Cílem této diplomové práce je shrnout právní úpravu pohody zvířat (welfare) na území České republiky a upozornit na její případné nedostatky či možné změny de lege ferenda. Dnes mají lidé nad životními podmínkami, ve kterých žijí zvířata kolem nich, téměř neomezenou moc a stále více pozornosti je tak věnováno právní regulaci této oblasti. Věnuje se jí i tato práce, která je rozdělena do tří hlavních částí. V části první je analyzován samotný pojem pohody zvířat - welfare - a porovnán je s pojmem ochrany zvířat. Prostor je též věnován stručné historii welfare a různým způsobům zjišťování úrovně životní pohody zvířat. V části druhé je poté popsána a shrnuta právní úprava welfare, přičemž autorka postupuje od mezinárodní právní úpravy přes unijní až k národní. U mezinárodní právní úpravy je důraz kladen především na smlouvy přijaté v rámci Rady Evropy, v případě unijní úpravy se práce nejprve věnuje primárnímu právu a posléze specifickým právním předpisům práva sekundárního. Největší prostor je v této části věnován národní právní úpravě včetně stručného zmínění její historie. Důraz je zde kladen především na zákon č. 246/1992 Sb., na ochranu zvířat proti týrání, jakožto právní předpis, který se ochranou zvířat a jejich pohody v českém právu zabývá především, jsou však zmíněny i další české zákonné i... The aim of this thesis is to summarize legal regulation of animal welfare in relation to the Czech Republic and to highlight its potential shortcomings and possible amendments de lege ferenda. Today, humans wield almost unlimited power over living conditions in which animals around the world live in, and so more and more attention is paid to the legal regulation of this area of law. This thesis, which is divided into three main parts, also pays attention to it. The first part contains the analysis of the concept of "animal welfare" and compares it to the concept of "animal protection". It also deals with a brief history of animal welfare and various ways of determination of its level. The second part describes and summarizes legal regulation of welfare, whereas the author proceeds from the international law through European law to national law. With the international law, the biggest emphasis is on the conventions signed under the Council of Europe, while with the European law, the thesis deals first with the primary law and then with the specific acts of secondary law. The most of this part is devoted to the national legal regulation of welfare along with a brief summary of its history.
