Legal regulation of ex situ biodiversity conservation Abstract This thesis focuses on the legal regulation of biodiversity conservation at international, European and mainly national level, in relation to ex situ conservation. The aim of the thesis is to introduce and provide an overview of the legal regulation of biodiversity conservation with a focus on ex situ protection of species of animals and plants. The secondary objectives of the thesis are de lege ferenda considerations in response to the identified shortcomings of the legal regulation in the Czech Republic, together with a comparison of selected provisions of the Slovak and Czech legal system. Overall, the thesis is intended to encourage reflection on the importance of biodiversity conservation and to focus attention on programmes, facilities and other methods of addressing ex situ protection. The thesis is divided into four parts. The first part deals with basic concepts such as biodiversity and its levels, or a more detailed definition of in situ and ex situ conservation. 1 Legal aspects of pet animals breeding Abstract and key words The subject of this diploma thesis is the issue of pet animals, especially dogs and cats. The diploma thesis focuses on the development of legislation concerning these animals and the obligations of breeders. In terms of content, the work is divided into six chapters. The first chapter defines the principles applied in animal protection law and the basic concepts of this work, which are animals, pets, breeders, breeding and pedigree. The second chapter provides a brief overview of the instruments used in environmental protection, with an emphasis on animal protection. The third chapter deals with the responsibilities of the breeder, where the civil, administrative and criminal liability is discussed in more detail. The chapter examines all statutory obligations whether they applied equally to dogs and cats breeders. The subchapter on criminal liability also contains a comparison of previous and current legislation. The fourth chapter presents the bodies operating in the field of animal protection and their competencies. The fifth chapter mentions the function of shelters and the process of adoption of the animal, including the solution of the legal relationship with the original owner of the animal. The aim of this thesis is to summarize legal regulation of animal welfare in relation to the Czech Republic and to highlight its potential shortcomings and possible amendments de lege ferenda. Today, humans wield almost unlimited power over living conditions in which animals around the world live in, and so more and more attention is paid to the legal regulation of this area of law. This thesis, which is divided into three main parts, also pays attention to it. The first part contains the analysis of the concept of "animal welfare" and compares it to the concept of "animal protection". It also deals with a brief history of animal welfare and various ways of determination of its level. The second part describes and summarizes legal regulation of welfare, whereas the author proceeds from the international law through European law to national law. With the international law, the biggest emphasis is on the conventions signed under the Council of Europe, while with the European law, the thesis deals first with the primary law and then with the specific acts of secondary law. Legal Aspects of Protection of Animals against Cruelty Abstract The diploma thesis provides a comprehensive overview of the current legislation on the protection of animals against cruelty at the international, European and national level. The treatise is divided into an introduction, four chapters and a conclusion summarizing the findings. The first introductory chapter is divided into three sub-chapters and is devoted to the concept of animal rights itself, including the definition of the elementary terms "animal protection against cruelty" and "animal welfare", then ethical, especially religious and philosophical starting points for legislative protection of animals against cruelty, and finally briefly summarizes the historical relationship between humans and animals. The second chapter discusses the transnational regulation of the legal protection of animals against cruelty. Its first sub-chapter is devoted to international agreements, and primarily to European agreements adopted under the authority of the Council of Europe. The second sub-chapter summarizes the legislation of the European Union adopted in the field of animal protection, including historical excursus and current regulation. The issue of cruelty and other inappropriate treatment of animals and their protection through criminal law This thesis is focused on the protection of animals against cruelty and other inappropriate treatment, and its securing through criminal law within the legal order of the Czech Republic. The aim of this work was to evaluate the current level of legislation concerning animal cruelty in the sense that it is possible, especially in criminal law, but also in administrative law, to effectively detect, sanction and prevent its recurrence in the future. The aim of this thesis was also to evaluate the changes in the protection of animals against cruelty, which occurred with the adoption of Act no. 114/2020 Coll., amending Act no. 40/2009 Coll., Penal Code, as amended, and some other laws. 1 Abstract This Master's thesis entitled Legislation on treating animals in human care compares Czech and Australian legislation in selected aspects of three categories of animals in human care - farm animals, companion animals and animals used for scientific and other research purposes. The thesis is composed of 5 main chapters. The first chapter describes sources of law regarding treating animals in human care from the perspectives of international law, European Union law, federal Czech law and Australian law. The second chapter explains basic terms - an animal and its legal status and animal in human care in Czech and Australian legislation. The third chapter focuses specifically on farm animals as a category of animals in human care as it is detailed in Czech and Australian legislation. The fourth chapter deals with companion animals in both countries' legislation. Legal regulation of treating animals in human care

This diploma thesis deals with legal regulation of the treatment of animals under human care. It provides a comprehensive overview of international legislation, European legislation and also Czech laws. On the international level it describes fundamental conventions of the Council of Europe. On the level of European Union this thesis does not omit primary law of the European Union, secondary legislation as well as conceptual tools. On the national level it tries to outline the key regulations governing the treatment of animals. Next it deals with definition of an animal, creature and wildlife, and categorizations of animals. It also also includes a civil nature of the animal. The major Czech law governing the main ways of dealing with animals in captivity this thesis describes the act no. 246/1992 Coll., On Protection of Animals against Cruelty. After defining possible ways of the treatment it does not forget to acquaint with the possible torts for breach of the requirements for the protection of animals, including act no. 40/2009 Coll., The Criminal Code. In conclusion, it briefly describes the status of bodies whose activities relate to the protection of animals.
Civil initiative in the field of animal reproduction

This Diploma Thesis focuses on the issue of reproduction of animals and the non- profit organisations and subjects working in this field. The cat and dog reproduction is a primary cause of their overpopulation in the Czech Republic which becomes an ever- increasing issue as the abandoned animal shelter network fails to provide enough capacity for local demand. The thesis is focused on the activities of such organisations and tools they use for mobilising the necessary resources as well as the issue of animal reproduction itself. The theory basis is in the general theory of resource mobilisation supported with the explanation of the civil initiatives dedicated to this phenomenon as well as the overview of the phenomenon of the animal reproduction as well. The thesis is composed of five qualitative interviews with organisations or movements that are dedicated to effective reduction of animal reproduction. The empiric part of the thesis presents selected organisations and then analyses the collected data. The financial and human resources are mostly utilised by organisations which physically treat animals and the majority of the funds is consumed by providing care for them. The diploma thesis deals with the legal regulation of the treatment with wild animals. It compares different terms used in legal regulation of protection of animals. It specified differences between concept of an animal in private law and public law. The diploma thesis is focused on possibilities of gaining ownership to the wild animals, proving origin of animals bred in human care. It concerns with legal regulation of treatment with handicap animals. The diploma thesis analyzes preparation and realization of Action and Management Plans and is also concerned about protection of wild animals against cruelty.
