Movement and hazardous wastes management from the perspective of international law
Diblíková, Anna ; Damohorský, Milan (advisor) ; Sobotka, Michal (referee)
89 Summary Movement and hazardous wastes management from the prespective of International law. The purpose of this thesis is to examine the movement and hazardous wastes management or more precisely the international and European law that regulates it. The movement, particularly the transboundary movement, and the management belong to high risky activities considering the protection of human life and the environment. Hand in hand with the management of radioactive waste and chemical substances, they fall under the subject matter of International Environmental Law (IEL). Most of the sources of IEL are not binding "soft law" due to the delicacy of the subject matter on which is hard to get a global consent. In the centre of the attention is the Basel Convention on the Control of Transboundary movements of Hazardous Wastes and their Disposal. Unfortunately it can not be described as a global convention, because the contracting parties are virtually only states of the Euro-American region. On the other side stands the Bamako Convention which was prepared by the Organization of African Unity and which placed the total ban on imports of hazardous wastes to the African continent. International law is to be considered just one layer of the analysed legislation. Second one is the European law. Europe Union regulates...

Fornůsková, Michaela ; Žákovská, Karolina (advisor) ; Stejskal, Vojtěch (referee)
GENETICALLY MODIFIED ORGANISMS AND LEGAL REGULATION OF THEIR USE ENGLISH RESUME This thesis aims to give a complete insight into the framework and problem questions arising in connection with legal regulation of genetically modified organisms (GMOs). The use of genetic modifications as one of modern techniques of biotechnology has spread widely during last fifty years. This technology has brought many advances. On the other hand as any new technology it represents potential adverse effects on biological diversity and possible risks to human health. At the beginning there is a brief introduction into GMOs from historical and technical point of view. Then I dealt with biosafety measures adopted at global, regional and national levels. The main principles of environmental law take part afterwards. I am focusing mainly on prevention and precautionary principle. International law relating to the GMOs consists of soft law documents. There is only one exception - Cartagena Protocol on Biosafety focusing on transboundary movement. The Law of EU comprises of Regulations, Directives and Recommendations. Notifications, approvals, risk assessment and monitoring are consequential. The Czech law has been harmonized according to the law of the European Communities. Act no. 78/2004 Coll., on the use of GMOs and genetic...

Conflict Prevention in Uzbekistan and Turkmenistan
Zalánová, Zuzana ; Klimešová, Martina (advisor) ; Ditrych, Ondřej (referee)
This diploma thesis deals with conflict prevention in Uzbekistan and Turkmenistan. Its aim was to compare its relevance and results in the both countries. In doing so, the first theoretical section outlined the way of assessing conflict potential, which conditions and justifies applying preventative measures. This was examined in terms of Copenhagen school and its broaden meaning of security, whereas the paper focused on the political, economic and societal dimension. Then the notion of conflict prevention was framed within terminological and historical context and considered in terms of its trends and current challenges. At the end of the theoretical section, the concepts if security dimensions and conflict prevention were discussed in terms of their applicability for the case studies of Uzbekistan and Turkmenistan. Afterwards, the empirical section researched the conflict potential and preventive actions of international organisations, states and non-state actors in the both countries. Analytical part evaluated the empirical data in order to assess conflict prevention in the both states. In doing so, I used SWOT analysis, which defined strengths, weaknesses, opportunities and threats of conflict prevention in Uzbekistan and Turkmenistan. The results can be summarised as follows: The character...

Jelínková, Petra ; Tichý, Luboš (advisor) ; Svoboda, Pavel (referee)
The subject of my master thesis is the EU directive 2004/35 on environmental responsibility, prevention and damage redress, its implementation into the legal order of the Czech Republic and the potential impact of undue transposition of the directive. The first part of my thesis deals with the harmonization need in this area and with the directive itself. Following a brief introduction of the directive, I'm presenting an overview of its basic institutes and their legal form. I'm also making an effort at identifying possible shortcomings of the directive. The basic institutes of the directive include: key principles, the environmental damage itself, operational activity, responsibility mechanisms, financial safeguards and the administrative procedure to impose a preventive or a remedial provisions. The second part of my thesis deals with the theoretical aspects of appropriate implementation, such as the interpretation of the directive, a timely adoption of the transposition provisions, proper projection of the content of the directive, due form of the transposition provisions, the application of EU norms, the equivalence and effectiveness imperative and the internal Czech rules for the implementation of EU norms that have been laid down by the governmental provision Nr. 1304 (methodological directions). Necessity of leisure time centre for seniors and volunteer potentialities
