Termination of travel contract due to force majeure

The subject of the thesis is the termination of travel contract due to unavoidable and extraordinary circumstances. The term of unavoidable and extraordinary circumstance is not legally defined in the Czech Civil Code. Therefore, the thesis analyses this concept in the light of the case law of several European countries and compares the term substantively with the liberation ground under art. 2913 par. 2 of the Civil Code. In the following sections, the thesis discusses the meaning of unavoidable and extraordinary circumstances for the right of the contracting parties to withdraw from the travel contract free of charge, defining the various conditions under which the right can be exercised. The thesis also covers the meaning of unavoidable and extraordinary circumstances for the subsequent impossibility of performance.
Travel contract under Czech and German Law

The main part of this thesis is divided into two chapters. The first chapter, entitled Chapter 2, presents the background of the current legal regulation and explains why it has become necessary to codify these rules. The second of the two chapters, entitled Chapter 3, comprehensively deals with the travel contract itself
Claim from the incrorect fulfilment of the tour conract

The diploma thesis is focused on the claim from the incorrect fulfilment of the tour contract, which represents a part of the legal regulations of a tour. Considering significant development of travelling, this topic is very actual and issues that arise during implementing the legislation in practice need to be answered. The goal of my thesis is answer questions which are actual and often appearing in practice, but it does not exist clear legal opinion or sufficient resources to answer to these questions. The main resources for the writing of my thesis was the current text of the Civil Code, the Tourism Act, the Consumer Protection Act and Directive 90/314 / EEC, which were compared with the new Directive 2015/2302 and the proposed regulations of the Civil Code. The diploma thesis consists of six chapters, including the introduction and the conclusion. The basic direction of the thesis is presented in the introduction same as questions. The main goal is answer to these questions. The content of the second chapter is the definition of the tour contract through several legal regulations, the definition of contracting parties and the related representation of their rights and obligations. Travel contracts according to the new Civil Code

The topic of this thesis is: Travel contracts according to the new Civil Code. The thesis consists of two parts - theoretical and practical. The theoretical part deals with the basic terms related to the tourism and it describes the consumer protection legislation in both the Czech Republic and the European Union. In the practical part, there is an analysis of some travel contracts (including the terms of a contract) of tour operators and travel agencies located in České Budějovice. This part also analyses the results which were obtained from the questionnaires intended for the customers of tour operators or travel agencies and for the tour operators and travel agencies.
Consumer protection in a travel agency

This work deals with consumer protection within travel agencies. A part of the work is a literary research of the current situation of the CK and CA market, an analysis of selected travel agencies, and a questionnaire survey, which aimed to determine how aware consumers are of their rights when purchasing a trip. Consumer protection is still a relevant topic that is necessary to pay attention to.

Bachelor thesis is aimed at the travel agency AXIA, concretely at its functions, activity, sevices, offer, competition (the travel agency Slan Tour, the travel agency Kellner and the travel agency Mayer&Crocus) and last but not least at its promotion. The first part is theoretical, where all the basic and important terms are defined. While the second part is based on the practical aspect and the most important subject of this part is a supply analysis of the tours and packages of the travel agency AXIA. This chapter includes also transport services analysis, accommodation facility analysis, food service analysis and the ways of supply promotion. At the end this bachelor thesis evaluates the travel agency AXIA and its current supply in term of SWOT analysis and checklists.
The protection of consumer in tourism

The thesis is focused on protecting consumers and tour operators and travel agencies. The basic aim is to analyze consumer awareness of their rights and obligations arising from the travel contract and general terms and conditions. A sub-goal is to determine the perception of ITQ Code (International Travel Quality), both by consumer and by the tour operator. For the analysis was selected questionnaire survey. The results of the investigation pointed to the fact that consumers are not satisfied with the failure of contractual obligations and are determined to pursue their legal rights. On the other hand, many do not read or terms and conditions. Questions focused on the ITQ Code, which specifies exactly complaints procedure and compensation system, revealed that consumers would welcome such a product and it take into account the selection of a tour operator, but more than half of this Code, still heard.
