Optimal regulation of order in satisfying of claims of unconsensual creditous in the insolvency proceeding

Optimal protection of creditors is an important part of insolvency law as well as legal and economic environment. The group of nonconsensual creditors invokes a lot of discussions, because these creditors didn't accept the relation with debtor voluntary and they possibly could suffer a big loss. The most of experts agreed with the necessity of protection for this group. The main suggestions are upward move in the priority ladder or the introduction of personal liability of shareholders. The work first describes the attributes of optimal legal regulation. The core consists of characterization of nonconsensual creditors and description of reasons why they should be given "superpriority". Second part is discussion about personal liability of shareholders for corporate torts. Práce se snaží postihnout nejen přípravu Taroucy na celoživotní dílo, ale snaží se postihnout principy tvorby a celkovou kompozici, která vyplývala z ojedinělého terénu. V práci je popsaná i nerealizovaná část parku.

Czech supervisor authority in the consumer protection

Diploma thesis is aimed at the Czech supervisor authority in the consumer protection. The main object is to find out Czech consumer awareness of the working of The Czech Trade Inspection Authority. Necessary information is found out using questionnaire survey and controlled depth interview. On the basis of observed results the recommendations for improvement are suggested.

The comparison of the consumer protection in the Czech republic and Germany

Nowadays, during the era of the international trade's liberalization, the efficient consumer protection is very important, especially to the advanced countries. The consumer policy is changing and developing continually in order to protect consumers sufficiently and not to restrain producers and dealers overmuch. At the beginning of my Bachelor thesis, fundamental terms and theory connected with the consumer protection is mentioned. The main part deals with the comparison of the consumer protection in the Czech Republic and Germany especially focused on the legal regulations and consumer policy institutions in both the countries. There is some information about the historical evolution of the consumer protection mentioned, as well. The last part includes summary of the important facts and distinctions between the solutions of the consumer protection in both the countries.

Extrication of Persons Trapped in Crashed Vehicles with Respect to their Construction

This thesis deals with the topic of extrication of people trapped incrashed vehicles regarding the construction of the vehicle. Part of the resources needed for this theses was taken from a literary survey drawn up with the help of the Research and scientific library in Hradec Králové according to the given topic and key phrases. The first part of the thesis deals with specific parts of the constructions of cars. This part is followed by description of road accidents, various kinds of accidents and possible deformations of cars after accidents. The thesis deals with extrication itself made by fire brigades, suitable procedures, kinds of interventions and means of used technical equipment. Another part suggests ways of saving trails and evidence during road accident interventions. Final part of the thesis is focused on overall analysis of the given problem based on personal experience, suggestions, negative aspects of the current situation and differences in training of possible situations with reality at the site of the accident.

77 11 RESUME Legal capital de lege lata and de lege ferenda In the dissertation "Legal capital de lege lata and de lege ferenda", I draw attention to the current situation of registered capital of public companies and the theoretical concepts. In order to understand the role of the registered capital within the system of law, I analyse the historical basis of the concept and system of protection of creditors in company law. I deal with the role of registered capital for company by itself as well as with its function how to protect shareholders and creditors. The guiding objektive of this study is evaluace the feasibility of an alternative to the current regime of legal capital established by the Second Copmapy Law Directive and by legal framework set in Czech Commercial code (code 513/1991, subsequently amended). One building block of current capital regime of the EU and of the Czech Republic is the concept of a subscribed capital which is protected from distributions. The concept of subscribed capital is extended to the Second Directive's approach to capital maintenance, which provides restrictions on share repurchases, capital reductions, the withdrawal of shares and financial assistance. Consumer protection in the European Union

This thesis is focused on consumer protection in the European Union with a special emphasis on online shopping. The first section defines the term 'consumer protection', its development, institutional support, instruments and financing. Also, this part describes the digital market of the European Union, hindrances to the growth of online shopping as well as strategies which are created in order to form a digital single market in the European Union. The second section focuses on protection of personal data, alternative dispute resolutions, current legislation regarding consumers rights on internet and new proposals from the European Commission. The new proposals dominate the second part of this thesis and are discussed with an expert. A survey has been conducted to find out more about the Czech experience with problem solving when shopping online. Moreover, this thesis does not leave out court orders from the European Union´s Court of Justice which have led to the uniform application and interpretation of the consumer protection in the European Union.

The Antitrust policy of the Czech Republic and the European Union in the conclusion of the cartel agreements

This work deals with the detecting the cartel agreement, which are closed by the companies to assure their gains. However these agreements are in many countries prohibited. Antitrust institutions guarding the competition on the markets detect and punish cartel agreements and similar efforts of companies to protect the competition. The main goal of this work is the analysis of leniency program's efficiency, which is used to detect the cartels. I examine the functioning of leniency program in Czech Republic and European Union, number of cases, successes in detecting the hard-core cartels and the differences in final fines after the judgments. Finally I summarize my knowledge information and opinions of the leniency program and the problem with cartels in general and I suggest the possible ways of improvement.

Legal status of a victim of domestic violence

The topic of my thesis is Legal Status of a Victim of Domestic Violence. It is devoted to domestic violence as a contemporary phenomenon and to the legal status of its victim. The purpose of the thesis is to analyse relevant Czech legislation and compare it with the real needs of a victim of such treatment. It attempts to give to the reader a comprehensive overview of this topic and also to suggest some amends aiming at better protection of the victim of domestic violence. The thesis consists of five chapters each of them dealing with different aspects of domestic violence and position of its victim. Chapter one is called The concept of a domestic violence: explanation and is subdivided into five parts. The first part deals with the definition of the concept and its elements. Part two lists kinds and forms of violent conduct. The third part points out the psychological consequences the victims of domestic violence may suffer from, such as the so called battered woman syndrome. Part four suggests that not only women may be victims of domestic violence and deals with selected specific aspects of situations when men, children or elderly people become victims of domestic violence.
