Legal regulation of ex situ biodiversity conservation Abstract This thesis focuses on the legal regulation of biodiversity conservation at international, European and mainly national level, in relation to ex situ conservation. The aim of the thesis is to introduce and provide an overview of the legal regulation of biodiversity conservation with a focus on ex situ protection of species of animals and plants. The secondary objectives of the thesis are de lege ferenda considerations in response to the identified shortcomings of the legal regulation in the Czech Republic, together with a comparison of selected provisions of the Slovak and Czech legal system. Overall, the thesis is intended to encourage reflection on the importance of biodiversity conservation and to focus attention on programmes, facilities and other methods of addressing ex situ protection. The thesis is divided into four parts. The first part deals with basic concepts such as biodiversity and its levels, or a more detailed definition of in situ and ex situ conservation. 1 Legal aspects of pet animals breeding Abstract and key words The subject of this diploma thesis is the issue of pet animals, especially dogs and cats. The diploma thesis focuses on the development of legislation concerning these animals and the obligations of breeders. In terms of content, the work is divided into six chapters. The first chapter defines the principles applied in animal protection law and the basic concepts of this work, which are animals, pets, breeders, breeding and pedigree. The second chapter provides a brief overview of the instruments used in environmental protection, with an emphasis on animal protection. The third chapter deals with the responsibilities of the breeder, where the civil, administrative and criminal liability is discussed in more detail. The chapter examines all statutory obligations whether they applied equally to dogs and cats breeders. The subchapter on criminal liability also contains a comparison of previous and current legislation. The fourth chapter presents the bodies operating in the field of animal protection and their competencies. The fifth chapter mentions the function of shelters and the process of adoption of the animal, including the solution of the legal relationship with the original owner of the animal. Legal regulation of animal welfare

The aim of this thesis is to summarize legal regulation of animal welfare in relation to the Czech Republic and to highlight its potential shortcomings and possible amendments de lege ferenda. Today, humans wield almost unlimited power over living conditions in which animals around the world live in, and so more and more attention is paid to the legal regulation of this area of law. This thesis, which is divided into three main parts, also pays attention to it. The first part contains the analysis of the concept of "animal welfare" and compares it to the concept of "animal protection". It also deals with a brief history of animal welfare and various ways of determination of its level. The second part describes and summarizes legal regulation of welfare, whereas the author proceeds from the international law through European law to national law. With the international law, the biggest emphasis is on the conventions signed under the Council of Europe, while with the European law, the thesis deals first with the primary law and then with the specific acts of secondary law. The issue of cruelty and other inappropriate treatment of animals and their protection through criminal law This thesis is focused on the protection of animals against cruelty and other inappropriate treatment, and its securing through criminal law within the legal order of the Czech Republic. The aim of this work was to evaluate the current level of legislation concerning animal cruelty in the sense that it is possible, especially in criminal law, but also in administrative law, to effectively detect, sanction and prevent its recurrence in the future. The aim of this thesis was also to evaluate the changes in the protection of animals against cruelty, which occurred with the adoption of Act no. 114/2020 Coll., amending Act no. 40/2009 Coll., Penal Code, as amended, and some other laws. 1 Abstract This Master's thesis entitled Legislation on treating animals in human care compares Czech and Australian legislation in selected aspects of three categories of animals in human care - farm animals, companion animals and animals used for scientific and other research purposes. The thesis is composed of 5 main chapters. The first chapter describes sources of law regarding treating animals in human care from the perspectives of international law, European Union law, federal Czech law and Australian law. The second chapter explains basic terms - an animal and its legal status and animal in human care in Czech and Australian legislation. The third chapter focuses specifically on farm animals as a category of animals in human care as it is detailed in Czech and Australian legislation. The fourth chapter deals with companion animals in both countries' legislation. Civil initiative in the field of animal reproduction

This Diploma Thesis focuses on the issue of reproduction of animals and the non- profit organisations and subjects working in this field. The cat and dog reproduction is a primary cause of their overpopulation in the Czech Republic which becomes an ever- increasing issue as the abandoned animal shelter network fails to provide enough capacity for local demand. The thesis is focused on the activities of such organisations and tools they use for mobilising the necessary resources as well as the issue of animal reproduction itself. The theory basis is in the general theory of resource mobilisation supported with the explanation of the civil initiatives dedicated to this phenomenon as well as the overview of the phenomenon of the animal reproduction as well. The thesis is composed of five qualitative interviews with organisations or movements that are dedicated to effective reduction of animal reproduction. The empiric part of the thesis presents selected organisations and then analyses the collected data. The financial and human resources are mostly utilised by organisations which physically treat animals and the majority of the funds is consumed by providing care for them. On the other hand, organisations dedicated to enlightenment and education are able to function as self-funded and self-organised...

Criminal law protection of animals against cruelty and other inappropriate treatment Abstract This diploma thesis deals with animal protection in the Czech Republic from perspective of criminal law as a legal instrument ultima ratio. Primary goal of this thesis is to analyse legal regulation in Act no. 40/2009 Coll., Penal Code, de lege lata and evaluate possibilities de lege ferenda. Within current legal regulation this thesis works with articles 302, 302a and 303 of Penal Code and the current legal regulation is compared with the previous one. Particural attention is dedicated to Act no. 114/2020 Coll., which established entirely new crime into the Czech legal system called Breeding Animals in Iappropriate Conditions and widened the listing of penalties stated in article 52 of Penal Code by penalty of prohibition of keeping and breeding animals. Particular novelties are analysed in detail and the thesis also responds to the most frequent arguments in favour and against passing the new legal regulation. Law legislation of breeding wild animals in captivity Abstract The aim of this diploma is to summarize and analyze the fragmented legislation concerning the breeding of wild animals in captivity, both in terms of national and EU legislation. However, given the limiting length of work, the EU legislation is not interpreted in detail, but outlines the most important sources concerning wild animals and their transposition into national law. The opening part contains an explanation of basic concepts, which this work couldn't do without, including introduction with key laws and the definition of cruelty and killing of animals in the light of the law on the protection of animals against cruelty. The second chapter is devoted to wild animals from the point of view of different legislation in relation to other animal species, especially in the area of capture and killing bans and regulation of some activities with them. Diploma thesis - Legal regulation of protection of farm animals against cruelty This diploma thesis on Legal regulation of protection of farm animals against cruelty divides into five chapters (excluding the introduction and conclusion). The first chapter explains the relevant terminology. The second chapter concentrates on history of animal rights and philosophical aspects of these rights as well as on animals as subjects of law. The following chapters focus on applicable relevant legislation. The third chapter deals with international animal welfare agreements and relevant EU legislation. The fourth, most important, chapter summarizes the legislation on the protection of farm animals against maltreatment in the legal order of the Czech Republic. This chapter gradually focuses on both public and private law. Finally, the fifth chapter brings a comparison of the domestic legislation on the protection of farm animals against cruelty with the legislation of the Hellenic Republic.
