Europeisation of Czech Criminal Procedure Law

The topic of this thesis is the Europeanisation of Criminal Procedural Law in the European Union region and in the Czech Republic. The thesis deals with the general questions of Europeanisation of Criminal Law including definition of the institute of Europeanisation of Criminal Law, outline of historical evolution of Europenisation and characteristic of the sources of law and besides concentrates on basic instruments of Europeanisation of Criminal Procedural Law, institutional framework for cooperation and the position of victims and aggrieved person. The last chapter deals with the analysis of fundamental rights and freedoms in the criminal procedure within the process of Europeanisation of Criminal Procedural Law with a view to the judicature of the Court of Justice of the European Union.
Europeanization of Czech labour law

The purpose of this thesis is to analyse not only the general topic of the europeanisation but also the topic of the legal europeanisation as such. This thesis is divided into eight parts. Chapter I provides a general introduction of the europeanisation and it also sets down the goals of this thesis. Chapter II aims at the general overview of the labour law. Chapter III deals with the European Union and the European law. This chapter is divided into two subchapters. The first subchapter goes in mainly for the development of the European Union. This is followed by the second subchapter dealing with the development of the labour law in the European Union. European labour law has been developing long time and can be divided into three time lines. Chapter IV engages with the topic of the europeanisation. Firstly, the terminology is reconciled and afterwards it continues with the europeanisation in common sense. Also some definitions and opinions from authors dealing with the Europeanisation are taken into consideration and pointed out. Europeanization of the Czech Foreign policy and the impact of the Presidency in the Council of the EU: The case of the Israeli-Palestinian conflict

This diploma thesis applies the theoretical concept of Europeanization on a research of the Czech foreign policy and its changes in relation to the presidency of the EU Council. As a case study, it analyses different Czech and EU's positions towards the Israeli-Palestinian conflict and then by comparison of both levels it determines the misfit between Czech and the EU's policies in the mentioned agenda. From historical point of view and from contemporary perspective as well, the Czech Republic is famous for very pro-Israeli attitudes. On the other hand, the EU is significantly focused on supporting of the Palestinians and building the Palestinian state. The research is divided into three periods: before the Czech Presidency of the EU in the years 2004-2008, during the Czech Presidency and then after the presidency until the end of 2010. The aim of the research is to evaluate changes of the misfit between the Czech domestic attitudes and the EU's positions by the example of the Israeli-Palestinian conflict's issues and then to find out whether the Czech foreign policy has been europeanized during the studied period. Bilingual schools and European projects

The theme of this dissertation thesis is the relation of bilingual education and educational projects aimed at European issues. The research part was conducted at bilingual upper secondary schools in the Czech Republic, Germany and Great Britain (Wales). In the thesis the themes such as European politics, intercultural dialogue, international peace, human rights, humanitarian aid and language education are primarily included into European issues. The empirical research was deliberately realized at bilingual schools, where the instruction is delivered throught the medium of two languages. With regard to this fact a frequent participation at educational projects with European focus (European projects) was anticipated at these schools. European projects are often interconnected with the laguage studies. In recent years education projects have been an important part of the curriculum in Czech, German and British environment and they play a vital role in education context. The projects enrich the bilingual instruction from both methodical and content perspective and enable launching cooperation between schools and other partner institutions. The Socialization of Czech Political Actors. The Attitude of Czech Politicians towards the Iraq Invasion in 2003

In the 1990s when enlargement of Euro-Atlantic organizations was slowly becoming reality, a theory exploring interaction between an organization and its member states gradually resigned from primary perception of the state as a socialized actor (socializee) and this concept was substituted by the notion of political actors. It was the theory of socialization that became more and more important in terms of examining impact of political organizations on political representatives of Member States, their behaviour and possible interaction between them. This recent and dynamic theory was often confronted with obstacles, especially in terms of its theoretical anchoring. Even within the framework of ongoing academic debate, this theory did not obtain clear recognition. Researches examining causal relationship between socialization and subsequent behaviour of politicians come up with various results. The aim of this thesis is to enter into this debate and verify the hypothesis assuming that the decisions of foreign policy actors are influenced by socialization of respective political actor. Europeanization of substantive criminal law Petra Meinlová This master thesis is focused on the development of police and judicial cooperation in criminal matters in the European Union and the Europeanization of particular crimes. The thesis is composed of four chapters. The introductory chapter defines basic terminology, the European Union with its powers, the European law and the main legal instruments with the effect on criminal law, and finally the part investigating the idea of Europeanization of criminal law. Chapter two focuses on the definitions of police and judicial cooperation in criminal matters. The cooperation in criminal matters is very problematic in relation to the state sovereignty, second part of the chapter outlines the main features of this relation. Chapter three describes the evolutionary process through which the European Union has acquired the competence over criminal law affairs. The cooperation in criminal matters is relatively new field of the European integration. The Legal Nature of the Schengen Acquis

The Legal Nature of the Schengen Acquis Mgr. Robert Solich Abstract The thesis deals with general legal aspects of the Schengen acquis which represents a set of rules relating to the lifting of the border control at internal borders of the states concerned. It especially focuses on internal structure of the Schengen acquis, at its legal effect and legal forms with their mutual relations during particular phases of the development of the Schengen acquis. The author describes in detail the process of europeisation of the Schengen acquis, which was originally created as a legal subsystem of international law based on the "Schengen agreements" and later integrated into the framework of EU on the basis of the Treaty of Amsterdam. The author elaborates the question of legal effects of the acquis integrated in the EU and its co-existence with newly adopted Community or Union Schengen acquis. Within the analysis, the changes stemming from the Treaty of Lisbon are taken into account as well. The thesis further deals with territorial scope of the Schengen acquis and the EU case-law relating to the acquis in question.
Czech non-governmental organisations and EU climate change policy

The thesis aims to analyse the relations of non-governmental organisations towards the European integration process, which creates an additional platform for their interest representation. This case study focuses on how Czech non-profit organisations, which are dealing in long term with the topic of climate change, try to use the instruments and channels available at the EU level to promote their idea of the 2030 Climate and Energy Framework targets and how the EU climate action policy translates to their understanding of the topic. The thesis is based on the Europeanization theory that assumes that non-state actors are adjusting their behaviour to the existence of another platform of decision making and interest representation. I, therefore, assume, that the selected sample of Czech ecological NGOs tries to actively use the opportunity to participate in the EU decision making - especially because a climate policy is decided mostly at the EU level and therefore the outcomes, such as the 2030 Framework, present another tool to achieve change in the climate policy of the Czech Republic. It gives overview of the field of studying europeanisation -- ist development, terminology and various attitudes towards this topic. The tesis tries to resolve the question, whether German asylum policy and its major changes in the 90s were affected by the EU, or if Germany actively tries to influence the common European asylum policy.
