Personal data protection in labor relations

The author deals with issues of personal data processing in labor relations and the problems which arise in everyday practice. A substantial part of the work is about subjects which are processing personal data and their particular responsibilities. The author proceeds from relevant decisions and opinions of the supervisory body, the Office for Personal Data Protection. The thesis also analyzes particular personal data which are processed by the employer. In this context the author analyzes in detail the decision of the Supreme Administrative Court in connection with the issue of communicating of salaries and compensation of civil servants under the Act No. 106/1999 Coll. Freedom on Information, as amended. The author concluded that the current wording of Act No. 106/1999 Coll. can't be used to communicate the information on salary or remuneration of state employees. The last chapter is dedicated to possibilities of using modern means used to protect the rights and legitimate interests of employers, which process personal data of employees. In this regard, the author expresses opinion on the appropriateness of adopting special legislation that would regulate unequivocally the possibility to use these modern means in labor relations.

Personal Data Protection in Labour Law Relationships The thesis deals with personal data protection in relation to employees as a subject of data and an employer as a person processing such data. At the beginning, general issues of personal data protection are analysed, including a short overview of data protection regulations within both an international and domestic context. The introductory part also includes an explanation of terminology and a description of individual rights and obligations in the field of data protection. In the following part the author concentrates on the regulation of disposal of particular types of personal data that are processed in relation to creation, duration or termination of labour law relationships, and also on the relationship between the Act No. 101/2000 Coll., on Personal Data Protection, and the Labour Code, as well as other related legislation. Attention is devoted to the extent of personal data that the employer may request from candidates for a vacancy, as well as to the necessity of the employee's consent to the processing of their personal data by the employer. This thesis deals with problems of personal data protection at the schools which provide elementary education (elementary schools, practical elementary schools and special elementary schools) in region Ústí nad Labem. The thesis is divided into three parts: handover of pupils' personal data when they change the school, publication of pupils' work, photos and videorecordings during the school presentation, e.g. at the exhibitions, in school magazine or on the internet and using of camera systems at schools. The aim of this thesis is to find the optimal and the legal procedure and together with questionnaire survey compare it with real practice at the elementary schools in region of Ústí nad Labem. There were used recommendations, standpoints and interpretations of authorities (Ministry of Education, Regional council, Czech school inspection, Institution for personal data protection) in this thesis.

The theme of the dissertation is surveillance. Its aim is to answer the following question: up to what extend do we live in a society, which may be described as a surveillance society. For this purpose it defines, what is meant by surveillance, how surveillance evolved through history, which theories relevantly describe this phenomenon and in which spheres surveillance is notable. The dissertation introduces the main theories of the multi-disciplinary field of surveillance studies, which has been developing over the last twenty years. Special attention is focused on CCTV systems. At the same time, the thesis focuses on ethical problems of surveillance, i.e. privacy, discrimination, social exclusion, transparency and responsibility.

Protection of personal data in the course of rendering health care SUMMARY Medical treatment is based on trust. Patients coming to the medical facility often share details about their personal lives that could potentially embarrass or dishonour them and eventually discourage them from getting medical treatment at all. That is why patients seeking medical help need to know that those to whom they confide in are willing to keep the information private and discreet. This thesis will address the protection of personal data in the healthcare area and its main purpose is to provide complex analysis of the relevant legal framework, especially in the light of the recently passed legislation. Protection of personal data in the healthcare are is governed by two pieces of legislation - The Data Protection Act and The Healthcare Act. These statutes present main instruments by which the protection of patients' information is provided. The first part of the thesis examines the general principles of the data protection as they are outlined by the Data Protection Act. 1 Resumé Personal data protection in employment formation This thesis is concerned with the questions of personal data protection in connection with labor-law relationships. In the concrete the author focuses on personal data protection in formation of the employment. First the author deals with general legal basis of the issue and, consequently, the author analyses personal data protection in positive law, namely in the Act No. 101/2000 Coll., on the Protection of Personal Data, as amended. The author examines in detail some questionable duties of the employer connected with processing of personal data of his employees and, at the same time, refers to the imperfection of transposition of the Directive 95/46/ES of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of these data. On the basis of given comments the author in the general level presents the scope of personal data that can be requested by the employer from the employee in formation of the employment. This thesis analyzes selected issues of the hiring of employees. It is the connection between the uncodified branch of human resources and the labour law generally. This topic is close to everyone because every person sometimes finds himself during the life in the position of job applicant and chooses acceptable employment and also person is hiring by employers. It is neccessary to know rights and responsibilities which everyone has to follow in the process of hiring of employees. The procedure of hiring of employees can be uderstood from many aspects. If we want discusse it closely we must focus on one of them. These selected issues of the hiring of employees are methods of hiring and protection of personal data which is connected by employer with application of methods. Moving information system in the cloud.

This thesis deals with the theme Moving information system in the cloud. The paper first describes the issue theoretically. It is defined and characterized by cloud computing as the current major trend in the implementation of information technology. A description of individual actors and models emerging in cloud computing, its brief history, related technology underlying or expand cloud computing, client issues and reference architecture model. It also includes an analysis of the current state offered cloud services, compared to open source and proprietary solutions, and was implemented insight into the upcoming National Strategy for Cloud Computing The case study move e-mail system to a hosted private cloud is demonstrated by the complexity of the entire process and the rugged environment of government institutions. On the basis of theoretical knowledge and case studies in the last chapter proposes a model that would in general help in deciding whether the institutions of government information systems migrate to cloud computing, which is also in line with the forthcoming national strategy.
Personality Protection and Camera Systems

The thesis deals with the protection of individual integrity and camera systems, through the lens of valid and effective law regulation. The content of this work is formulation of theoretical basis, an analysis of relevant laws governing the issue of individual integrity protection of natural persons (especially their privacy) and camera systems, specifically for each type of camera system: the camera system with recording, camera system without recording, comparison of both types of camera systems and an account of legal instruments available for protection of individual integrity of each person, whose universal individual integrity rights were violated due to the operation of a camera system (regardless of it's type). The theoretical basis is followed by the main body of work, which explores researching camera system usage within a specific public authority agency. The operation of camera system is subjected to critical legal analysis, where particular aspects of a specific public authority subject's practice is evaluated as part of the findings of the thesis and qualified as compliant or non-compliant with the law. At the end of the work, the author formulates specific recommendations to the public authority agency, aiming to improve the approach to operating a camera system from the legal point of view.
