Škarpichová, Jarmila ; Svoboda, Pavel (advisor) ; Král, Richard (referee)
OMISSION OF EU's MEMBER STATES LEADING TO THE LIABILITY FOR DAMAGE RESUMÉ This thesis deals with the responsibility of the member states of EU for damages caused by failure of member states. Both problems are solved in this work, as general requirements for liability relationship, as description of these failures modes with numerous references to case law of the European Court of Justice. Indeed, case law represented a huge range of sources for this thesis. To sum up the work into several points, we can start by making a breakthrough in the issue of liability in the European Union which Francovich case meant. This case established the rule that it is the responsability of member states to implement EU law properly and in time and provide protection to the rights that follow these standards. This rule was followed by other cases which are called "the first generation of cases liability" by many authors. Typical liability sentence: unlawful act (caused by the EU's institution), the damage suffered by the other party and the causal nexus, was subsequently supplemented by the Schöppenstedt criterion, which established the rule that during the process of adopting EU's legislation must be sufficiently serious breach of the law standards, which serves to protect the individual. The last unification of the...

Wygrysová, Dominika ; Kasáková, Zuzana (advisor) ; Šlosarčík, Ivo (referee)
The bachelor thesis deals with the role of the European Parliament in decision-making process in European Union under the co-decision procedure. By using the theory of liberal integovermentalism it reflects on wheter the position of the Parliament is mainly influenced by preferences of its political groups, or whether the national interests of those backbenchers, who depending on their position in the institution are able to influence this position, also play the role. The paper focuses on the case study of the Services Directive, which during its negotiations became a subject of many changes. Most controversial issues of the draft were a scope of the Directive and newly introduced country-of-origin principle. The first part of the paper introduces different paradigms of the European integration, which could influence decision-making process. The second part presents key players of the negotiations within the Parliament. The third part itself focuses on the case study, mainly on the preferences of those key players during the development of the position of this institution. It later shows how those key players are able to assert their position in the Parliament and during the inter-institutional negotiations. The paper mainly focuses on the possibilities of those key players to promote the national...

European directive on nuclear safety: Council decision making in 2004, 2009 and 2014
Kulda, Tomáš ; Weiss, Tomáš (advisor) ; Tomalová, Eliška (referee)
Even though nuclear energy was one the first areas in which European countries started integrating their policies through the European Atomic Energy Community (Euratom), the question of nuclear installations safety was only addressed by the EU in the context of the impending enlargement of the Union in 2004. In 2003, the European Commission submitted the first-ever proposal for a European directive on nuclear safety. However, the Council rejected it the following year, opening a five-year-long debate leading to the drafting of a new directive proposal, which was subsequently adopted in 2009. Only two years later, in the wake of the 2011 Fukushima disaster, amending this directive became necessary. Discussions resulted in adopting the amended legislation in the summer of 2014. This master's thesis analyses the main factors influencing the Council's decision-making on either rejecting or adopting the proposed directives in 2004, 2009 and 2014. The analysis is based on the following five scope conditions supposed to lead to integration acceptance by EU member states, as defined by authors Manuele Citi and Martin Rhodes: policy failure and availability of a successful alternative, external influence emanating from foreign countries hardly manageable by the individual states, functional interdependence...
