech Case Law

This thesis deals with the reflection of confiscation and the allotment procedure pursuant to presidential decrees in Czech case law. In numerous cases, the allotment procedure has still not been completed or persistent problems arise from it in the area of legal relations to immovables and their registration up to the present day. The thesis analyses and categorises relevant statutory and case law based upon the material criterion. The result is a set of clearly defined thematic groups of the most significant judgements covering the individual problems identified and an analysis of the stability of the case law or the lack thereof in the individual thematic groups particularly in relation to the principle of legal safeguard which - as this thesis argues - gradually becomes more and more important in relevant Czech case law.
Personnel "Purge" at Central Authorities in Czechoslovak Republic after 1945

This diploma thesis attends to personnel "purge" in the field of public administration in Czechoslovakia after World War II in a broader context. "The purge" of civil servants is presented in the context of the overall development of the Czechoslovak Republic in the period 1945 -1948 and with the general requests of the postwar "purge". The attention is paid to the status of civil servants, particularly in the Protectorate of Bohemia and Moravia and in the postwar period. The next part of this thesis is focused on the activity of the purgatory commissions, which operated on the basis of the Decree of the President. In the selected ministries is performed the analysis and the comparison of the model cases of "purge" of the civil servants.

RESUMÉ OF THE RIGOROUS THESIS DECREES OF THE PRESIDENT OF THE REPUBLIC IN RELATION TO DEPORTATION OF SUDETEN GERMANS FROM PLZEN AND KLATOVY AREA This Rigorous Thesis is focused on the Decrees of the President Edvard Beneš (more commonly known as the Beneš decretes) issued in 1945 in relation to the deportation of Sudeten Germans, especially Germans living in Plzen, Klatovy and surrounding areas. This Thesis briefly describes the history of Czech-German relationships from the eldest times till the middle of the twentieth century, further then the legal form of the citizenship from 1945 and historical events which in their result led to deportation of German Citizens from Czechoslovakia. It is followed by description of establishment and activity of Czechoslovakian exile government in London during the Second World War and origination of Decrees of the President of the Republic same as development of opinions to the solution of Czech-German coexistence of Czechoslovakian politicians and resistance organizations during the Second World War. The Thesis also mentions the contents of the Constitutional Decree No.33/1945 on Modification of Czechoslovak Citizenship of persons of German and Hungarian ethnicity and several Decrees relating to legal status of Sudeten Germans. Presidential decrees 1940-1945 and their influence on Czechoslavakia-German relations

The bachelor thesis deals with the presidential decrees of the 1940-1945. It analyses the context of the creation of these documents and then observes decrees, which influenced german (hungarian) minorities and then their future lives. The resting parts are based on the comparison of the Czech- German international relations and presidential decrees, where the influence of the decrees on the formation between the Czech republic (or Czechoslovakia) and Germany is observed.
