Private international law in a comparative perspective - a comparison of the conflict of laws rules of family law in the Czech and French legal orders

55 ZÁVER Medzinárodné právo súkromné je veľmi náročnou oblasťou práva a v súdnej, ako aj advokátnej praxi čoraz častejšie potrebnou. Vzrastajúci význam medzinárodného práva súkromného je citeľný aj v komunitárnom práve. Predmetom tejto práce bolo porovnavanie kolíznych noriem na úrovni mikrokomparácie s cudzím prvkom medzinárodného práva súkromného. Táto práca bola zameraná len na porovnanie kolíznych noriem, no netreba zabudnúť, že súčasťou medzinárodného práva súkromného je aj právo procesné. Témou diplomovej práce je - Medzinárodné právo súkromné v porovnávajúcom pohľade - porovnanie kolíznych noriem rodinného práva v českom a francúzskom právnom poriadku. V tejto práci sme sa zamerali predovšetkým na platnú českú a francúzsku úpravu kolíznych noriem rodinného práva v oblasti medzinárodného práva súkromného. Samotnou mikrokomparatistikou jednotlivých inštitútov rodinného práva sme sa snažili čo najjednoduchšie poukázať na rozdiely, ale zároveň aj na spoločné znaky obidvoch národných úprav. Základný a kľúčový rozdiel obidvoch národných úprav môžeme pozorovať už v samotnej forme úpravy medzinárodného práva súkromného. Somatomotor and somatosensory modulation of pain in the EEG and fMR image

Pain processing is modulated at different levels of the central nervous system by concurrent sensory and motor processes. From previous studies with innocuous somatosensory evoked potentials we know of the phenomenon of gating by movement. The classical explanation [Melzack R, Wall PD. Pain mechanisms: a new theory. Science 1965;150(699):971-979.] of the mechanism of gating in the posterior horn of spinal cord is complemented by other, lesser understood data, suggesting supraspinal mechanisms. A similar lack of understanding of the cortical mechanisms is seen in pain modulating methods using concurrent electrical nerve stimulation. This work is intended to further our understanding of the cortical mechanisms of pain modulation in the specific cases of (a) isometric muscle contraction of the right or left hand during painful electrical intraepidermal stimulation of the right index finger and (b) during observation of the acute effects of concurrent innocuous median nerve stimulation on painful tonic thermal stimulation of the thenar eminence.

Stimulation of employees as a part of social services management (surveying of stimulation instruments in selected non-profit organisations)

Ve své diplomové práci se zabývám problematikou stimulace pracovníků v sociálních službách. Stimulace představuje významnou oblast řizeni lidských zdrojů; je součásti celého řizeni (managementu) organizace. Člověk je nejcennějšim zdrojem jakékoliv instituce. V organizacích, které poskytuji sociální služby, jsou pracovnici zdrojem klíčovým, protože právě oni realizuji cile a posláni organizace, a to vedle dalších činnosti především v podobě přimé práce s klienty. Působeni v sociálních službách svým charakterem patři mezi velmi namáhavé profese, neboť v přimé práci s klienty se pracovnici denně setkávají s nelehkými životními osudy, jež se jich lidsky dotýkají, a tak se často se musi vyrovnávat s emočně náročnými a vypjatými situacemi. Charakter jejich práce vyžaduje porozuměni a ochotu naslouchat problémům a potřebám druhých a nepřetržitou připravenost na kontakt s klienty. To vše čini jejich práci mimořádně psychicky náročnou. Pokud organizace chce poskytovat kvalitní služby na profesionální úrovni, měla by též kvalitně a profesionálně pečovat o své pracovníky. Právě z výše uvedených důvodů považuji problematiku stimulace pracovníků v sociálních službách za téma, které si zasluhuje pozornost. Pracovnici potřebuji být ve své činnosti dostatečně podporováni a motivováni k odváděni kvalitní práce. Management...

Provincial town, culture and etnography

Eleonora and Marie Prosek were the teachers and ethnography research workers, which on the break 19 and 20 century worked in Turnov. Their fates show us what acceptance had ideas of women emancipation among active women in small provincial town. Their interest in ethnography show us beginning of ethnography as a scientific branch and what importance had women in that. Eleonora was born on 13 th December 1844 in Prague and Marie was born on 10 th February 1858 also in Prague. Sisters obvious come from family, which came under the middle classes. In Prague sisters attended the school. Sisters were venerable much distant and so possibilities of education they had different. Eleonora gained education of teacher of needlework, but Marie was able to gain education on school for teachers and started to teach also specialist subjects. To Turnov came Eleonora in 1872 and started to teach needlework on school for girls. In this time she was interesting of national dresses and textile. This interest she specified from 1886 in cooperation with museum in Turnov. She cooperated also on preparation on big exhibitions in 90. 19 century, which took place in Prague. Domestic Violance and NGOs Dealing With This Problem

This master's thesis is concerned with domestic violence against women. After an introduction to the concept of domestic violence and its forms, the thesis presents the approach of the Police of the Czech Republic to this issue and its practical involvement. At the same time it gives an overview of domestic violence oriented NGOs and analyses their activities according to the specific criteria designed for this purpose by the author of the thesis. Finally, it evaluates the present situation in the fight against domestic violence in the Czech Republic.

EÚ, the effectivitz of its institutional system and her ambition to become one of the world economy's poles

The aim of this thesis is to observe the EU's institutional system from the viewpoint of its effectivity and impact on the economic growth and various trasnmission mechanisms. The EU is a group consisting of 27 countries from different cultural backgrounds, with different national mentalitities, economic, social and politic systems. The economical and political integration is not taking place in a spontaneous way, as a process of continuous cognition, analysis and learning from mistakes, but according to a plan comming from upper political levels and with emphasis on the aims more than on the means. In the EU there are at least 2 levels of legislature, executive and jurisdiction, each on the national and supranational level. The nature of these 2 levels is rather parallel than vertical. An important link and therefore effective feedback is missing between the supranational level and the national level represented through the vote of the population and the performance of the economic environment. Constructivistic efforts are encumbering the economy of the EU with balast, that can be understood as a pool of from the system arising ineffectivities. The result of this balast is an inhibition of the economic growth despite declarations to accelerate it. This thesis will observe these ineffectivities through a more detailed analysis of macroeconomic fields as are monetary policy, labour markets and tax systems. The emphasis will be put on concrete impacts of supranational policies on individual countries, areas inside the EU and the EU as a whole. The USA will serve as a benchmark, because the EU has the ambition to get ahead of them as the world largest economy and that by the year 2010. The nature of these ineffectivities is of a rather hidden nature and therefore I will preffer the studying of literature in fields of interest as a mean of identifying the ineffectivities rather than atual quantifications.

New Housing Production after 1989

The aim of this Diploma thesis is a survey and analysis of housing productin in broader context of transformation period after 1989. The basis of this paper are the expert opinions published in a domestic and a foreign literature. Fundamental method of my research is secundary data analysis published mainly by the ČSÚ and the Eurostat. Although the dominant theme of this paper is housing production, sufficient space is dedicated to the factors, that are influencing it, like historical development, regional, housing, social and economic policies, economic process, society structure, other economical faktors and many more. Extra focus is dedicated to the present problems of housing, particularly to the condition of concrete blocks of flats, on the first sight the most intensive legacy of the past.

Search of the most suitable method of estimation of output gap for the czech economy

By monetary policy decisions, central banks use output gap to keep macroeconomic variables at their natural levels. A substantial disadvantage of this variable is the fact that it is an unobservable variable which is very problematic to measure, although it is possible to estimate it with various methods of estimation. This thesis aims to find the most suitable method of estimation for Czech economy. Thirteen methods have been chosen for this aim: linear trend, quadratic trend, HP filter, band-pass filters, robust trend, univariate unobserved component model, two types of production function, two SVAR models, multivariate HP filter and multivariate unobserved component model. Own estimations have shown that estimated trajectories of unobservable states were not identical. For own selection of the most suitable method of estimation, quantitative (ability to forecast inflation ,a growth of product and data revisions by selected national and international organisations) and qualitative criterions (qualities of methods of estimation, transparency and easy application) have been selected, where emphasis was put on quantitative criterions. Results of this thesis will show that the most suitable method of estimation output gap for Czech economy is multivariate unobserved component model.

Analysis of the pension systems of Czech Republic and Slovak Republic and their comparison in the years 1993-2015

The aim of this thesis is the analysis of pension systems in the Czech and Slovak Republics. The result of this analysis is the evaluation and comparison of these systems and their functionality for the needs of present and future generations of retired people. In 2016, the second pillar of the pension system in the Czech Republic was cancelled. This pillar was established in 2013. Its creation and existence was deemed unsuccessful. In contrast with the Slovak system where the second pillar operates eleven years and has a large number of participants. Theories of causes of failure of the second pillar in the Czech Republic in the last year came up a lot. The importance of initial conditions of the other pillars in the pension system before the reform was crucial for the success of the new, now canceled that second pillar. The theoretical part of thesis studies social policy, its divisions and implementation. Subsequently there are descriptions of general models of pension systems, their financing methods and possibilities of implementation. The practical part analyzes the historical development and current form of pension systems in the Czech and Slovak Republics. It also describes ways of contribution, profiles of participants, payment options and risks of individual pillars. At the end of the practical part is the comparison of both systems, with projections of possible developments in the future.

Fiscal rules in the Czech republic after joining the EU

This thesis concerns fiscal rules which represent a possible solution of excessive deficits of public budgets. The chosen topic is very relevant as most developed countries are now facing the problem of fiscal imbalance. The aim of the thesis is to analyze existing rules in the Czech Republic and to formulate recommendations for its public budgets with regard to the specifics of the economic and political environment. The main hypothesis is that fiscal rules in the Czech Republic are not well designed and do not contribute to the stabilization of public finances. This hypothesis was partially proved true. Proposal to strengthen the fiscal framework by implementation of the reform of medium-term expenditure frameworks and by adopting debt rule at the constitutional level results from the realized findings. Further recommendation is to establish independent fiscal institution that would oversee the fiscal policy in the Czech Republic.
