Working Time and Remuneration in the Healthcare Sector Abstract This thesis deals with selected aspects of labour law in the healthcare sector. The author focuses mainly on such areas of labour law that are most often discussed in the healthcare by both the professional public and healthcare professionals themselves. This is particularly the case of topics of working time and remuneration. The adherence to the legal regulation of working time is an essential requirement of the legislator for the employers. The provisions of the Labour Code governing the layout of shifts, overtime work and on-call duty are crucial particularly in healthcare and a higher standard of compliance monitoring is necessary. Thus, the part focusing on the topic of working time is not limited to an evaluation of the current factual situation only, but also presents findings as to whether the practice actually complies with the legal requirements. Another part of this thesis is devoted to the subject of remuneration, which is closely related to the issue of adherence to rules on working time in the healthcare sector. Determinants defining pay of NHL players

The thesis is focused on examination of various determinants having effect upon National Hockey League players´ pay. It also aims at the role of players´ individual skills, personality as well as characteristic of each club. I have decided to test pay determination on the base of Jones and Walsh model (1988), which uses a set of specific variables and is formed and tested for each post (goalkeeper, defender, forward). I enriched the model with other variables (market value of the club, annual profit, average price of a ticket). The empiric part contains regression analysis (OLS) of data sets of all players - newcomers in season 2015/16. Skill and experience of the players are the most relevant factors of the model. The influence of team characteristic appeared to be (compared to the previous research) statistically less significant (close to 0). Pay discrimination of European NHL players against the ones from North America was not proved. In spite of the supposition positive effect of European origin on players´ pay emerged.
The role of unions in promoting gender equality in employment relationships

Diploma thesis is focused on the issue of gender equality in labour relations in order to assess what role the trade unions can or could play in promoting gender equality. The theoretical part introduces the basic concepts of gender issues and outlines the historical development of unionization in the Czech lands. Attention is paid to legislative standards governing the conditions unionization and analysis of legal measures to promote equality in labour relations. The research focuses on analysis of the texts of collective agreements, and analyses semi- structured interviews performed with representatives of trade unions and the Committee on Equal Opportunities for Men and Women at Czech-Moravian Confederation of Trade Unions.

This dissertation is presented within the doctoral study on the Charles University in Prague, Faculty of Law. The presented dissertation addresses the issue of the status and activity of trade unions in labour relations. The dissertation deals with the conditions for legal foundation and creation of trade unions, the conditions for their operation at an employer, their organisational structure, the conditions for the dissolution and disbanding of trade unions. The dissertation is also devoted on the questions of plurality of trade unions, as well as the questions of jurisdiction and powers of trade unions in labour relations, focusing on the right of collective bargaining and the right to conclude collective agreements. The dissertation also deals with the collective labour disputes and the various methods of their resolving, focusing on the right to strike as an extreme means for resolving a collective dispute. The aim of this thesis called "The right to strike and lock-out" is to provide a comprehensive overview of the theory and practice of the right to strike. The thesis is divided into four separate chapters. The first one focuses on the theoretical aspects of the right to strike, a large space is devoted to the species and forms of strikes. The second chapter deals with the strike in the field of international law, in addition to describing the current law seeks to analyze the opinions of the relevant committees of the International Labour Organisation and the Council of Europe. The third chapter focuses on the right to strike in the legislation of the Czech Republic. Attention is paid to the right to strike under the Collective Bargaining Act. The last chapter deals with the right to lockout. The intention is a brief characteristics of this right of employers, as the counterpart of the strike.
Resolving disputes in labour law relations - czech-german comparison

Diese Arbeit ist als Übersicht der Wege der Lösungen der arbeitsrechtlichen Beziehungen mit dem Fokus überwiegend auf die kollektiven arbeitsrechtlichen Streitigkeiten konzipiert. Die Arbeit teilt sich auf drei Hauptabschnitte: die tschechische Gesetzgebung, die deutsche Gesetzgebung und dann ihren Vergleich. Ein unbeträchtlicher Teil der Arbeit verfolgt den Vergleich der Gerichtsbarkeit in Arbeitssachen, wo die tschechische Agenda im Rahmen der allgemeinen Gerichte gelöst wird und die deutsche das Institut der Arbeitsgerichte benützt. Das Kapitel des Vergleichs beginnt mit einer tabellarischen Übersicht des Verfahrens. Erwähnt ist auch die Effektivität beider rechtlichen Ausgestaltungen. Unwesentlich sind die alternativen Wege der Lösung arbeitsrechtlicher Streitigkeiten erwähnt, und zwar mit dem Vergleich der Schlichtung und der Mediation. Das Hauptthema sind die aus den kollektiven arbeitsrechtlichen Beziehungen entstandenen Streitigkeiten, insbesondere aus den kollektiven Verhandlungen in der Tschechischen Republik und aus den Tarifverhandlungen in Deutschland im Rahmen der Abschließungen der kollektiven (und in Deutschland der Tarif-) Verträge. NHL and crisis

Title: NHL and crisis Objectives: The goal of this diploma thesis is to analyze crisis of the National Hockey League and to make the economic forecast of the league and chosen clubs. Other goals are to introduce the league, its game system and the way of leading. Then to make an analysis of each crisis which the NHL went through during its history and to identify their causes. Methods: A qualitative and quantitative research, concretely descriptive analysis and the linear regression, which was made by the Microsoft Excel programme and its function TREND, were used in this thesis. Descriptive analysis was used for introduction of the National Hockey League and for definition of the main terms about the topic. The Microsoft function TREND was used for the forecast of the NHL and NHL team's economic situation. Results: Result of this diploma thesis is a summary of the most important terms and facts about the National Hockey League. Also a summary of the NHL crisis and an identification of their reasons. The main reason is that the team owners have completely different interests than the players, which can result to the lockout. The lockouts harm the richest teams and help the poorer ones, sometimes it can even solve them from bankruptcy. The biggest problem has been the high level of player's salary....
Comparison of the regulation of collective agreement in Germany and the Czech Republic

Resümee Die vorliegende Diplomarbeit setzt sich mit dem Thema des Vergleichs der deutschen und tschechischen Regelung des Tarif- bzw. Kollektivvertrags auseinander. Zielsetzung der Arbeit ist, das Institut des Kollektivvertrags einschließlich der damit zusammenhängenden Institute zu verdeutlichen und zugleich mit Anwendung der vergleichenden Methode die Bewertung der aktuellen Rechtslage in der Tschechischen Republik und in der Bundesrepublik Deutschland darzulegen. Der erste Teil der Arbeit untersucht den breiteren Kontext des kollektiven Arbeitsrechts, seine historische Entwicklung und Rechtsquellen. Als nächstes wird die Problematik der Formen der kollektiven Arbeitsverhältnisse mit der Zielrichtung an das Recht der kollektiven Verhandlung beschrieben. Darauf aufbauend wird im zweiten Teil die Rechtsregelung des Tarifvertrags in der Bundesrepublik Deutschland analysiert. Der Schwerpunkt liegt vor allem in der Erörterung des zu dem Tarifvertragsschluss führenden Prozesses, dessen Verlauf für den Inhalt des Vertrages entscheidend ist. THE RIGHT TO STRIKE AND LOCK-OUT ABSTRACT The content of this thesis is to outline the issue of strikes and lock-outs in the Czech republic, both in terms of current legislation, as well as in future ones. On previous pages I try to describe strike actions from the historical and economic points of view, but I also try to compare their individual characters within the EU countries and to accent their specific features and patterns, which are typical for the state or region. I spent an essentional part of my work by studying strikes not modified by acts and the questions of their legality. I gradually evolved into a full knowledge of complete state of freedom of association in our country because of Judicial decisions I didn't know before. I drew my conclusions primarily from literature, articles from distinguished academics and renowned experts and of course from court cases. The importace of legislative was relative because the lawmaker did not fully explore this area. I describe strikes and lockouts as a general phenomenon, whose presence is desirable in every developed community. But I also realized the individual typological aspects of employment law entities.
