Non-contractual legal institutions of the use of copyrighted work

The topic of my thesis is the analysis of non-contractual legal institutions of the use of copyrighted work, that means the means how to use a copyrighted work without the need to conclude an agreement with it's author. The wording of the thesis itself is divided into four chapters. After the brief introduction of the topic, I explain the basic relevant terms in the field of copyright and subsequently, I address the sources of copyright law on the national level, on the level of EU and finally, on the international level, with the analysis of the main sources. Before the attention is paid to the core of this thesis, I explain the concepts of copyrighted work and author. The fundamental part of my thesis contains the analysis of non-contractual legal institutions of the use of copyrighted work, whereas I address the very concept of these institutions and furthermore, I concentrate on free works, exceptions and limitations of copyright. In the follow-up part of the thesis, I adress the analysis of the particular free-of- charge, as well as chargeable statutory licences. The entire thesis emphasizes also the link with the EU law, accordingly, I mention several significant decisions of the Court of Justice of the European Union, whereas, some of them are examined in greater detail (e.g. the judgment in...

132 The Concept of a Work in Copyright Law Abstract The theme of the work is the author's creation , it's concept in the legal definition and further in the meta-legal sense,ie as defined by the authors's work of art,on the one hand by artists ,on the other by artistic institutions . Contract for work focusing on structure as a subject of a work Abstract The topic of this rigorous thesis is the legal regulation of a contract for work with a focus on structure as the subject of a work. Its aim is not only to provide the reader with a description of the obligation with the raising of problematic issues in practice, but also to try to answer them with the help of relatively extensive judicial decisions in cases where the explicit legislation is completely absent or unclear. The rigorous thesis is divided into an introduction, twelve chapters and a conclusion. The individual chapters are designed to make the reader think critically about the legislation chosen by the legislator, not only from the point of view of the letter of the law, but directly in relation to specific practical examples. When reading it, the reader will get acquainted in particular with the essentials of the contract for work, the manner of performance of the work, the issue of ownership of the construction work, the client's rights from defective performance or securing the contractor's obligations. This thesis focuses on the personality of a writer and humorist Jarmila Hašková. It deals with a biographical summary of the writer's life and author's bibliography overview. The thesis is divided into two main chapters, the first deals with the author's life and the second dedicates to the author's creation. The first chapter describes the author's childhood spent in a large family, but it was accompanied by frequent health problems, furthermore, a relatively dramatical relationship with a writer Jaroslav Hašek and a period of author's life after separation, when Hašková came with her son Richard back to her parents. She gained not only a permanent job but also she took up a literary activity completely. The second chapter deals with the author's work in detail, initially with the work's beginnings, which relate to poetry. After that, it deals with prosaic writings in which lied centre of her creations and, ultimately, other arts sectors such as film and radio Hašková devoted. The concept of the contemporary author in case of J. K. Rowling The diploma thesis deals with the contemporary concept of the author which is examined on the specific case of Joanne Kathleen Rowling. The theoretical part of the thesis focuses on the biography of the author and the previous philosophical theories concerning the concept of the author and his/her role in the identity of the literary work. The main authors of the theories are Roland Barthes, Michel Foucault, and Umberto Eco, whose concept is crucial for this thesis. The research part presents specific styles of writing which are characteristic for authors and applies this theory to the analysis of two literary works of J. K. Rowling. The conclusion of the thesis is the summary of the research and an attempt to define the concept of the contemporary author. Art criticism in magazine Dílo (1903-1949) Abstract Bachelor thesis Art criticism in magazine Dílo (1903-1949) deals with critical texts published monthly in journal Dílo, the magazine of "Jednota umělců výtvarných" society in the years 1903- 1949. In chronologically arranged chapters are the selected texts analysed, compared with texts from the rival journals, set in the context of contemporary artistic disputes and the chapters are completed with basic information about editorial staff and thematic focus of the magazine Dílo. In conclusion there is outlined an overall picture of the art criticism in magazine Dílo, its orientation, transformations, value and influence on the art scene in the first half of the 20th century.
