Radislav Krstić: the procedural conduct of the criminal proceedings before the ICTY

The Bachelor's thesis Radislav Krstić: the procedural progress of a criminal proceeding before ICTY is a case study analysing the fulfilment of the right to just trial in the Krstić case. The analysed subject was chosen for its close connection to the consolidation of the western Balkan countries, in which the Tribunal had become involved, that is mainly in pursuance of development of democratic institutions and judicial reforms. The ICTY's opportunity of consolidation originated from the Tribunal's judicial praxis, which had had to be convincing and just enough to have confirmed the leaders of these countries that the returned verdicts were in their interest as well. This way the Tribunal gained the credibility needed, and the countries of former Yugoslavia let it intervene with their internal affairs. Although a successful cooperation was established, the author asks himself whether the influence of mass media over the decision making of courts could have influenced trials before the International Criminal Tribunal for the former Yugoslavia. Therefore the thesis analyses the procedural progress with R. Krstić, who was the first one convicted of genocide, and received one of the three most severe sentences of that time. The intention of my thesis is to analyze "the image of Jana Nagyova on media scandal "Abuse of Military Intelligence"in the period of June 1st 2013 to December 31th 2013 and from May 11th 2015 to July 31st 2015. It is dependent on every single phase of that case and incorporating the large social effects as well. I focused on the semantic forms of the headlines printed by daily Blesk, Mlada fronta Dnes and Pravo. In this research, I decided to use a quantitative analysis based on the answering of the basic hypothesis. This hypothesis is called: it is possible to blamed Jana N. based just by these kinds of headlines, before getting the verdict in this cause? To be more specific: it is possible that all these headlines were prepared to affect the reader's perception of Jana N. including her judgment in the moral, the social or in criminal law ? I also tried to analyze if it could be possible to find the basic differences between the newspapers as it is so- called and the investigative journalism in general. My thesis is divided into two main parts. The first one is based on the theory and it contains a description of that cause and a short theoretical excursion. The phenomenon of serial killers on the example of the case of Svatoslav Štěpánek (1911-1938)

Murder and violence in general have always been, and unfortunately will probably always be, one of the great problems of humanity. From time immemorial, however, the most serious act of violence - murder - has been punished. The most perverted cases were punished by the so- called "eye for an eye" principle, i.e. by sentencing them to death. After the establishment of the First Czechoslovak Republic, it was discussed whether to continue to retain the death penalty as part of criminal law. The capital punishment remained enshrined in law until 1990. There were quite a few murderers punished in this way during the interwar period. The presented work focuses on the case of the sexual serial murderer Svatoslav Štěpánek (1911- 1938), who started his killing spree in 1928. His last victim was murdere in 1936, the year he was arrested. In a trial that took place from 12 to 17 May 1937 at the Regional Court in Litoměřice, he was found guilty of the murders of Bedřich Brožovský, Františka Třísková and Jiřinka Šťastná, and sentenced to death. The dispute over the unrealized marriage of Peter II. of Švamberk and Eliška of Žerotín

Annotation The goal this bachelor theses The dispute over the unrealized marriage of Peter II. of Švamberk and Eliška of Žerotín is to describe the events, that happened after Ludmila Žerotín of Kolovrat had married her daughter Eliška to Ladislav Berka of Dubé in 1604. Peter II. of Švamberk was interested in Eliška since her early age, and her mother betrothed her to him. Švamberk perceived the marriage of his betrothed Eliška as a public shame, which he decided to solve by a trial. The first part thesis deals with the universal development of the nobility in the Czech Kingdom, their marriage strategies, how much was a choice of the partner a strategic verdict and what aspects played relevant role. In the second part, the thesis watches the course of the dispute at the wider royal council, the involvement of the participated people on both sides and the arguments of the individual sides. The theses will attempt to interpret the dispute in a context of researches of the aristocratic honor and free religious clashes, because unlike the evangalist Petr II. of Švamberk, Ladislav Berka was convinced catholic.

Domestic Violence from the perspective of criminal law

v angličtině The first few chapters of the rigorous discuss the definition, types and theories of domestic violence. I explore potential gender-specific aspects of domestic violence, with a separate chapter devoted to victims of domestic violence. Building on the introductory chapters I proceed to analyze criminal offences related to domestic violence, including related verdicts. In the procedural area I focus in particular on custody, victims' property rights, and the payment of damages to the plaintiff. This section is closed off by a discussion of police and civil interventions in cases of domestic violence. The final part of the dissertation analyzes domestic violence in the context of international law, providing a comparison with the legal order of the Slovak Republic.
The Case of Law in the Field of Value Added Tax and its Impact on Legislation

Harmonization of tax systems of the European Union member states has been going on since 1950s. This trend is followed to this day in order to achieve one of the primary objectives of the European Union, single domestic market. The harmonization of tax systems allows free movement of capital, goods, and services. Value added tax is harmonized through the EU Directives that have unified tax object, tax base and partly tax rates. The Court of Justice of the European Union also plays a vital role in the harmonization, because the European case law complements the interpretation of the directives and creates a comprehensive impact throughout the harmonization. This thesis analyses the judgments of the Court of Justice of the European Union, which have been implemented in the VAT Act, and examines at the same time impact of the implementation. The first implementation took place in the amendment of the VAT Act in 2006. The biggest changes occurred in the amendment of the VAT Act in 2012 and it was mainly in the realm of the conditions for exemption from VAT without deduction and the possibility of claiming a deduction. Finally, time frame of the implementation was also researched, judging from the outcomes of the research, one can say that the Czech Republic responds quite flexibly to the publication of the European case of law and the implementation takes place shortly following verdict of The Court of Justice of the European Union.
