Special Methods of Evidence in Criminal Proceedings Focused on the Lineups of Suspect

The goal of this thesis is to take a closer look at the special methods of gathering evidence which have become a part of the Criminal Procedure Code. In the past, these acts were considered as a special form of interrogation or examination. Firstly, the thesis deals with the historical development of the search for truth which was from time immemorial associated with perpetrator's confession as an indisputable proof of guilt. Specification of related terms both from the area of criminalistics and criminal law will follow. The next part will be devoted to the relation between criminalistics and special methods of gathering evidence, especially in the elimination of contradictions in the obtained evidence. In order to understand better memory limit options by recalling the backward image of perceived reality we will mention the mechanism of memory imprints origin.Part four analyses the general principles of these acts and in the fifth part we go through some special methods of gathering evidence. In the sixth, penultimate chapter, we discuss the recognition in detail as a special way of identifying the object. In the final part we will deal with the consequences of defects in the process and try to solve some problems in order to result in proposals de lege ferenda.
Interaction investigator with selected participants of criminal proceedings and its impact on based recognition

(in English): The thesis "Interaction of police investigators with selected participants of criminal proceedings and its impact on recognition" is studies the interaction and communication of criminal proceeding participants and its influence on the quality of those proceedings on recognition. The theoretical part deals with criminal proceedings such as all the trial requirements and factors which affect police investigation. Rights and responsibilities of all participants of trials are defined. Furthermore, communication, its types and categories and -most of all -its impact on successful police interrogation is examined. We also mention interpersonal perception. In the theoretical part of the thesis a lot of attention is devoted to the personality of police investigators and to significant characteristics which form the foundation of police profession. In conclusion of the theoretical part we describe the aspects which control the investigation and potential offender recognition. In the empirical part the aim was to find out what impact the quality of instructions has on successful offender recognition. The empirical part was performed in an experiment. The special methods of proof in criminal procedural law and comparison with anglo-saxon legal system

The goal of this thesis is to compare the special methods of proof in the criminal procedural law in the Anglo-Saxon coutries (England, Irend and Scotland). Firstly I will concentrate briefly on the history of criminal law in the Czech Republic, followed by a short introduction of the phases of the trial. Then, the special methods of proof in the Czech system of law will be focused on in detail (recognition, reconstruction, confrontation, on-site examination and the crime experiment). Then I will turn back to the methods of gathering special evidence in the Anglo-Saxon countries. When possible, I will point out the diferrence between both system in the chapters themselves as they arise, however in the I will conclude the findings in the final chapter if the thesis: how the methods differ and what they have in common. Recognition in the Investigation of Crime

The theoretical part deals with criminal proceedings such as all the trial requirements and factors which affect police investigation. In conclusion of the theoretical part we describe the aspects which control the investigation and potential offender recognition. The empirical part was performed in an experiment. The research participants were devided into categories according to chosen standards. Then they were presented with a video recording of a criminal offence followed by recognition. We targeted at discovering whether the instructions and the way they are given influence the results of recognition.

The topic of my thesis is a recognition in criminal proceedings. The thesis deals with recognition in terms of crimilonogy and criminal procedure. The recognition is one of the important evidence, which are often based on evidence in criminal proceedings. At first sight it may seem that a recognition is easy procedure in criminal proceedings, but closer examination reveals its complexity. The aim of the thesis is to introduce the recognition as a special way of proving and its specifics, summarization of the knowledge gained by studying textbooks and monographs, articles in journals and some judicial decisions, as well as outlining the selected questions and poiting out possible problems, especially the obligation of the defendant to attend the recognition. The thesis is divided into eight chapters, which are divided to subchapters. Following the introduction, the first chapter defines the concept of recognition, and then focuses on psychological basics of recognition, historical evolution of recognition as an evidence since 1873 and also its grounding in the Code of Criminal Procedure. Recognition - psychological context and impact of ethnicity of offenders

One of the problems in eyewitness recognition of offenders is their different ethnicity from the persons identifying them. This has been the subject of several scientific papers worldwide. Although the number of other ethnic groups in the Czech Republic grows, research into this area remains insufficient. Therefore, the present thesis focuses on ethnicity of offenders in the recognition process. Using video footage of an assault with Czech and Vietnamese offenders and subsequent mugshot facial recognition, the present thesis seeks to highlight the problem of a higher number of false identifications with persons having different ethnicity. Based on previous international research, the offenders' ethnicity is expected to have a negative impact on the ability to correctly identify perpetrators in the Czech Republic alike. The research showed a higher rate of false identifications of offenders with foreign nationality, but at the same time, nevertheless, found no relationship between correct identification of perpetrators with our and with foreign ethnicity.
