130 Pojem díla v autorském právu Abstrakt Tématem práce je autorské dílo, jeho pojem v právním vymezení, a dále ve smyslu metaprávním, čili jak vymezuje autorské dílo umění, jednak sami umělci a jednak umělecké instituce. A s tím souvisící ohraničení tohoto pojmu, jeho meze či extenze. Na jednu stranu se pojem autorského díla v praxi jakoby rozšiřuje, na druhé straně zužuje, jak vysvětlím. To znamená, že se musím nejprve blíže podívat na pojem díla ve smyslu autorského zákona. Jedná se o centrální pojem celého autorského práva, nicméně - a možná právě proto - jeho vymezení podle autorského zákona je hodně vágní. Po Úvodu, kde jsem se pokusil zamyslet nad vymezením a praktickými možnostmi právní vědy, se v první kapitole věnuji právnímu vymezení pojmu díla obecně a pak pojmu autorského díla. Myslím si, že jeho zákonná definice se do jisté míry točí v kruhu - autorské dílo je výsledkem tvůrčí činnosti autora, a autor je osoba vytvářející autorské dílo. To nedává příliš smysl. Nicméně odpovídá to vymezení podle mezinárodních úmluv a historicky je vymezení dostatečně zaužívané. Dále se v 1. kapitole věnuji judikaturnímu vymezení pojmu, a to jak našimi soudu, tak hlavně v judikatuře SDEU. A pokud začneme rozebírat jednotlivá zákonná vymezení, dostáváme se k dalším a dalším nejasnostem. Není přece vůbec jasné,... 132 The Concept of a Work in Copyright Law Abstract The theme of the work is the author's creation , it's concept in the legal definition and further in the meta-legal sense,ie as defined by the authors's work of art,on the one hand by artists ,on the other by artistic institutions . And, the related delimitation of this concept,it's limits or extensions.On the one hand ,the concept of an author's work seems to be expanding in practice,on the other hand, it narrows,as i will explain. This means that I must first take a closer look at the concept of a work in the sense of copyright law.It is a central concept of the entire copyright law,however ,and perhaps because of this,its definition under this law is very vague. After the introduction ,where I tried to think about the definition and practical possibilities of legal science ,in the 1 Chapter I deal with the legal definition of the concept of the work in general and then the concept of the author's work. I think its legal definition, to a certain extent,revolves around a circle,the author 's work is the result of the author's creative activity and the author is the person creating the author's work.
