Problematika týrání a jiného nevhodného zacházení se zvířaty a jejich ochrana prostředky trestního práva Tato diplomová práce je zaměřena na ochranu zvířat pro týrání a jinému nevhodnému zacházení, a její zajišťování prostředky trestního práva v rámci právního řádu České republiky. Cílem této práce bylo zhodnotit aktuální úroveň právní úpravy týkající se týrání zvířat v tom smyslu, zdali je, především v rámci trestního práva, ale i v rámci práva správního, možné takové nežádoucí jednání efektivně odhalit, sankcionovat a zamezit jeho opakování v budoucnu. Dalším z hlavních cílů pak bylo zhodnocení změn v oblasti ochrany zvířat proti týrání, ke kterým došlo přijetím zákona č. 114/2020 Sb., kterým se mění zákon č. 40/2009 Sb., trestní zákoník, ve znění pozdějších předpisů, a některé další zákony. Obsah této diplomové práce tvoří celkem 10 kapitol, které jsou dále členěny na podkapitoly. Vymezení základních pojmů, nastínění vývoje, kterým si právní úprava týkající se ochrany a Welfare zvířat ve světě i v České republice prošla, a náhled do nadnárodní právní úpravy v oblasti ochrany zvířat, jak na mezinárodní úrovni, tak na úrovni Rady Evropy a Evropské Unie, je obsahem prvních čtyř, pro účely této práce podpůrných, kapitol. The issue of cruelty and other inappropriate treatment of animals and their protection through criminal law This thesis is focused on the protection of animals against cruelty and other inappropriate treatment, and its securing through criminal law within the legal order of the Czech Republic. The aim of this work was to evaluate the current level of legislation concerning animal cruelty in the sense that it is possible, especially in criminal law, but also in administrative law, to effectively detect, sanction and prevent its recurrence in the future. The aim of this thesis was also to evaluate the changes in the protection of animals against cruelty, which occurred with the adoption of Act no. 114/2020 Coll., amending Act no. 40/2009 Coll., Penal Code, as amended, and some other laws. The content of this thesis consists of a total of 10 chapters, which are further divided into subchapters.
